(a) No person shall own, harbor or keep any dog within the City which
has not been inoculated against rabies, provided that dogs which have
not attained the age of six (6) months shall not be required to be
so inoculated, and further provided, that any dog may be exempt from
the requirement of such inoculation, for a specified period of time,
by the Division of Health upon the presentation of certificate from
a veterinarian stating that because of infirmity or other physical
condition, the inoculation of such dog, for said specified period
of time, is contraindicated.
(b) All persons who shall own, keep or harbor a dog within the City limits,
except as specified in Section (a), shall procure for each such dog
so owned, kept or harbored and shall cause to be securely fastened
on the collar or harness of such dog a suitable tag, indicating that
said dog has been inoculated against rabies, and indicating the year
of such inoculation. The inoculation shall be made by a duly licensed
veterinarian of the State of New Jersey, or such other person permitted
by law to make same and approved by the Division of Health.
(c) The inoculation against rabies shall commence upon the dog reaching
the age of six (6) months and said dog shall be inoculated once each
year after the first inoculation, except where a dog has been inoculated
with an avianized vaccine, then in the latter case a dog shall be
inoculated once every three (3) years from the date of the avianized
vaccine inoculation.
Either the Police or Health Division or the pound keeper may
serve notice upon the owner or person in charge of a dog or other
animal which has attacked or bitten a person, to confine the animal
at the expense of the owner or person in charge of it upon the premises
of the owner or person in charge or at some other place designated
in the notice, for at least ten (10) days after the animal has attacked
or bitten a person.
Every physician shall, within twelve (12) hours after his first
professional attendance upon any person bitten by a dog or other animal,
report to the Police or Health Division or the pound keeper, the name,
age, sex, color and the precise location of the person so bitten.
The parent or guardian of a child bitten by a dog or other animal,
when no physician attends such child, shall within twelve (12) hours
after first having knowledge that the child was so bitten, report
to either the Police or Health Division or the pound keeper, the name,
sex, age, color and the precise location of the child.
Either the Police or Health Division or pound keeper shall serve
a notice, in writing, upon the owner or person in charge of a dog
or other animal known or suspected to have been bitten by an animal
known or suspected of being affected by rabies, requiring the owner
or person in charge of the animal to kill or confine it for a period
of not less than six (6) months.
An animal confined under the order of either the Police or Health
Division or the pound keeper shall not be released until a certificate
of release has been issued.
