In order to protect cemetery areas within the Town from injury,
damage or desecration, these regulations are enacted. The term "cemetery"
as hereinafter used in this chapter shall include all cemetery property,
grounds, equipment and structures, both privately and publicly owned,
which are located within the Town of Rome.
As used in this chapter, the following terms shall have the
meanings indicated:
ALLEY
A public right-of-way, which normally affords a secondary
means of vehicular access to abutting property.
BASE
The tower or bottom part of the monument.
DIE
The upper or main part of the monument.
FRONT AREA OF MONUMENT
The result obtained by multiplying the dimensions of the
length by the dimensions of the height. The face area or average dimensions
of each piece in the monument is to be figured separately. When the
front areas of each piece are totaled, the result is the front area
of the monument.
GRADE
The average level of the finished surface of the ground adjacent
to the exterior walls of the building or structure.
LOT
A parcel of land. A lot may be a parcel designated in a plat
or described in a conveyance recorded in the Office of the Register
of Deeds, or any part of a large parcel when such part complies with
the requirements of this chapter as to width and area for the district
in which it is located.
MARKER
Any structure of approved stone or bronze, which is flush
with the ground or sits on a foundation that is flush with the ground.
MEMORIAL
A monument, slant or marker, which marks a grave.
MONUMENTS
Any structure of approved stone or bronze that extends above
the surface of the grade.
OWNER
Includes the plural as well as the singular and may mean
either a natural person, firm, association, partnership, private corporation,
public or quasi-public corporation, or combination of these who shall
hold title to a building, structure or property, or who shall be in
actual possession of, or have charge, or control of building, structure,
or property as agent of the title holder, or who shall be trustee
or guardian of the estate or person of the title holder.
PERSON
Includes a corporation, firm partnership, association, organization
and any other group acting as a unit as well as individuals, including
a personal representative, receiver or other representative appointed
according to law. Whenever the term "person" is used in any section
of this chapter prescribing a penalty or fine, as to partnerships
or associations, the work shall include the partners or members thereof,
and as to corporations, shall include the officers, agents or members
thereof who are responsible for any violation of such section.
REFUSE
Combustible and noncombustible discarded material including,
but not limited to, trash, rubbish, paper, wood, metal, glass, plastic,
rubber, cloth, ashes, litter and street rubbish, industrial waste,
dead animal tissue, blood or parts, mine tailings, gravel pit and
quarry spoils, and material and debris resulting from construction
or demolition.
RUBBISH
Rubbish is the miscellaneous waste material, combustible
and noncombustible, resulting from housekeeping and ordinary mercantile
enterprises, and includes boxes, cartons, excelsior, paper, ashes,
cinders, tin cans, bottles and broken glass, rubber, grass clippings,
brush, leaves, garden plants, and animal waste.
SIGN
Any medium, including its structure, words, letters, figures,
numerals, phrases, sentences, emblems, devices, designs, trade names
or trademarks by which anything is made known and which are used to
advertise or promote an individual, firm, association, corporation,
profession, business, commodity or product and which is visible from
any public street or highway.
STRUCTURE
Anything constructed or erected, the use of which requires
a more or less permanent location in or on the premises, or any other
attachment to something having a permanent location on the ground,
which includes, but is not limited to, objects such as buildings,
mobile homes, gas or liquid storage tanks, bridges, culverts, decks,
fences, satellite dishes or swimming pools.
TOWN
The Town of Rome, Adams County, Wisconsin, or any duly appointed
designate thereof, including, but not limited to, the Town Board and
Town committees.
TOWN BOARD or BOARD
The present governing body of the Town or any successors
to the legislative power of said body, or any duly appointed designate
thereof.
VEHICLE
A motor vehicle, trailer, semitrailer or mobile home, whether
or not such vehicle is registered under Wisconsin Law.
WASH
The exposed upper portion of the base.
The cemetery property owner shall have the authority to establish
reasonable rules and regulations to regulate and govern the operation
of any cemetery in accordance with state law and this Code. The cemetery
property owner shall rescind the right to prohibit and regulate the
planting or placement of any flowers, plants, vines, shrubs, trees,
flower pots, urns or other objects on cemetery property. Placements
of any such plantings, containers or objects shall be in accordance
with established regulations of the cemetery property owner.

The Director of Public Works shall keep records, which contain
the following information:
A. Lot owner:
(4) Date lot sold and amount.
(5) Date and amount of perpetual care.
(7) Upon transfer of title a cross reference to new owner.
B. Interments.
(3) Name of funeral director.
(4) Address of funeral director.
C. A diagram of each grave site showing number of site, name of owner
and name of each person buried.
D. Copies shall be maintained of the:
(2) Interment/disinterment applications.
(3) Monument applications.
(a)
Sketch or picture of the memorial to be installed with a full
description of the same, including color, finish, weight, lettering,
ornamentation, kind and grade of stone or metal, original source of
stone or metal, whether a single piece or several pieces, how mounted
together, all dimensions, etc. agreement between memorial dealer and
Town regarding warranty and installation. Also permit for installation
issued by the Town.
(b)
All servicing of memorials, additional lettering, and work done
on them shall be noted in the same manner in this file. In every instance,
the name and address of the dealer or contractor involved shall be
filed and the date noted.
