Pursuant to N.J.S.A. 33:1-5, there is hereby created a Board of Alcoholic Beverage Control, which Board shall exercise and perform all of the functions, powers and duties and rights to administer the provisions of Title 33 of the New Jersey Statutes in respect to the City of Plainfield and Chapter 4 of the Municipal Code of the City of Plainfield.

The Board shall consist of three (3) persons, no more than two (2) of which shall be of the same political party, who shall be chosen and appointed by the Mayor with the advice and consent of the City Council for terms of three (3) years. The term of each member shall be three (3) years but one (1) of the initial appointments shall be for one (1) year, another for two (2) years, and the third for three (3) years. In case of a vacancy occurring before the expiration of any term, the appointment to fill such vacancy shall be for the unexpired term. Each member of the Board, upon his/her appointment, shall file with the Municipal Clerk, in duplicate, an acceptance of his/her appointment, one (1) of which shall be retained by the Municipal Clerk and the other of which shall be transmitted by him to the Director of the Division of Alcoholic Beverage Control as hereinafter provided.

(a) 
The Mayor shall appoint the Municipal Clerk or some other qualified person as Board Secretary.
(b) 
The Secretary shall attend all meetings of the Board, keep the minutes thereof and perform such other clerical duties as shall be assigned to him thereby.
(c) 
The Secretary shall receive annual compensation in the amount of Seven Thousand Five Hundred Dollars ($7,500.00).

The Municipal Clerk shall, upon the appointment of the members of the Board, transmit to the Director of the Division of Alcoholic Beverage Control a certified copy of this section and of the resolutions appointing the members of the Board and a duplicate original certificate of acceptance by each of the members filed with him.

The members of such municipal Board shall receive no salaries and they shall be removable by the City Council for cause. Such members shall not be subject to the provisions of Title 11, Civil Service.

No person appointed to any office, position or employment under this section while holding said office, position or employment, shall directly or indirectly, individually or as a member of a partnership or as a stockholder of a corporation or any other association have any interest whatsoever in the manufacture, sale or distribution of alcoholic beverages, or in any enterprise or industry dealing or connected with alcoholic beverages or kindred or cognate thereto; nor shall any such person accept any gift, gratuity, or anything of value whatsoever from any licensee or applicant for a license, directly or indirectly; but it shall not be a violation of this section for such person to purchase or possess for consumption and not for resale any alcoholic beverages.
