This article shall be entitled "Local Law of 2016 Requiring
Reimbursement of Application Expenses and Consulting and Professional
Fees."

Pursuant to § 10 of the Home Rule Law and the Village
Law of the State of New York, the Incorporated Village of Dering Harbor,
County of Suffolk and State of New York, hereby enacts by this local
law of 2016, a local law of the Village of Dering Harbor.
This article shall take effect on the filing of the approved
local law with the Secretary of State of New York, which shall be
within 20 days after its approval by the Board of Trustees of the
Incorporated Village of Dering Harbor
The purpose and intent of this article is for the Village of
Dering Harbor to recover reimbursement for the expenses incurred by
the Village for stenography, consulting, professional and other expenses
in applications to the Village of Dering Harbor Boards.
Applicants to the Village Boards of the Village of Dering Harbor
shall be required to reimburse the Village of Dering Harbor for all
costs and expenses of the Village of Dering Harbor in the consideration,
hearing and decision on the application, including, but not limited
to, stenography, consulting, professional, copying and processing
expenses and fees.
Any decision on an application shall be conditioned on the applicant's
compliance with this article.
The Village of Dering Harbor may require an applicant to submit
a deposit in an amount sufficient to cover the expected costs and
expenses of the Village in that application, prior to the hearing
or consideration of the application. Additional deposit monies shall
be paid by the applicant during the processing of the application
if required by the Village. Any excess funds retained by the Village
at the conclusion of the application shall be refunded; any deficiencies
in the amount due for costs and expenses shall be paid by the applicant.
In the event that one or more provisions of this article be
determined to be invalid or unenforceable, the remaining provisions
of this article shall remain in full force and effect.
