In accordance with the provisions of § 1156 of Article XI of the Second Class Township Code, as amended, no railroad or street railway shall hereafter be constructed upon any Township road, nor shall any railroad or street railway crossings, nor any gas pipe, water pipe, electric conduits or other piping, be laid upon or in, nor shall any telephone, telegraph, or electric light or power poles, or any coal tipples or any other obstructions be erected upon or in, any portion of a Township road except under such conditions, restrictions and regulations relating to the installation and maintenance thereof as may be prescribed in permits granted by the Township for such purpose. The conditions, restrictions and regulations are set forth in the application and permit which is incorporated herein and made a part hereof by reference thereto, and are hereby specifically adopted by the Board of Supervisors. Such regulations or requirements for the issuance of a permit shall be set from time to time by resolution of the Board of Supervisors.

The application for a permit shall be on a form prescribed by the Township and submitted to the Township in triplicate. The application shall be accompanied by a fee in accordance with the schedule of fees set forth by the Pennsylvania Department of Transportation for highway occupancy permits and restoration charges. In addition, the applicant shall submit three copies of a sketch showing such dimensions as the location of the intended facility, width of the traveled roadway, right-of-way lines and a dimension to the nearest intersecting street.

A permit shall be issued to the applicant after all the aforementioned requirements have been filed.

Upon completion of the work, the applicant shall give written notice thereof to the Township.

Upon completion of the work authorized by the permit, the Township shall inspect the work and, when necessary, enforce compliance with the conditions, restrictions and regulations prescribed by the permit. Where any settlement or defect in the work occurs, if the applicant shall fail to rectify any such settlement or other defect within 60 days after written notice from the Township to do so, the Township may do the work and shall impose upon the applicant the cost thereof, together with an additional 20% of such cost.

Any person, firm, corporation or utility which shall violate any of the provisions of this article shall be subject, upon conviction before a district justice, to pay a fine of not more than one $1,000 and cost of prosecution, and, in default of payment of such fine and costs, to imprisonment in the Dauphin County Jail for not more than five days.

All application for road encroachment permits shall be made to the Township road master and said permit shall be issued by him. The Township road master shall also be responsible for inspection after the work is completed and for enforcement of this article.

1. 
The following street cut specifications shall be met by any and all individuals working within South Hanover Township rights-of-way and street openings:
A. 
Trench excavation, backfilling and compacting.
(1) 
Maintenance and protection of traffic.
(a) 
Maintain traffic in one or more unobstructed lanes and provide access to all streets and private drives.
(b) 
Provide and maintain protective devices as required by state and local codes, permits and regulations.
(c) 
Employ traffic control measures in accordance with Pennsylvania Department of Transportation Publication 213, "Temporary Traffic Control Devices," current edition.
(2) 
Cutting paved surfaces prior to excavation.
(a) 
Where installation of pipelines, miscellaneous structures and appurtenances necessitate breaking a paved surface, make cuts in a neat, uniform fashion forming straight lines parallel with the center line of the trench. Cut offsets at right angles to the center line of the trench.
(b) 
Protect edges of cut pavement during excavation to prevent raveling or breaking; square edges prior to pavement replacement.
(c) 
In addition to the trench, excavations should include the saw cutting and removal of the existing paved surface nine inches back from the sides of the trench, exposing undisturbed subgrade. The present road shall be cut or saved in a neat straight line to the bottom of the existing base course. The detached material shall be removed.
(3) 
Trench excavation.
(a) 
Support excavations with sheeting, shoring and bracing or a "trench box" as required to comply with federal and state laws and codes.
(b) 
Install adequate excavation supports to prevent ground movement or settlement of adjacent structures, pipelines or utilities.
(c) 
Keep the ground surface on both sides of the excavation free of excavated material to comply with federal and state laws and codes.
(d) 
Provide temporary barricades to prevent excavated material from encroaching on private property, walks, gutters and storm drains.
(e) 
Maintain accessibility to all fire hydrants, valve pit covers, valve boxes, curb boxes, fire and police call boxes and other utility controls at all times. Keep gutters clear or provide other satisfactory facilities for street drainage. Do not obstruct natural watercourses. Where necessary, provide necessary channels to allow the flow of water either along or across the site of the work.
(f) 
In areas where pipelines parallel or cross streams, ensure that no material slides, is washed or is dumped into the stream course. Remove cofferdams immediately upon completion of pipeline construction.
(g) 
Comply with PA DER Chapter 102 and the PA DER Soil Erosion and Sedimentation Control Manual.
(h) 
Intercept and divert surface drainage away from excavations. Design surface drainage systems so that they do not cause erosion on or off the site or cause unwanted flow of water.
(i) 
Comply with federal and state requirements for dewatering to any watercourse, prevention of stream degradation and erosion and sediment control.
(4) 
Backfill and compaction.
(a) 
Backfill trenches with suitable backfill material in lifts no greater than 12 inches in depth and compact to a density of not less than 95% of the maximum dry weight density at its optimum moisture content plus or minus 2%.
(b) 
Suitable backfill material.
1) 
From top of pipe bedding material to 24 inches over top of pipe:
a) 
Material excavated from the trench if free of stones larger than two inches and free of wet, frozen or organic materials.
2) 
From 24 inches above pipe to subgrade elevation:
a) 
Material excavated from the trench if free of stones larger than eight inches in size and free of wet, frozen or organic materials.
(c) 
Compaction testing. Determine compaction by the testing procedure contained in ASTM D698 or ASTM D2922.
(5) 
Protection of existing utilities and structures.
(a) 
Take all precautions and utilize all facilities required to protect existing utilities and structures. Comply with the requirements of the Pennsylvania Underground Utility Protection Law. Request cooperative steps of the utility and suggestions for procedures to avoid damage to its lines.
(b) 
Advise each person in physical control of powered equipment or explosives used in excavation or demolition work of the type and location of utility lines at the job site, the utility assistance to expect and procedures to follow to prevent damage.
(c) 
Immediately report to the utility and the road master any break, leak or other damage to the lines or protective coatings made or discovered during the work and immediately alert the occupants of premises of any emergency created or discovered.
(d) 
Allow free access to utility personnel at all times for purposes of maintenance, repair and inspection.
B. 
Trench paving and restoration.
(1) 
Restoration materials.
(a) 
Bituminous materials and aggregates. Refer to Publication 408 Specifications. All bituminous materials and aggregates used in base course construction, paving and resurfacing are designated in these specifications by, and shall conform to, the applicable portions of the Publication 408 Specifications.
(2) 
Temporary trench paving.
(a) 
Place temporary paving immediately upon completion of trench backfilling. Unpaved trenches shall not remain unpaved longer than five working days after backfilling, nor over weekends and holidays.
(b) 
Shape and compact subgrade material, then place and compact base course to the required thickness.
(c) 
Place temporary paving material. Compact to required minimum thickness with trench roller having a minimum 300 pounds pressure per inch-width of compaction.
(d) 
Continuously maintain temporary paving.
(e) 
Temporary paving materials shall consist of:
1) 
Base. Compacted eight-inch thick layer of PennDOT No. 2A coarse aggregate or compacted four-inch thick layer of B.C.B.C.
2) 
Compacted three-inch thick layer of PennDOT ID-2 binder course.
(3) 
Permanent trench paving.
(a) 
For bituminous surface course, saw existing paving in accordance with 67 Pa. Code, Chapter 459. Remove temporary paving material. Trim existing paving to remove damaged areas. Cut straight joint lines and right angle offsets.
(b) 
Construct permanent base and surface courses to the required compacted thickness and in accordance with PADOT Publication 408 Specifications.
(c) 
Permanent paving material shall consist of:
1) 
Base. Compacted eight-inch thick layer of PennDOT No. 2A coarse aggregate or compacted five-inch thick layer of B.C.B.C.
2) 
Surface. Compacted three inch ID-2 binder course and 1 1/2 inch wearing course.
(4) 
Driveways.
(a) 
Trim concrete and bituminous driveway surface to remove damaged areas. Saw or cut straight joint lines parallel to the center line of the trench. Cut offsets at right angles to the trench center line.
(b) 
Restore existing concrete driveways with a six inch layer of concrete reinforced with WWF 6 x 6 - W2.9 x W2.9 (6 ga.) wire mesh, placed two inches from top surface.
(c) 
Restore existing bituminous driveways in kind; minimum 1 1/2 inch layer wearing course over six inch layer of select granular material (2RC).
(d) 
Restore earth driveways with a six-inch layer of select granular material (2RC).
(e) 
Restore stone or gravel driveways in kind; minimum six-inch layer of select granular material (2RC).
(f) 
Restore brick driveways with like bricks placed on a four-inch thick wet sand bed. Place bricks in like pattern and spacing.
(5) 
Joints. All joints to be sealed with hot bituminous material using AC-20, asphalt cement, or E-8, emulsified asphalt, or approved equivalent. When wearing coarse is placed adjacent to curb to form bituminous gutter, seal with hot bituminous material of the class and type designated for wearing course and extend to 12 inches form the curb applied evenly.
(6) 
Restoration options.
(a) 
When working within South Hanover Township rights-of-way, street openings must be repaired to Township specifications. The contractor or party responsible for repair has two options:
1) 
Install permanent repairs initially.
2) 
Install a temporary repair which will remain in place for a minimum of 90 days but no longer than 180 days and then return to install a permanent repair.
(b) 
With either option, the contractor or responsible party can be required to return at any time during two years following the initial work to correct any deficiencies in accordance with Township specifications and the recommendations of the Township Engineer.

No person, firm or corporation shall grade, construct, install or erect a drain, culvert, footwalk, drive or driveway or other means of ingress or egress, or affecting discharge or passage of drainage water onto or along a Township road unless and until the Township has granted a permit for such grading, construction, installation or erection.

1. 
Application for such permit shall be made by the owner or occupier, or by his contractor or agent in writing, on forms provided by the Township and in accordance with such rules and regulations as may be established by the Township. There shall be appended to each application a drawing or plan showing the outlines of the property affected with existing improvements thereon, existing drains, culverts, footwalks, drives and driveways, with the proposed drain, culverts, footwalks, drives and driveways proposed to be added, and the relationship of the foregoing to the Township road, particularly with relationship to the effect on the drainage of said road.
2. 
All driveway entrances or aprons shall be constructed in accordance with the requirements of § 22-503 of the Subdivision and Land Development Ordinance as amended [Chapter 22], and each permit shall require that paving be completed within 12 months of the date the permit is issued unless extended in writing by the Board of Supervisors. Failure to complete the required driveway paving within the twelve-month period shall constitute a violation of this article and shall be subject to the penalties hereinafter set forth. Notice of this requirement shall be given to each recipient of a driveway permit and no additional notice shall be required.

The costs of filing such application and permit to be issued thereon, and the cost of any inspection deemed necessary by the supervisors, shall be determined according to a schedule of fees which will be adopted by the supervisors by resolution and all such fees and costs shall be paid into the Township treasury.

The supervisors may alter plans filed with the application, and specify and changes or modifications of any kind which they may deem necessary, and make its approval of the granting of any permits subject to any such alterations, changes or modifications.

All grading, construction, installation and erection shall be in strict compliance with the plans and specifications on the basis of which the permit is granted.

Any person, firm or corporation violating the terms of this article or of any of the terms and conditions of any permit issued pursuant hereto, including any regulations applicable thereto, shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 together with cost of prosecution, or in default thereof, to imprisonment for not more than 15 days.
