No person shall have installed or operate any air-conditioning and/or refrigeration system or equipment pertaining thereto requiring the use of water, supplied by any public or semi-public water company or derived from any well or any other source without first conforming to the provisions of this article and the Building and Plumbing Codes of the City.

(a) 
Sand traps and gasoline and oil separators shall be constructed in accordance with drawings entitled "City of Plainfield, N.J. Catch Basins or Traps for Intercepting Sand, Gasoline and Oil," as revised, filed in the office of the Clerk in May, 1915, unless different types are approved for installation by the Department of Public Works.
(b) 
Sand traps and gasoline and oil separators shall be installed under the direction of the Division of Health.

(a) 
Application, in duplicate, on forms furnished by the Division of Public Works, for permits for air-conditioning and/or refrigeration systems or equipment pertaining thereto to be installed or operated shall specify the information requested on the application.
(b) 
Application shall be accompanied by a fee of Five Dollars ($5.00).
(c) 
One approved copy of the application will be returned to the applicant to serve as a permit.
(d) 
Applicant shall obtain approval of such systems and/or such equipment in advance from the Division of Public Works or other designee before such permit is issued.
(e) 
Applicant shall give notice of completion of the installation and operation to the Division of Public Works.

(a) 
The term "air conditioning" as used herein applies to that equipment used primarily for human comfort cooling and shall be considered on the basis that one compressor motor horsepower is equal to one ton of refrigeration.
(b) 
Equipment used for a purpose other than air conditioning shall be considered on the basis that one compressor motor horsepower is equal to 0.6 ton of refrigeration.
(c) 
Refrigeration and/or air conditioning equipment using gas or other type of energy shall be rated on the basis that one (1) ton is equal to the removal of twelve-thousand (12,000) British Thermal Units per hour with a five (5) degree Fahrenheit evaporating temperature and eighty-six (86) degree Fahrenheit condensing temperature from the space being cooled.
(d) 
The term "public water system" or "potable public water system" as used in this article shall mean water supplied to the consumers by any public or semi-public water company.
(e) 
All new installations of any individual or collective system of air conditioning equipment and/or refrigeration equipment of three (3) tons and over shall be equipped with a water conserving device such as economizer, evaporative condenser, water cooling tower or similar apparatus, which device shall not consume for makeup purposes in excess of five percent (5%) of the consumption of water that would normally be used without such device, except as provided in Subsection (K) (1) of this section.
(f) 
All new installations of air conditioning equipment, and/or refrigeration equipment under three (3) tons, not using recirculated water shall be provided with an automatic water supply regulating device so as to limit the flow of water in relation to the condenser temperature reduction requirements of the apparatus. In no case shall the equipment use in excess of one and one-half (1 1/2) gallons per minute per ton capacity.
(g) 
If two (2) or more units, which in the aggregate total to three (3) tons or over, are installed to serve the same building or premises, said unit or units shall be subject to the same requirements applicable to a unit or equipment of three (3) tons or over, as in this article provided.
(h) 
Each direct water connection to an air conditioning unit and/or refrigeration unit using water for cooling purposes and which is connected with the potable public water system, shall be equipped with a vacuum breaker except in installations where the water supply piping has no contact with the refrigerant. This will be the case where two substantial and independent wall thicknesses of metal separate the refrigerant from the public water system.
(i) 
Air conditioning units and/or refrigerating units with a capacity of more than twenty (20) pounds of refrigerant shall be provided with a relief valve installed on the outlet side of the vacuum breaker of the water supply connection, such relief valve being set at five (5) pounds above the maximum water pressure at the point of installation.
(j) 
(1) 
All existing installations of air conditioning and/or refrigeration equipment installed on any premises, requiring the use of water, supplied by a public or semi-public water company, or derived from a well or any other source shall be subject to the provisions prescribed in this article.
(2) 
All persons who have installed such systems and equipment prior to the adoption of this Code shall, notify the Division of Public Works of such existing installation. Failure to give such notice shall be a violation of this article.
(3) 
The person in possession of any premises upon which refrigeration and/or air conditioning equipment requiring the use of water is already installed, shall make application and obtain a permit for the existing installation not later than September 1, 1953. Such application shall contain the same information as in the case of a new installation.
(4) 
All existing installations of air conditioning and/or refrigeration equipment, requiring the use of water, installed prior to the adoption of this Code shall comply with the requirements of this article in the same manner as new installations.
(5) 
Such equipment already installed shall be changed, rebuilt or remodeled and all the work and equipment required therefore, shall be installed and completed on or before May 31, 1954, pursuant to the inspection and supervision of the Director of Public Works or other designee, for good cause shown, in writing extend the time for compliance for a further period, or periods.
(k) 
(1) 
All installations of any individual or collective system of air conditioning equipment and/or refrigeration equipment of three (3) tons and over shall be equipped with a water conserving device as provided in Subsection (e) of this section.
(2) 
The Director of Public Works or other designee may grant permission in writing for a diffusion device which will return the water in a pure and uncontaminated condition, without loss or waste, back into the ground instead of the device required under Subsection (e) of this section.
(3) 
The Director of Public Works or other designee, may grant permission in writing for a device which will return the water in a pure and noncontaminated condition without loss of waste into the public water system instead of a device required under Subsection (e) of this section.
(4) 
If such permission is granted for a diffusion device to return the water into a public water system it will be the responsibility of the property owner, tenant or other legal occupant of the premises serviced by such system of refrigeration and/or air conditioning equipment to insure that no water is wasted or contaminated thereby.
(5) 
It is the declared intent of the Council that no diffusion well, recharge basin, stream, brook, pond, lake or any other source of water or public water system connecting device shall be permitted under this article unless it is assured that all water used in such refrigeration and/or air conditioning system will be effectively returned in a pure and noncontaminated condition after use to the sources from which the said water is obtained or to a public water supply system.
(l) 
In no case shall such air conditioning and/or refrigeration systems or such equipment pertaining thereto adversely affect the flow, quantity, quality or state of water to other users in the area.
(m) 
The discharge of waste into the City sewage system shall not:
(1) 
Overburden the City system of sewage disposal;
(2) 
Cause a nuisance;
(3) 
Violate any of the provisions of this Code respecting safety of persons or property.
(n) 
No air-conditioning and/or refrigeration equipment using water as a direct cooling medium may be installed, converted, modified or adjusted unless a means of water disposal shall first be provided in accordance with the provisions of this Code.
(a) 
The Director of Public Works or his designee shall cause all such systems and equipment regulated herein to be inspected from time to time for compliance with this chapter.
(b) 
In case of non-compliance the Director of Public Works or his designee shall notify the applicant or permit holder to comply with or correct any condition within thirty (30) days.
(c) 
In the event of failure, or upon refusal of the applicant or permit holder to comply as ordered, the Director of Public Works or his designee shall refuse the application or revoke the permit as the case may be; provided, that upon a showing of hardship or other circumstances warranting such action, the Director of Public Works or his designee shall have the authority to grant an extension.
(d) 
Whenever the Director of Public Works or his designee shall make an order in writing, rejecting any application or revoking any permit, the person aggrieved shall have the right to appeal within ten (10) days of such order to the Council. The decision of the Council with respect to such appeal shall be final for judicial review.
