The Director of the Department of Health and Human Services or his designee(s) is hereby authorized to provide for the rentals of the areas at the associated costs as set forth in §
209A-6 of this article for the use of community, social and private gatherings, meetings and parties in accordance with the other provisions of this article. Such costs may be classified as to the nature of the user, i.e., not-for-profit corporations, private individuals or commercial or corporate users. The Director shall have the discretion to deny any rental at any time for any reason except solely on the basis of race, creed, gender or national origin, and no rental shall be inconsistent with the purposes of the City of Atlantic City or create or tend to create any negative image of the City to the public. The Director shall also have the discretion to reduce the fees upon the showing of an extraordinary or special circumstance.

Each user must execute a written rental agreement with the City
of Atlantic City for the use of the area. Such rental agreement will
include all the conditions of this article and such other provisions
not inconsistent with this article that the Director of Health and
Human Services shall determine and shall further be required to be
approved by the City Solicitor as to form and execution prior to execution
of the agreement by the Director of Health and Human Services or his
designee(s), who shall execute such agreements in the name of the
City of Atlantic City.
Each user must pay and assume responsibility for the following:
A. The costs of all utilities which will be incurred by the City.
B. Costs of personnel for City custodial, maintenance and security staff,
who shall be required to be present at all times during the use, to
safekeep all City property. Not fewer than one City employee shall
be present at all times. The Director or his designee shall determine
the need for any such persons during the period of the rental.
C. Providing insurance to the City for its property and the use of its
property, including any liability which may occur during the period
of the rental, in an amount satisfactory to the Director or upon guidelines
the Director may establish.
D. Indemnifying and holding harmless the City of Atlantic City, its
officers, agents and employees from and against any claims, demands
or liability, including attorney's fees, costs, fees, interest or
penalties. For purposes of this article of the City Code, the word
"city" shall include the City of Atlantic City and its officers, agents
and employees unless the context of the provision is clearly inapplicable.
E. Any cleanup costs arising out of said use.
F. Obtaining any needed permits from federal, state, City or other governmental
entities prior to the rental. The rental agreement shall not be deemed
to include the grant of any permit by the City by virtue of the fact
of its execution.
G. No rental of any equipment, furniture or other item is included in
any rental unless explicitly provided for in the agreement. If any
equipment, furniture or other item is included, then all the terms
of this article concerning rental of areas shall apply to said equipment
or furniture and an additional cost may be set by the Director or
his designee.
H. A deposit of $100 shall be required for the use of any cooking, food
preparation or kitchen areas.
The responsibility of the City shall not include any of the
following:
A. Liability to the renter in an amount greater than the cost of the
rental of the area in any circumstance or event, including the unavailability
of the area after rental for any reason.
B. Liability of any kind for any property of the user, its guests, licensees
or invitees for any reason, including negligence of the City.
All rentals shall be subject to the following conditions:
A. No rental shall begin before 7:00 a.m. nor extend beyond 2:00 a.m.

B. The use of alcoholic beverages must be explicitly provided for in
the rental and is limited to beer or wine. If not permitted in the
agreement, then no alcoholic beverages may be used in the rented areas.
C. No rental or use shall exceed the stated occupancy of the area.
E. No renter may make any alterations to the premises.
F. No rental of any equipment or furniture is included in any agreement.
G. No renter may discriminate in the provisioning of any service at
the rental areas on the basis of race, creed, gender or national origin.
The following areas may be rented at the costs as provided.
Users are responsible for verifying the exact dimensions and space(s)
to be rented.
A. Atlantic City Aquarium.

E. Fee schedule.
(1) Schools and day cares with 501(c)(3) status will be granted a special
rate of $25 per hour with a four-hour minimum.
(2) Atlantic City community organizations with documented 501(c)(3) tax-exempt
status will be charged $50 per hour for a minimum of four hours. Out-of-town
community organizations with documented 501(c)(3) tax-exempt status
will be charged $100 per hour for a minimum of four hours.
F. Fees for equipment for residents, nonprofit organizations with 501(c)(3),
and nonresidents.
