The regulation, planting, care and control of shade and ornamental
tree and shrubbery upon and on the streets, highways, public places,
parks and parkways of the Borough of Merchantville shall hereafter
be exercised by a Commission consisting of seven residents of the
borough which shall be known as the "Shade Tree Commission of the
Borough of Merchantville." The members of such Commission shall be
appointed by the Mayor or other chief executive officer of the borough
within 60 days after this Article shall become effective and shall
serve without compensation.

The terms of office of the Commissioners first appointed shall
commence upon the day of their appointment and be for the respective
periods of three, four and five years from January 1 next succeeding
such appointment, the terms of each appointee to be designated in
his appointment. All subsequent appointments, except to fill vacancies,
shall be for the full term of five years, to take effect on January
1. Any vacancy occurring by reason of the death, resignation or removal
of any Commissioner shall be filled for the unexpired term by the
Mayor or other chief executive officer.

The purpose of this amendment is to increase the Shade Tree
Commission from five to seven members. This amendment is not intended
nor should be construed or interpreted as revoking the appointments
of the members currently serving or in altering their terms of office.
One of the new appointees shall be appointed for a term of four years
and the other new appointee shall be appointed for a term of five
years from January 1 next succeeding such appointments. The terms
of each appointee shall be designated in his appointment and shall
be for such a period of time that the appointee's term shall
not expire on the same date as any member currently serving or the
other appointee.
Such Commission shall organize, within 30 days after the appointment
of its total membership, for the remainder of this calendar year,
and thereafter annually by the election of one of its members as President
and the appointment of a Secretary, who need not be a member.
Such Commission shall exercise the powers conferred and perform
the duties imposed upon it by Chapter 64 of Title 40 of the New Jersey
Statutes Annotated of the State of New Jersey of 1937 (N.J.S.A. 40:64-1
to 40:64-14), as amended and supplemented, and the funds to be used
by said Commission shall be raised in the manner provided by said
act, its supplements and amendments.
This article shall take effect upon due passage and publication
according to law.
