1. All roads, streets and avenues proposed to be constructed for public
use in the Borough of New Stanton shall have a minimum right-of-way
of 50 feet. Said roads shall have a minimum paved surface width of
24 feet, exclusive of curbs. (Curbs may be bituminous wedge type as
per attached sketch.) The paving width, curbing, grade and type of
paving shall be established and noted on detailed plans and profiles
submitted to the Borough of New Stanton for their approval. The plans
and profiles for each street must be shown on a drawing 24 inches
by 36 inches and a reproducible tracing furnished together with three
prints.
2. No road construction can be commenced within the Borough until a
road construction permit has been granted by the Borough of New Stanton.
Each permit is to be issued upon blank forms furnished by the Borough.

Detailed plans of the drainage and proposed drainage facilities
for said streets and roads and contiguous territory shall be submitted
to the Borough of New Stanton for their approval. These plans must
cover a scope large enough to show the effect of the proposed facility
or facilities on any land or street above and any land or stream below.
This scope is to be determined by the Borough or their Engineer, and
must be shown on a separate twenty-four-inch by thirty-six-inch map.
Three prints of said map are to be furnished to the Borough.

1. A road, street or avenue must be graded out to the full width of
the right-of-way unless the topography of the ground does not permit
this to be done in a practical manner. If the topography of the ground
does not permit the grading of the entire right-of-way, the finished
grade area must slope from the right-of-way line toward the paving.
2. No base construction can be commenced prior to the installation of
all utilities and sanitary sewers, including laterals and service
lines. All public utilities and sanitary sewer lines shall be installed
underground.
3. All grading, subgrade, fine-grade, drainage structures, bridges, culverts, base and paving must conform to the current specifications of the Pennsylvania Department of Transportation, Form 408, and the specifications and exhibits found in Chapter
22, Subdivision and Land Development.

1. Before any construction can be commenced within the Borough of New
Stanton of any road, street, avenue or drainage facility, the Borough
of New Stanton shall be provided with an executed copy of the agreement
for such construction between the contractor and builder or owner.
In addition, before any plans shall be approved and any permit issued,
the contractor and builder or owner shall provide the Borough of New
Stanton with a performance bond or cash security guaranteeing the
completion of said construction, which bond or security shall be provided
according to the following schedule:
A. For any road, street, avenue and/or drainage facility, or for any
portion thereof which is being constructed separate and apart from
the remaining portion or portions of the construction set forth on
the approved plans, which costs amount to a sum of less than $5,000,
a performance bond or cash security in the amount of 100% of the costs
of construction.
B. For any road, street, avenue and/or drainage facility, or for any
portion thereof which is being constructed separate and apart from
the remaining portion or portions of the construction set forth on
the approved plans, which costs amount to a sum of less than $5,000,
a performance bond or cash security in the amount of 50% of the costs
of construction.
2. If a stage of construction is completed according to the approved
plans and specifications, and inspected and approved by the Borough,
the performance bond or cash security posted for said stage shall
be released to the contractor and builder or owner.
3. Upon completion of the road, street or avenue and as a condition
of acceptance by the Borough, a two-year maintenance bond in the amount
of 50% of the cost of the base, binder and wearing surface shall be
given to the Borough of New Stanton by the contractor and/or builder
guaranteeing said base, binder and wearing courses against deficiencies
in workmanship and materials.

1. The contractor and/or builder or owner, prior to the issuance of
any permit or any construction, must pay to the Borough of New Stanton
an inspection fee or fees according to the following schedule:
A. An inspection fee of $100 for the inspection of any road, street
or avenue, or for any portion thereof which is being constructed separate
and apart from the remaining portion or portions of the road construction
set forth on the approved plans.
B. An inspection fee of $100 for the inspection of any drainage facility
or for any portion thereof which is being constructed separate and
apart from the remaining portion or portions of the drainage facilities
set forth on the approved plans.

Any person, partnership or corporation who or which shall construct,
dedicate or open to travel any road, street, avenue, portion thereof,
or any drainage facilities in connection therewith, for public use
or travel or for the common use of occupants of buildings abutting
thereon, without first having complied with the provisions of this
Part, shall be, upon conviction thereof, sentenced to a fine of not
more than $1,000, plus costs, and, in default of payment of said fine
and costs, to a term of imprisonment not to exceed 30 days.
