There shall be a Board of Health established in the Borough of Merchantville organized in accordance with the provisions of the Act of the Legislature of the State of New Jersey entitled "An Act to establish in this State a Board of Health, and a Bureau of Vital Statistics, and to define their respective powers and duties," approved March 31, 1887.[1]

Said Board shall be composed of five members, residents of the borough, appointed by the Mayor and confirmed by Borough Council. The members of the Board of Health first appointed in pursuance of this Article shall hold their office as follows: one until December 31, 1931, two until December 31, 1932, and the remaining members, until December 31, 1933: provided, however, that except to fill an unexpired term, all appointments thereafter shall be for the term of three years or until their successors are appointed and qualified. If any vacancy shall occur in said Board by reason of the resignation, death or inability of a member to fulfill the duties of his office, or his removal from the borough, such vacancy shall be filled by appointment of the Mayor, confirmed by Borough Council, but for the unexpired term only.

It shall be the duty of the Mayor, at the organization meeting of the borough in each year, or at the next regular meeting thereafter, to nominate to Borough Council the names of persons to fill vacancies caused by the expiration of the terms of any member or members of said Board; provided, however, that nominations to fill vacancies for an unexpired term may be made at any time.
This article shall take effect immediately.
