The title of this article shall be the "Commercial Vehicle
Parking Ordinance of South Hanover Township."
2.
Regulation of the parking of commercial vehicles in
South Hanover Township is essential in managing impacts and protecting
public health, safety, and welfare of Township residents and maintaining
the residential character of the neighborhoods in the Township. The
purpose and scope of this article are to prohibit the parking of specific
classes of commercial vehicles as defined by the Pennsylvania Department
of Transportation on specific public Township streets.

As used herein, the following terms shall have the meanings
set forth hereinbelow:
Any motor vehicle or trailer typically used for business,
industrial, office, or institutional purposes or having painted thereon
or affixed thereto a sign identifying a business, industry, office
or institution or a principal product or service as such. Agriculture
equipment used as part of a permitted agricultural principal use shall
not be considered a commercial vehicle.

This prohibition shall not apply to a commercial vehicle
or combinations of vehicles in the act of making pickups or deliveries
to properties, Township Public Works Department vehicles, or emergency
services vehicles.

1.
The Township may bring civil complaints pursuant to
or to enforce this article. A separate offense shall arise for each
day or portion thereof in which a violation is found to exist and
for each section of the article which is found to have been violated.
2.
Civil penalties shall be assessed up to, and shall not
exceed, $500 per violation per day the violation exists. In any case
where a penalty for a violation of this article has not been timely
paid and the person upon whom the penalty was imposed is found to
have been liable therefor in civil proceedings, the violator shall
be liable for the penalty imposed, including additional daily penalties
for continuing violations, plus court costs and reasonable attorneys'
fees incurred by the Township in enforcement proceedings.

Any person authorized by the Township to issue a civil
complaint may also issue a notice of violation specifying actions
to be taken and the time in which they are to be taken to avoid issuance
of a civil complaint.
4.
Fines shall be assessed up to, and shall not exceed,
$150 per violation per day the violation exists.

If any section, subsection, sentence, clause, phrase or word
of this article is for any reason held illegal or invalid by any court
of competent jurisdiction, such provision shall be deemed a separate,
distinct and independent provision, and such holding shall not render
the remainder of this article invalid.

Any ordinance or part thereof in conflict with the provisions
of this article is hereby repealed to the extent of said conflict,
except that nothing in this article shall affect any act done or liability
incurred or any suit or prosecution pending or to be instituted under
any repealed or superseded ordinance.

This article shall become effective five days after enactment.
