A. 
The Administrative Branch shall consist of the Office of the Mayor, the departments and offices under his direction and control, designated independent or quasi-independent agencies and advisory boards and commissions.
B. 
The departments and offices subject to mayoral direction shall be:
(1) 
The Department of Administration.
(2) 
The Department of Law.
(3) 
The Department of Finance.
(4) 
The Department of Planning and Development.
(5) 
The Department of Police.
(6) 
The Department of Fire.
(7) 
The Department of Public Works.
(8) 
The Department of Community Services.
(9) 
The Office of the Mayor.
(10) 
The Municipal Court.
C. 
The independent and quasi-independent agencies, advisory boards and commissions shall be:
(1) 
The Board of Library Trustees.
(2) 
The Public Housing Authority.
(3) 
The Alcoholic Beverage Control Board.
(4) 
The Rent Leveling Board.
(5) 
The Planning Board.
(6) 
The Zoning Board of Adjustment.
(7) 
The Economic Development Commission.
(8) 
The Board of Health.
(9) 
The Local Assistance Board.
(10) 
The Board of School Estimate (N.J.S.A. 18A:22-1).

The Mayor may approve the organization and reorganization of departments, offices and agencies upon recommendation of the heads thereof and subject to available appropriations, provided that any plan calling for changes in the number of departments or in personnel strength or the classification and pay of employees shall be adopted by ordinance.

A. 
Appointment, term and compensation. The Mayor shall appoint the directors of all departments, with the advice and consent of the Council, to serve during his/her term and until appointment and qualification of their successors. Their compensation shall be as provided in the annual Salary Ordinance.
(1) 
The Mayor may fill a position, in the absence of any contrary provision in federal law, state law, or city ordinance, by appointing a person in an acting capacity. Such appointee shall have all of the functions, powers, and duties of the office.

(2) 
A person employed and/or working in an acting capacity for the City of the Township of Orange shall not continue to be acting in said position more than ninety (90) days. If said person is not a permanent employee on or before the ninety (90) day period expires, said person shall no longer continue to be employed by the City of Orange Township in said position, unless the Council shall, by resolution, authorize one (1) or more extensions of that period.

(3) 
If the Mayor has presented the resolution before the Municipal Council for a vote for permanent appointment at a Municipal Council meeting within the ninety (90) day period delineated above and the Municipal Council fails to vote, the person shall be entitled to continue in said position until the Municipal Council approves or rejects the permanent appointment.

(4) 
If the Municipal Council declines to extend the timeframe within which the person is serving in an acting capacity or directly rejects the person presently acting in the position, the Mayor may appoint another individual to serve in an acting capacity subject to the above requirements. In no circumstance shall the previous acting person continue in the acting position.

(5) 
In regard to persons presently serving in an acting position, the Mayor shall have thirty (30) days to present the resolution at Municipal Council meeting within the thirty (30) day period for hiring for permanent status. If said person is not accepted as a permanent employee by the Municipal Council at a Municipal Council meeting within the thirty (30) day period said person shall no longer continue to be employed by the City of Orange Township in said position, unless the Municipal Council shall, by resolution, authorize one (1) or more extensions of that period.

(6) 
Elected officials performing duties as employee of city. All elected officials shall be barred from receiving any monetary compensation for performing duties as an employee of the City of Orange Township in an acting and/or permanent capacity for any department and/or division.

B. 
Removal. In accordance with the authority set forth in Section 43(c) of the Optional Municipal Charters Law, the Mayor may remove any director, subject to disapproval by the Council.
C. 
Powers and duties. Each director:
(1) 
Shall appoint subordinate officers and employees within his/her department and may, with the approval of the Mayor, remove such officers and employees subject to Civil Service provisions (N.J.S.A. 11:21D-1 et seq.).
(2) 
Shall plan and supervise the work of the department.
(3) 
Shall assign and may modify the functions and duties of subordinates.
(4) 
May delegate to subordinate employees in writing such supervisory powers as he/she may deem necessary for efficient administration.
(5) 
Shall report periodically to the Mayor or his designee and at least quarterly to the Council on the work of his/her department in such form as the Mayor or his designee shall specify. Said form shall include, but not be limited to: a written report, followed by an oral summation with allowance for inquiry by Council members during a regular meeting, Executive Session and privileged matters.

(6) 
Shall authorize all purchase requisitions or provide for their authorization and shall certify the correctness and propriety of all payrolls and vouchers.
(7) 
Shall perform such other duties as may be assigned by the Mayor or his designee.

Each department, office and agency shall have such employees as the Council may authorize. Employees shall be appointed and may be removed pursuant to the Charter, civil service regulations and city personnel rules and shall be paid in accordance with the annual Salary Ordinance.
