In this Part, the word "person" shall mean and include any natural
person, partnership, association, firm or corporation. The singular
shall include the plural and the plural the singular, and the masculine
shall include the feminine and the neuter. "Township" shall mean the
Township of Valley, Chester County, Pennsylvania.

No person, owning or occupying any property in the Township
of Valley, shall permit any grass or weeds or any vegetation whatsoever,
not edible or planted and maintained for a useful or ornamental purpose,
to grow or remain upon such premises so as to exceed a height of 12
inches, or to throw off any unpleasant or noxious odor, or to conceal
any filthy deposit, or to create or produce pollen or to go to seed.
Any grass, weeds or other vegetation growing upon any premises in
the Township in violation of any of the provisions of this section
is hereby declared to be a nuisance and detrimental to the health,
safety, cleanliness and comfort of the inhabitants of the Township.

The owner of any premises, as to vacant premises or premises occupied by the owner, and the occupant thereof, as to premises occupied by other than the owner thereof, shall remove, trim or cut all grass, weeds or other vegetation, growing or remaining upon such premises in violation of the provisions of §
10-302.

The Township Supervisors, or any officer or employee of the Township designated thereby for the purpose, are hereby authorized to give notice, by personal service or by United States mail, to the owner or occupant, as the case may be, of any premises whereon grass, weeds or other vegetation are growing or remaining in violation of the provisions of §
10-302, directing and requiring such owner or occupant to remove, trim or cut such grass, weeds or vegetation, so as to conform to the requirements of this Part within seven days after issuance of such notice, in case any person shall neglect, fail or refuse to comply with such notice within the period of time stated therein, the Township authorities may remove, trim or cut such grass, weeds or other vegetation, or contract to have such work done, and the cost thereof, together with an additional amount of 10%, may be collected by the Township from such person in the manner provided by law.

Any person who shall violate any provision of this Part shall
be guilty of a summary offense punishable by a fine not to exceed
$1,000, together with all court costs and reasonable attorney's fees
incurred by the Township in such enforcement proceeding, and may further
be punished by imprisonment to the extent permitted for summary offenses.
Each day that a violation continues may be considered a separate offense.

The Township Code Officer, or any Township police officer, is
authorized to institute proceedings in any court to enforce the provisions
of this Part.
