Pursuant to the provisions and authority of the Borough Code,
the Borough Council does hereby create and establish a Recreation
Board for the Borough of Pine Grove to be known as the "Pine Grove
Borough Recreation Board."
The Board shall consist of five members to be appointed by the
Council for the Borough of Pine Grove. The Board members must be registered
voters residing in the Borough of Pine Grove. No more than one Pine Grove
Borough Council member may be appointed to the Board at any time.
The Board members shall serve for terms of four years, or until their
successors are appointed, except that the terms of the members first
appointed shall be so fixed that two members shall be appointed for
four years, one for three years, one for two years, and one for one
year. Vacancies occurring otherwise than by expiration of terms shall
be for the unexpired term and shall be filled in the same manner as
original appointments. The members of the Board shall serve without
compensation. Each member shall serve until December 31 of the year
in which the member's term is scheduled to expire, or until a
new appointment has been made in accordance with the requirements
of this section.
The Board shall be invested with all and full powers and authority
as delegated to it under the Borough Code and with the right to improve,
equip, operate, maintain and regulate public parks, playgrounds, play
fields, public swimming pools and bathing places, indoor or outdoor
recreational facilities, places or centers established within the
Borough.
The Recreation Board shall meet no less than one time per month
and shall elect a board President, vice President, secretary and treasurer.
Minutes of meetings shall be taken and a monthly report shall be forwarded
to Borough Council.
The Recreation Board shall have the authority to open bank accounts,
take loans, apply for grants or any other financial assistance consistent
with the Pennsylvania Municipalities Planning Code and the Borough
Code. All accounts, loans, and grants shall be taken in the name of
the Board.
The Board shall submit an annual report to the Borough Council
not later than September 1 of each year. The report shall include
a listing of the significant activities of the Board during the prior
year and comments and recommendations with respect to the management
and operation of recreation programs and parks and open spaces within
the Borough of Pine Grove, including an analysis of parks, recreation,
and open space areas and programs, as well as maintenance and operations.
The Recreation Board shall also recommend and submit an annual budget
not later than September 1 of each year to the Borough Council who
shall review said budget. The Board shall not have authority to enter
into any contracts that are to incur any obligations binding upon
the Borough of Pine Grove. The Recreation Board shall exercise general
supervision over the care, maintenance, improvement and replacement
of Borough property and equipment in parks, recreation and open space
areas.
All ordinances or parts of ordinances inconsistent herewith
be and the same are hereby repealed.
The provisions of this chapter shall be severable, and if any
of its provisions shall be held to be unconstitutional, illegal or
invalid, such decision shall not affect the validity of any other
remaining provisions of this chapter. It is hereby declared as legislative
intent that this chapter would have been adopted had such unconstitutional,
illegal or invalid provision not been included therein.
