Public records of the Borough shall be open for inspection by
members of the public as provided by N.J.S.A. 47:1A-1.
a. The Municipal Clerk shall be the custodian of government records
for the Borough of Roseland. The Municipal Clerk may designate Deputy
Custodians by resolution so as to facilitate the process of providing
access to government records.
b. The Municipal Clerk and/or Deputy Custodian shall make government
records subject to review, inspection and copying under the New Jersey
Open Public Records Act ("OPRA"), N.J.S.A. 47:1A-1 et seq. available
to any person during regular business hours.
c. All requests for government records shall be as specific as possible,
including the type of record and date created, if known. Requests
must be in writing and must be hand delivered, mailed, e-mailed, or
sent via facsimile to the appropriate custodian. A records request
may not be made by telephone.
d. In those instances where the nature of the request or record itself
leads the Municipal Clerk and/or Deputy Custodian to doubt whether
or not the record is a "government record" as defined by law, or is
a record exempt from disclosure, the Municipal Clerk and/or Deputy
Custodian shall request an opinion from the Borough's Attorney. A
copy of the request shall be forwarded to the Borough's Attorney,
who, after review and investigation, shall issue an opinion on the
request form and promptly return it to the Municipal Clerk and/or
Deputy Custodian.
e. A public official, officer, employee, or custodian who refuses access
to a government record and thereby incurs a civil penalty because
of denying access to a government record shall be indemnified by the
Borough provided that such denial was not knowingly and willfully
in violation of OPRA.
f. As provided by N.J.S.A. 47:1A-1.1, a government record shall not
include information that would give an advantage to competitors or
bidders. The Borough may adopt a set of regulations by resolution
identifying the type of information that may give an advantage to
competitors or bidders.

a. The following fees shall be charged for copies of government records:
1. $0.05 per page for letter sized pages and smaller;
2. $0.07 per page for legal sized pages and larger;
3. The actual cost of duplication where the actual cost to produce paper
exceeds the $0.05 and $0.07 rates;
4. The actual cost to provide records in another medium (i.e. computer
disc, CD-ROM, DVD); and
5. Electronic records (i.e. records sent via e-mail and fax) shall be
provided free of charge.
b. Whenever the nature, format, manner of collation, or volume of a
government record embodied in the form of printed matter to be inspected,
examined, or copied is such that the record cannot be reproduced by
ordinary document copying equipment in ordinary business size or involves
an extraordinary expenditure of time and effort to accommodate the
request, the requestor shall pay, in addition to the fees set forth
above, a special service charge as follows:
1. The hourly rate of the Roseland employee who performs the services
required to accommodate the request multiplied by the amount of time
required to complete the request.
2. The hourly rate shall be computed by dividing (the yearly salary
of the employee plus twenty-five (25%) percent of such salary by 1,820.
c. Where the Borough demonstrates that actual costs to duplicate a government
record exceed the page rates set forth in paragraph a. above, the
Borough shall charge the requestor the actual cost of duplication
of the record.
d. The Custodian shall permit access to a government record and provide
a copy thereof in the medium requested if the Borough maintains the
record in that medium. If the Borough does not maintain the record
in the medium requested, the Custodian shall either convert the record
to the medium requested or provide a copy in some other meaningful
medium. If a request is for a record:
1. In a medium not routinely used by the Borough;
2. Not routinely developed or maintained by the Borough; or
3. Requiring a substantial amount of manipulation or programming of
information technology;
The Borough may charge, in addition to the cost of duplication,
a special charge that shall be reasonable and shall be based on the
cost for any extensive use of technology, or for the labor cost as
set forth in paragraph b. above, of personnel providing the service,
that is actually incurred by the Borough or attributable to the Borough
for the programming, clerical, and supervisory assistance required,
or both.
e. The requestor shall have the opportunity to review and object to
any duplicating and service charges prior to the time such charges
are incurred.
f. A deposit shall be paid prior to satisfying any request where it
is estimated that the information requested will cost in excess of
twenty-five ($25.00) dollars to reproduce. The amount of the deposit
shall equal the total estimated cost of satisfying the request.
g. Plans and Specs-cost set by Borough Engineer.
h. Land Development Chapter $ 35.00
i. Permit Fee for the Use of Public Facility.
1. Permit; Fee. Any party desiring to use any facility, except use for
official Borough business, shall obtain a Facility Use Permit by submitting
an application with the Borough Clerk at least ten (10) days before
the contemplated use date. Such application shall state the name of
the parties, or group of parties which shall be using the facility
("applicant(s)"), the date, time and purpose of use and whether or
not any type of payment will be made to the registrant by those who
will be using the facility in connection with such registered use.
The applicant shall be the entity which will have primary responsibility
for the use of the facility.
In the event that the applicant receives any compensation, either
directly or indirectly, in connection with the use of such facility,
the applicant shall pay to the Borough ten (10%) percent of any gross
profits received out of such compensation ("user fee"). The user fee
and supporting documentation evidencing gross profits shall be paid
to the Borough within ten (10) days of the date of the conclusion
of the permitted use of such facility. By way of example only, if
an entity conducts, for ten (10) days, on a Borough playing field,
a private, for profit, soccer camp and receives three hundred ($300.00)
dollars gross profit from such camp, the Borough will be entitled
to receive thirty ($30.00) dollars as a payment for the use of such
playing field for private purposes.
2. Definition. As used in this paragraph:
FACILITY
shall mean any Borough-owned real property or personalty
which the Borough, in its sole discretion, may make available for
public use. A list of facilities available for use by the public pursuant
to this subsection shall be maintained in the Borough Clerk's Office.
3. Hold Harmless Agreement; Insurance Required
As a condition for issuance of a Facility Use Permit, the applicant
shall provide the Borough Clerk with a completed Hold Harmless Agreement
in a form satisfactory to the Borough Attorney. The applicant shall
also provide the Borough with a certificate of insurance naming the
Borough of Roseland as an additional insured, in an amount established
by Resolution of the Mayor and Council.
4. Penalty. Failure to comply with the provisions of this paragraph a. shall subject the violator to a penalty, within the Borough's discretion, pursuant to Section
1-5 of the Borough ordinances.

a. Fee Schedule. The following fees are hereby fixed and established
for certain services extended and materials distributed by the Police
Department of the Borough:
1. Copies of reports which are noncriminal in nature: $2.00
2. Search fee in cases where a review of a record is desired: $5.00
3. Viewing photographs of accident scenes: $5.00
4. Copies of photographs, each: $10.00
5. Copy of an accident report: $5.00
6. Copy of a report other than an accident: $2.00
7. Taking fingerprints of residents, canvassers and solicitors: $ 1.00
8. Processing Fees for Firearms ID Cards and Handgun Permits. In order
to process applications for handgun permits and firearms identification
cards in a timely manner, the following fees which are charged by
the FBI, New Jersey State Police, and the Borough of Roseland must
be paid by certified check or money order only.
Listed below are the fee schedules for firearms applicants.
The Borough of Roseland and Department of Police have no control
over the fees the above listed agencies charge for their services.
(a)
Firearms identification card/handgun purchase permit:
(1)
$49.00 money order payable to the "Division of State Police
SBI."
(2)
$50.00 payable to the Borough of Roseland for each firearms
identification card.
(3)
$25.00 payable to the Borough of Roseland for each handgun permit.
(4)
$200.00 for each concealed carry permit.
(i) $150.00 payable to the Borough of Roseland.
(ii)
$50 money order payable to the "Division of State Police SBI."
Additionally, applicants must make an appointment with the Roseland
Police Department Detective Bureau to be fingerprinted. The Detective
Bureau can be reached by calling 973-226-8700, Monday through Friday
8:00 a.m. to 4:00 p.m. and Saturday 8:00 a.m. to 4:00 p.m. Please
bring completed firearms paperwork and certified check(s)/money order(s)
on the day of fingerprinting.
All fees are to be paid to and collected by the chief police
officer of the Borough.
b. Viewing of Reports or Photographs. The viewing or reviewing of reports,
or of photographs of accident scenes, shall be permitted and conducted
at the Police headquarters daily, Monday through Friday, from 9:00
a.m. to 4:00 p.m.
c. Exemptions. No search fee shall be charged in the event that a report
or a photograph is not on file with the Police Department, nor for
any report for which a formal request is made by any local, County,
State, or Federal Law Enforcement Agency, or by the Federal Postal
Authorities.
d. Receipts. The Police Department shall issue a receipt for all fees
and monies received for the services extended or materials furnished,
as hereinabove provided.
e. Fee for Police Testing Application. There shall be a fee of fifty
($50.00) dollars for any police testing application. Upon written
certification to the Chief of Police that the payment of the testing
fee would create an undue hardship on an applicant, the Chief of Police
may, after inquiry and investigation, be granted permission to waive
such application fee.

a. Full Refunds.
1. A full refund will be given to the participant if the program is
cancelled by the Recreation Department or if a request to withdraw
from the program is made prior to the registration deadline.
b. Partial Refunds; Processing Fees.
1. Program Start Date shall be the date advertised on the program flyer
and as posted on the Borough's website.
2. For all registration fees totaling $100 or more, a $25 processing
fee will be retained by the Recreation Department.
3. For all registration fees under $100, a 75% refund will be given
to the participant, upon written request, before the season/program
starts. (A 25% processing fee will be retained by the Recreation Department.)
4. Injury Refunds. No refunds will be given after the season/program
begins unless an injury is sustained. This policy includes if the
participant is suspended or expelled from a program by the Roseland
Recreation Department.
(a)
For injuries sustained after the season/program begins (not
including pre-existing conditions) that prevents the participant from
further participation, a 50% refund will be given to the participant,
upon written request, up to the halfway point of the program.
