This Part shall be known as the "Garage Sale Ordinance of Valley Township."

As used in this Part, the following terms shall have the meanings indicated:
GARAGE SALE or SALES
Any sale of household or personal property conducted from a residence or from a premises not regularly used as a commercial retail outlet and advertised as a garage sale, attic sale, yard sale, barn sale, porch sale or similar designation and having as its primary purpose the sale and delivery and disposition of used household furnishings or personal property.
PERMIT OFFICE
The Zoning Officer of Valley Township.

It shall be unlawful to advertise or conduct any garage sale in the Township of Valley unless a permit shall first have been obtained from the permit officer. Said permits must be obtained five days prior to the day of the proposed sale.

A fee for the issuance of a permit for a garage sale shall be established by the Board of Supervisors and may be changed from time to time by resolution of the Board.

Garage sales shall be permitted in the Township no more than two times per calendar year at any one premises.

The vendor who organizes a garage sale or the owner of the premises upon which sale is held shall have a duty to provide adequate parking facilities for all anticipated customers and shall see to it that no travelled portion of any public highway is in any way blocked, partially or otherwise, or that the flow of traffic is impeded thereon in any way.

Garage sales may be held only from 8:00 a.m. to 5:00 p.m.

A garage sale shall not extend for more than two consecutive days.

The Valley Township's Board of Supervisors may from time to time designate dates and times for community-wide garage sales. Participation in a community-wide garage sale shall not require a permit in accordance with § 13-403, or be counted toward the two-sales-per-calendar-year limitation.

Any person who shall violate any provision of this Part shall be guilty of a summary offense punishable by a fine not to exceed $600, together with all court costs and reasonable attorney's fees incurred in any such enforcement proceeding, and may be further punished by imprisonment to the extent permitted by law for summary offenses. Each day that a violation continues may be considered a separate offense.
