Environmentally Sensitive Areas correspond with those areas
in the Township designated in the Master Plan for the Non-Pinelands
Area as either subject to flooding, as defined by the one hundred
(100) year flood plain and flood hazard areas, or as wetlands, as
defined by the U.S. Fish and Wildlife Service. In the interest of
public health, safety, and welfare, disturbance of these areas either
by the building of structures, infrastructure, filling, or the removal
of vegetation thereon shall be prohibited.
Usage of land within Environmentally Sensitive Areas shall be in accordance with the uses permitted within the particular zoning district in which the land is located. In general these areas shall be left in an open and natural state, but in certain instances, such as provided under Articles
IX and
XIV of this chapter, they may be considered as part of the common open space for a planned community development or clustered residential development.
The approximate location of Environmentally Sensitive Areas
if identified on Map 2, Environmentally Sensitive Areas, which is
part of the Master Plan for the Non-Pinelands Area, and is available
for inspection by the public in the Winslow Township Planning Board
Secretary's office. Property owners shall consult this map for the
approximate location of Environmentally Sensitive Areas. When an owner
proposes development within, or affecting, an Environmentally Sensitive
Area on his property, the owner shall show, as part of his application
to the township, the precise location and extent of the flood plain,
flood hazard area or wetlands areas. This information shall be based
upon a site survey prepared by a registered engineer.
Usage of land, within Environmentally Sensitive Areas must comply with all Federal, State, County and Local Regulations and standards governing flood plain, flood hazard areas, wetlands, and water quality. Lands that are determined to be located within flood plains or flood hazard areas shall comply with the procedures and standards specified in Chapter
145, Flood Damage Prevention. Lands that are determined to be within wetlands shall comply with the applicable requirements of the U.S. Army Corps of Engineers.
