Chapter 73, P.L. of 1963, finds and declares to be the public
policy of this State that public records shall be readily accessible
for examination by the citizens of this State for the protection of
the public interest except as otherwise provided in the law. Chapter
73 provides that all records which are required by law to be made,
maintained or kept on file by the State and local governmental agencies
are to be deemed to be public records, subject to inspection and examination
and available for copying, pursuant to said law. See N.J.S.A. 47:1A-2.

Unless otherwise provided by law the following shall not be
deemed public records subject to inspection and examination and available
for copying pursuant to the provisions of Chapter 73, P.L. 1963:
a. Questions on examinations required to be conducted by any State or
local governmental agency;
b. Personnel and pension records which are required to be made, maintained
or kept by any State or local governmental agency;
c. Records concerning morbidity, mortality and reportable diseases of
named persons required to be made, maintained or kept by any State
or local governmental agency;
d. Records that are required to be made, maintained or kept by any State
or local governmental agency which would disclose information concerning
illegitimacy;
e. Fingerprint cards, plates and photographs and other similar criminal
investigation records which are required to be made, maintained or
kept by any State or local governmental agency;
f. Criminal records required to be made, maintained and kept pursuant
to the provisions of N.J.S.A. 53:1-20.1 and N.J.S.A. 53:1-20.2;
g. Personal property tax returns required to be filed under the provisions of Chapter
4 Title 54 of the revised statutes;
h. Records relating to petitions for executive clemency;
i. Any other record deemed to be a nonpublic record by statute, resolution
of the legislature, executive orders of the Governor, rules of court,
Federal law regulation and orders.

This section shall in no way be interpreted to effect the right
the general public has, by common law, judicial decision, statute
or otherwise, to examine and copy public records and shall be limited
in its application to the provisions of Chapter 73, P.L. 1963.

The following fee schedule shall apply for copies of documents
made pursuant to the request from the general public:
a. Copies obtained from the Division of Licensing and Vital Statistics
shall be subject to the fee schedule outlined below:
1. Certified copies of birth certificates: $20.00 per copy
2. Certified copies of death certificates: 20.00 per copy
3. Certified copies of marriage license: 20.00 per copy
4. A research fee of $10.00 per year shall be charged if the date of
birth, death or marriage is unknown.
5. Duplicates of dog licenses: 5.00
6. Duplicates of metal dog tag: 5.00
b. Public Records Subject to Open Public Records Act.

shall be the same rate/fee assessed to the requester.
c. Police Records.
1. Making and supplying prints of photographs taken in connection with
accident/incident investigation:

b above shall be paid in the Office of the Township Clerk, where copies of the aforementioned items will be available, the fees to be paid to the Township Treasurer immediately upon receipt. Should any Department, other than the Township Clerk's Office receive a request for the duplication of documents, the Department shall determine the number of pages to be duplicated, direct the person to the Township Clerk's Office for payment of the amount determined in subsection
2-43.4 and, upon payment to the Tax Collector's Office, release the duplicated documents.
Any questions regarding whether the requested documents are
public records shall be directed to the Law Department.

One (1) copy of the condensed minutes of any meeting shall be
made available at no charge. In the event a request is made for verbatim
minutes of any meeting of the Township Council, Township Planning
Board, Township Zoning Board, the Rent Review Board or any Township
Advisory Board, the fee shall be one ($1.00) dollar per page, as specified
by the latest amendment to the Land Use Law. (Chapter 216, Laws of

a. A penalty of twenty ($20.00) dollars shall be established for personal

a. Availability. The Township of Cherry Hill Public Grounds Division
"Show Mobile" shall be made available to nonprofit and charitable
groups or organizations for use at various functions.
b. Fees Established. The proper officials of the Township of Cherry
Hill are hereby authorized to establish fees per event for use of
the "Show Mobile," to pay for the cost of labor and equipment at various
functions. The fees are to be determined according to the following

c. Collection of Fees; When Due. The above fee, to be collected by the
Township of Cherry Hill, is due upon application for the events, dependent
upon confirmation of availability, and contingent upon Township approval
by the Township of Cherry Hill.
d. Liability of Applicants. Applicants using the "Show Mobile" shall
agree to assume full liability for any damage to the "Show Mobile"
and/or the sound system, and adhere to all sections of the signed
application.
e. Insurance Required. Applicants must supply certificate of insurance
naming the Township of Cherry Hill as additional insured for said
event and/or function.
f. Right to Change Fees. The Township reserved the right to change the
fee as needed to accommodate extraordinary circumstances.
g. Refunds. Fees are nonrefundable.

a. The Judges of the Municipal Court of the Township of Cherry Hill
are authorized to make decisions as to which defendants are indigent
and after a determination is made, the Public Defender shall represent
the defendant.
b. The Court Administrator shall charge a fee of two hundred ($200.00)
dollars per application for a Public Defender. The fee may be waived
by the Judges of the Municipal Court, in their discretion, in whole
or in part, upon a clear and convincing showing by the applicant that
the application fee represents an unreasonable burden on the person
seeking representation and upon showing of absolute indigency without
the ability to pay the application fee. Need shall be measured according
to N.J.S.A. 2A:158A-14 and by guidelines promulgated by the New Jersey
Supreme Court.
1. Payments. The Municipal Court may permit a person to pay the application
fee over a specific period of time not to exceed four (4) months.
2. Provisional Referral. In the event that a determination of eligibility
cannot be made before the time when the first services are to be rendered,
or if an initial determination is found to be erroneous, the Municipal
Court shall refer the defendant to the Municipal Public Defender provisionally,
and if subsequently it is determined that the defendant is ineligible,
the Municipal Court shall inform the defendant, and the defendant
shall be obliged to engage his own counsel and to reimburse the Municipality
for the cost of the services rendered at that time.
3. Investigation of financial status. The Municipal Court shall make
an investigation of the financial status of each defendant seeking
representation and shall have the authority to require a defendant
to execute and deliver written requests or authorizations required
under applicable law to provide the Court with access to records of
public or private sources, otherwise confidential, as may be of aid
in evaluating eligibility. As provided by law, the Court is authorized
to obtain information from any public record office of the State or
of any subdivision or agency thereof on request and without payment
of the fees ordinarily required by law.
4. Financial obligation of parents or guardians. As provided by P.L.
1997, ch. 256, whenever a person entitled to representation by a Municipal
Public Defender pursuant to this act is under the age of 18 years,
the eligibility for services shall be determined on the basis of the
financial circumstances of the individual and the financial circumstances
of the individual's parents or legal guardians.
5. Reimbursement to the township; liens. As provided by P.L. 1997, ch.
256, if the defendant has or reasonably expects to have means to meet
some part, though not all, of the cost of the services rendered, the
defendant shall be required to reimburse the Township and the Township
shall have a lien on any property to which the defendant shall have
or acquire an interest for an amount equal to the reasonable value
of the services rendered to a defendant pursuant to this act as calculated
at the same rate as the Office of the Public Defender bill clients
at that time.
6. Collection and settlement of claims. The Municipal Attorney may do
all things necessary to collect any money due to the Township by way
of reimbursement for services rendered by a Municipal Public Defender.
The Municipal Attorney may enter into arrangements with any State
or County agency to handle collections on a cost basis. The Municipal
Attorney shall have all the remedies and proceedings available for
collection which are available for or upon the recovery of a judgment
in a civil action and shall also be permitted to collect counsel fees
and costs from the defendant. The Municipal Attorney is authorized
to compromise and settle any claim for services performed whenever
the financial circumstances of the person receiving the services are
such that, in the judgment of the Municipal Attorney, the best interest
of the Township will be served by compromise and settlement.
c. The application fee shall be used to help defray the cost of hiring
a Public Defender and in the administrative cost of the Municipal
Court of the Township of Cherry Hill including, but not limited to,
expert and lay investigation and testimony. Funds collected from the
application fee shall be deposited in a dedicated fund administered
by the Chief Financial Officer of the Township.

a. Findings. Within the Township of Cherry Hill is established a Division
of Emergency Medical Services; and the New Jersey State Department
of Health has issued licensure for the Township of Cherry Hill Division
of Emergency Medical Services as administered by the Business Administration
Office. The Division has been in operation since September 25, 1978
[Ordinance 78-64], providing experience, services and documentation
regarding the patients served; and the Division of Emergency Medical
Services has applied for and has received a "Provider Number" from
the Federal and State administered Medical/Medicaid Programs, enabling
the Township of Cherry Hill to institute a Third Party Payment Plan,
seeking reimbursement from insurance companies for emergency medical
services rendered. Most participants have an insurance plan or other
Medicare/Medicaid coverage which could provide payments to relieve
or partially relieve the revenue obligation of the taxpayers.
b. The Business Administrator and the Chief Financial Officer shall
be responsible for the Third Party Billing Program for Emergency Medical
Services.
c. The fee for services is established as four hundred ($400.00) dollars
per trip.
d. The Business Administrator and/or the Director of Operations and
the Chief Financial Officer shall annually review the cost accounting
records for service provision to analyze and adjust the fee hereby
levied on an annual basis.
e. The fee for services shall be adjusted annually as required pursuant
to the recommendations of the Business Administrator and the Chief
Financial Officer.

a. Availability.
1. Certain Cherry Hill Township groups may request the on-site use of
the Cherry Hill Township Emergency Medical Services Squads at their
particular event.
2. The Township Council and/or the Cherry Hill Township Police Department
may require that a Cherry Hill Township Emergency Medical Services
Squad be present at particular events.
b. Fees Established. The proper officials of the Township are hereby
authorized to establish fees per event for on-site use of the Cherry
Hill Township Emergency Medical Services Squad, to pay for the cost
of labor and equipment at various functions. The fees are to be determined
in the following manner:
1.
Less than full day events.

by the EMT Chiefs and the Police Department.

c. Collection of Fees; When Due. The above fee, to be collected by the
Office of the Business Administrator, is due upon application for
the events, dependent upon confirmation of availability, and contingent
upon Township approval by the Office of the Business Administrator.
d. Refunds. Fees are nonrefundable.

a. An authorized representative of the Recreation Commission and/or
the Recreation Department is authorized to collect and set fees for
special events within the Township of Cherry Hill.
b. Fees Established. The proper officials of the Township are hereby
authorized to establish fees for special events. The fees must fall
within the following ranges:
1. Food Vendors: Fees for participation in the event. These fees are exclusive of any food vending fees required under Article
IX within.
(a)
Mobile food vendors: food vendors who distribute food from a
handcart, truck, pushcart, or other mobile means: $25.00—$100.00/event
(b)
Stationary food: food vendors who distribute food from a table,
booth or by other stationary means: $25.00—$100.00/event
All food vendors must also possess a current Township food vending license pursuant to Article IX within.

2. Non-Food Vendors: Any person(s) distributing non-food items which
include, but are not limited to, balloons, blow-up toys, light sticks/necklaces,
clothing: $25.00—$250.00/event
3. Art and/or Craft Special Events. At any art and/or craft special
event, the participant may be charged for the space occupied: $50.00—$500.00/event
4. Sponsorships. Sponsorships for special events may be solicited by
the proper representatives of the Recreation Department as authorized
by the Mayor or Council.

a. Definitions.
1. NON-POLICE-ORIENTED SECONDARY EMPLOYMENT — Any form of gainful
employment, including self-employment, during the hours when the employee
is off-duty, where the employment capacity is not predicated upon
the employee's authority as a police officer, and where the uniform
of the Cherry Hill Police Department is not worn. (Examples: Retail
Sales, Real Estate Sales, Family Business, Civil Process Server).
The Cherry Hill Police Department may require registration and/or
completion of waiver or conflict forms.
2. POLICE-ORIENTED SECONDARY EMPLOYMENT — The employment of a
police employee during the hours when the employee is off-duty, in
a capacity that requires the member to wear the uniform of the Cherry
Hill Police Department, in a capacity where the uniform is not worn
but where the purpose of the secondary employment is either predicated
upon the employee's authority as a police officer or where employment
is controlled by the guidelines set forth within the 1939 Private
Detectives Act.
3. SCHEDULE COORDINATOR — A Schedule Coordinator is any employee
of the Cherry Hill Police Department, who provides any or all of the
following services for the secondary employer:
(a) The scheduling of the employee himself or herself, or of other employees
to work for one or more employers in a police-oriented secondary employment
capacity.
(b)
Serving as a liaison between one or more police-oriented secondary
employers and one or more employees.
(c)
Exercising any type of administrative control over one or more
employees on behalf of one or more police oriented secondary employers.
4. LEVELS OF EMPLOYMENT —
(a)
Level I Employment: Inside and Outside non-traffic protective
services.
(b)
Level II Employment: Camden County traffic direction and control
assignments.
(c)
Level III Employment: Traffic direction and control assignments,
holidays, and special events that pose a significant impact on public
safety.
5. ADMINISTRATIVE FEE — A fee charged to the secondary employers
at an hourly rate to compensate the Township of Cherry Hill for administrative
expenses.
6. VEHICLE FEE — A fee charged to the secondary employers at an
hourly rate to compensate the Township of Cherry Hill for vehicle
expenses.
7. SCHEDULING FEE — A fee charged to the secondary employers at
an hourly rate to compensate the Township of Cherry Hill for hours
spent to coordinate secondary employment.
8. CREDIT CARD FEE — A convenience fee will be charged to the
secondary employers to pay invoices via credit card.
b. Availability.
1. Certain Cherry Hill Township individuals, groups or organizations
may request the use of "off-duty" Cherry Hill Township Police Officers.
2. Cherry Hill Township police officers may only accept secondary employment
opportunities if:
(a)
The event/assignment is to take place within Cherry Hill Township
or outside of with the approval of the Chief of Police or his designee;
and
(b)
The Cherry Hill Police Department does not require their services
for the Township at the time of the assignment.
(c)
Only the schedule coordinator is permitted to negotiate a contract
with the individual, entity or organization requesting the assignment;
and
(d)
All Secondary Employment must be approved by the Chief of Police
or his designee.
(e)
Under no circumstance may any police officer initiate contact
with outside entities in order to procure secondary employment assignments.
c. Fees Established.
All police-oriented secondary employment will be paid through
the Cherry Hill Township payroll system at the following pay rates:

2. Equipment Use:
(a)
Use of a Patrol Vehicle: $15.00/hour
A marked Township police vehicle will only be assigned for secondary
employment at the discretion of the Chief of Police.
(b)
Other Equipment/Vehicles: Should the assignment necessitate
the use of any Cherry Hill Police Department equipment or vehicles,
other than patrol vehicles, a separate additional fee may be charged.
3. Administrative Fee:
(a)
A flat fee of $5.00 per hour will be assessed to every Scheduling
Fee, Level I, and Level III Secondary Employment hour paid.
4. Scheduling Fee:
(a)
A flat fee of $55.00 per hour will be assessed for a minimum
of one-half hour per invoice.
5. Cancellation Fee:
(a)
If cancellation is within three (3) hours of start time, a mandatory
four (4) hour show up fee per officer, including administrative and
scheduling fees.
6. Credit
Card Fee.
(a) If a vendor wishes to pay an invoice via credit card or e-check,
a convenience fee will be charged:
(1) 2.39% or $1.50 whichever is greater for credit cards.
7. Federal and State contracted jobs will be paid at the prevailing
governmental authorized amount.
d. Collection of Fees; When Due:
The above fee, to be collected by the Cherry Hill Police Department,
is due upon application for the event or service and is dependent
upon confirmation of availability. All police-oriented regular and
seasonal employers will establish an escrow fund with the Township
of Cherry Hill. Payments to the Township will be made in advance of
the disbursement of payroll funds for said secondary employment worked.
The collection of the escrow funds will be the responsibility of the
scheduling coordinator. All fees are non-refundable. If payment is
not made within 21 days, a late fee of $50.00 per invoice may be applied.
e. Any secondary employment that is mandated by a Public Amusement License
and/or Club License, or Township Ordinance, or employment that the
Chief of Police considers a public safety issue, will be paid at the
officer's contractual overtime rate with a four hour minimum.
f. Procedures:
In order to secure the services of a police officer for secondary
employment purposes, the individual entity or organization shall:
1. Make application to the Township, through the Cherry Hill Police
Department, for these services; and
2. Make payment to the Township, in advance of the services to be performed.
All procedures shall conform to the Cherry Hill Police General
order.

a. The Township of Cherry Hill uses various forms of electronic communication
including but not limited to a Township Website.
b. Fees Established. The proper officials of the Township are hereby
authorized to establish fees for the usage of private corporations,
professional corporations and businesses to list their businesses
on the Township Website and/or sponsorship and web page(s).
1. Enhanced listing (Cherry Hill business): $100.00/year
2. Enhanced listing (Non-Cherry Hill business): $125.00/year
3. Sponsorship of Webpage: $2,500.00/year
c. Term. Fees are for one a (1) year period starting from the date of
the listing/sponsorship of the web page.
d. All listings/sponsorships are subject to the approval of the Township.
The Township reserves the right to decline any listing.

a. Trash Cans.
1. As of January 1, 2016, all residents are provided, free of charge,
with one (1) green trash can be utilized with automated trash collection.
As of January 1, 2016, residents may request an additional green trash
can, above and beyond the one (1) can previously provided by the Township.
2. Fees Established. The fee for an additional Township green trash
can shall be fifty ($50.00) dollars per can. This fee applies to an
additional 96-gallon and/or 64-gallon can(s), to be utilized by the
household for automatic trash collection.
3. Refunds. Fees are nonrefundable.
b. Recycling Buckets.
1. Residents already possess blue recycling buckets as part of the Township's
recycling program. As of January 1, 2016, residents may request an
additional blue recycling bucket, above and beyond the one (1) bucket
previously provided by the Township.
2. Fees Established. The fee for an additional recycling bucket shall
be fifty ($50.00) dollars per bucket.
3. Refunds. Fees are nonrefundable.

a. Recreation Program Fees. The Township of Cherry Hill sponsors, conducts
and directs recreation programs. The Recreation Commission establishes
the fees for all recreation programs.
b. Children in Need. Hardship requests will be reviewed individually
and approved or denied by the Recreation Department.
c. Residency. The Recreation Department will clearly identify programs
that are restricted to residents only. When applicable, nonresidents
may register for recreation programs if space exists. Registration
fees for nonresidents will be assessed an additional fee. This nonresident
surcharge is set by the Recreation Department. In cases where an adult
is registering a minor, the parent/guardian registering the child(ren)
must reside in Cherry Hill Township.
d. Nonrefundable. All fees specific to recreation programs are nonrefundable,
unless a physician provides a medical exemption.

a. Purpose. The primary purpose of Cherry Hill Township's historic grounds/meeting
rooms is to support Township programs and activities. Accordingly,
Township sponsored programs and the programs of the Township's affiliated
organizations will always be given first priority in the reservation
of grounds/meeting room space at no cost. When there is available
space, individuals/organizations may rent Township grounds/meeting
space according to the fees set forth within.
b. Locations. The Township of Cherry Hill schedules the use of (1) the
grounds of two Township-owned historic sites, Barclay Farmstead (209
Barclay Lane) and Croft Farm (100 Bortons Mill Road) and (2) meeting
room facilities at the Croft Farm Arts Center (100 Bortons Mill Road)
and the Carman Tilelli Community Center (820 Mercer Street).
c. Facility Use Policy. Each individual and/or group must adhere to
the Facility Use Rental Policy set forth by the Township of Cherry
Hill.
d. Meeting Room Availability. Meeting rooms are available for rent Monday
through Friday as well as evenings and weekends, provided there is
not a conflict with Township usage/programming.
e. Historic Grounds Availability. Historic grounds may be rented seasonally,
15 April — 31 October, with a maximum of two rentals per month
and provided there is not a conflict with Township usage/programming.
There is an eight (8) hour maximum rental time, with all vents ending
no later than 11:00 p.m. inclusive of clean-up.
f. Meeting Room Fee(s) Established.
Weekday
Monday — Thursday from 5:00 p.m. — 10:00 p.m.
Residents — $50.00 per hour with minimum of two hour rental
Nonresidents — $65.00 per hour with minimum of two hour
rental
Additional time will be billed at a rate of $75.00 per hour
Weekend
Friday from 5:00 p.m. — 10:00 p.m.
Saturday and Sunday from 9:00 a.m. — 10:00 p.m.
Residents — $150.00 per hour with minimum of four hour
rental
Nonresidents — $175.00 per hour with minimum of four hour
rental
Additional time will be billed at a rate of $200.00 per hour
Sound and Technician — If the Township sound system is
required an additional fee of $100.00 per event will be required.
Additional fees may be required based upon the request made
for each event that may include but not limited to on site security,
parking staff, or event coordinator(s).
g. Historic Grounds Fees.
1. Site Fee:
Residents — $1,500.00 per rental
Nonresidents — $1,750.00 per rental
2. Attendant Fee: $250.00 (Paid directly to Friends of Barclay Farmstead
or other affiliate organization)
3. Private Access: $150.00 (only available with full site rental for
Barclay Farmstead of Kay-Evans House). This fee includes private access
to the Barclay Farmstead or Kay-Evans House for up to 20 guests (e.g.
bridal party) and up to two (2) hours of guided tours of each site.
(Paid directly to Friends of Barclay Farmstead or other affiliate
organization)
4. Overtime Site Charge: $300.00/hour.
5. Overtime Attendant Fee: $50.00/hour.
6. Advance Access: (See attached policy) $100.00/hour. This fee applies
to site access above and beyond the two (2) hours advance access within
the week preceding the event. This fee is payable to Cherry Hill Township.
h. Security Deposit.
1. Meeting Rooms: In addition to the fees listed above each rental will
require a $100.00 security deposit due within seven (7) days of reserving
date. This deposit may be returned in full, partial, or not at all
depending on the condition of the space at the end of their event.
2. Historic Grounds: In addition to the fees listed above each rental
will require a $500.00 security deposit due within seven (7) days
of reserving date. This deposit may be returned in full, partial,
or not at all depending on the condition of the space at the end of
their event. In the event of a cancelation the entire deposit is forfeited.
i. Nonrefundable. All fees specified to the rental agreement are nonrefundable.
j. Balance Due. Full payment of all Township fees (except security deposit
addressed in paragraph h) are due within 48 hours of event. If payment
not received within specified period, deposit will be deemed forfeited
and rental cancelled.
k. Certificate of Insurance. Each organization will be required to furnish
the Township with an insurance policy naming the Township of Cherry
Hill as additional insured as per the limits set forth in the Facility
Use Policy.
l. Changes. The Township reserves the right to change the fees as needed
to accommodate extraordinary circumstances.

22 (Recreation), Section
22-10 for cross reference.
