The power of the municipality to adopt ordinances concerning
traffic and parking is contained in R.S. 39:4-197. Various statutory
provisions throughout Title 39 control the manner in which municipalities
may regulate parking and traffic. R.S. 39:4-8 and R.S. 39:4-202 requires
that all traffic and parking ordinances be approved by the Motor Vehicle
Commission.
As used in this chapter, words and phrases concerning traffic
shall have the meanings ascribed to them in N.J.R.S. 39:1.1.
Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time,
as may be in current use in the borough.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in R.S. 39:4-138, any other New Jersey statute
or as hereinafter provided.
a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets within the borough. The emergency management
coordinator or the chief of police, or in either of their respective
absences, the ranking police officer, is authorized to declare an
emergency and to direct the posting of EMERGENCY NO PARKING signs
for the notification of such an emergency to the operator or owner
of any vehicle parked upon any street within the borough, when weather
conditions, accidents, fires, public celebrations, etc., dictate or
require the avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification of a declaration of an
emergency shall be given to the operator or owner of any vehicle which
has been parked prior to such declaration.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
c.
The effectiveness of this subsection is contingent upon the reasonable
attempt, based upon the existing circumstances, of providing notification
to the operator or owner of the vehicle at issue, or signs being erected
as required by law.

No person shall park a vehicle at any time upon any of the streets
or parts of streets described in Schedule I attached to and made a
part of this chapter.

No person shall park a vehicle between the hours specified on
any day, except Sundays and public holidays upon any of the streets
or parts of streets described in Schedule II attached to and made
a part of this chapter.

No person shall park a vehicle for longer than the time limited
designated at any time between the hours listed on any day, except
Sundays and public holidays upon any of the streets or parts of streets
described in Schedule III attached to and made a part of this chapter.
a.
Branch Avenue Parking Lot. No person shall park a vehicle in the
municipally-owned parking lot situated on the westerly side of Branch
Avenue and bounded on the east by Branch Avenue, on the north by Sycamore
Avenue, on the south by Oceanport Avenue and on the west by the right-of-way
of the New York and Long Branch Railroad Company without first securing
a permit therefore as provided in paragraph c. below; except as provided
in the subparagraphs below.
1.
No person shall park a vehicle in either of the two spaces in the
above described parking lot designated for Fifteen Minutes for a period
longer than the time limit.
2.
No person shall park a vehicle in the space in the above described
parking lot designated for handicapped parking who is not certified
as handicapped by the State of New Jersey, Motor Vehicle Commission.
3.
There shall be no parking except in the spaces provided therefor
and delineated by lines painted upon the surface of the parking area.
b.
Little Silver Railroad Station Parking Lot. No person shall park
a vehicle in any portion of the municipally leased and operated parking
lot, situated in the vicinity of the Little Silver Railroad Station,
which portion is designated for permit parking, without first securing
a permit therefor as provided in paragraph c. below.
No person shall park a vehicle in that portion of the parking
lot designated for meter parking without depositing in the meter provided
for the space occupied a fee calculated at a rate of three ($3.00)
dollars per 24 hours. Rebates for violations are permitted in the
event that the violations are a result of the pay stations being out
of order.
No person shall at any time stop or stand a vehicle on any portion
of the municipally leased and operated parking lot ingress or egress
road.
There shall be no parking except in the spaces provided therefor
and delineated by lines painted upon the surface of the parking area.
c.
Permits.
1.
Persons may secure parking permits by applying therefor to the borough
clerk, in the borough hall and paying the required fee.
2.
Permits shall be issued for six months and 12 months respectively
and shall be displayed by affixing the permit to the backside of the
rear view mirror so that the permit is plainly visible through the
front windshield of the vehicle when the same is parked in the parking
lot.
3.
Effective November 1, 2007, the fee for a six month permit shall
be two hundred ($200.00) dollars and the fee for a 12 month permit
shall be three hundred sixty ($360.00) dollars. The applicant must
exhibit a valid registration for each vehicle for which a parking
permit is being obtained.
4.
Should a properly registered vehicle be unavailable for use for any
reason by the permit holder and such permit holder desires to use
another vehicle temporarily, the permit holder may make a call to
police headquarters advising of the circumstances. Such call if properly
logged will suffice to cover the temporary vehicle for the balance
of the week in which the call was made. Calls may be made during the
evening prior to use of the temporary vehicle or before 8:30 a.m.
of the morning said temporary vehicle is to be used.
5.
Resident permits shall authorize the permit holder to park in both
the Branch Avenue parking lot and the Little Silver Railroad Station
parking lot. Nonresident permit holders shall be licensed to park
in the Little Silver Railroad Station parking lot.
a.
Handicapped Parking in Municipal Parking Lots and Board of Education
Property. In accordance with the provisions of R.S. 39:4-197, the
following off-street municipal parking yards and board of education
property, as shown in Schedule XII attached to and made part of this
chapter, are designated as handicapped parking areas. Such spaces
are for use by persons who have been issued special identification
cards for plates or placards by the N.J. Motor Vehicle Commission,
or a temporary placard issued by the chief of police. No other person
shall be permitted to park in these spaces.
b.
Handicapped Parking on Street. In accordance with the provisions
of N.J.S.A. 39:4-197, the following on street locations as shown in
Schedule XIII attached to and made part of this chapter, are designated
as handicapped parking spaces. Such spaces are for use by persons
who have been issued special identification cards for plates or placards
by the Division of Motor Vehicles, or a temporary placard issued by
the chief of police. No other person shall be permitted to park in
these spaces.
c.
Handicapped Parking on Private Property Open to the Public. In accordance
with the provisions of R.S. 40:48-2.46, the following off-street parking
yards as shown in Schedule XIV attached to and made part of the chapter,
are designated as handicapped parking areas. Such spaces are for use
by persons who have been issued special identification cards for plates
or placards by the Division of Motor Vehicles, or a temporary placard
issued by the chief of police. No other person shall be permitted
to park in these spaces.
d.
Handicapped Parking on all Other Private Property. In accordance
with the provisions of R.S. 39:5A-1, the following off-street parking
yards an designated in Schedule XV attached to and made part of this
chapter, are designated as handicapped parking areas. Such spaces
are for use by persons who have been issued special identification
cards for plates or placards by the Division of Motor Vehicles, or
a temporary placard issued by the chief of police. No other persons
shall be permitted to park in these spaces.
e.
Signs, Pavement Markings, Installation and Maintenance. The owner of the premises referred to in subsection 10-3.7c and 10-3.7d, shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signing and markings shall be checked by the Little Silver Police Department to insure installations meet Federal specifications, and all signing shall conform to the current manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition and at no cost or expense to the borough. The owner shall be responsible for the repair and restoration or replacement of same.
f.
Penalties. Unless another penalty is expressly provided by New Jersey
Statute, any person parking a motor vehicle in a restricted parking
space without a special vehicle identification card shall be liable
to a fine of one hundred ($100.00) dollars for the first offense and
for subsequent offenses, a fine of at least one hundred ($100.00)
dollars and up to 90 days community service on such terms and in such
form as the court shall deem appropriate, or any combination thereof.
a.
Pursuant to the provisions of N.J.A.C. 5:18-3.2(a) 3.F-311 and N.J.S.A.
40A:14-53 the borough fire prevention official is hereby authorized
to establish, within parking places or areas to which the public is
invited, fire lanes in which all vehicular parking is prohibited and
to require the owner of said parking places or areas to appropriately
delineate and mark said area as a fire lane in which parking is prohibited.
b.
Parking of vehicles in or otherwise obstructing, designated and marked
fire lanes throughout the borough is hereby prohibited.
c.
Any owner of a parking place or area who refuses to comply with the
directive of the borough fire prevention official shall be subject
to a fine and costs of court.
d.
Any person who violates the no parking provisions of this subsection
shall be subject to a fine of twenty-one ($21.00) dollars and costs
of court.
No person, at any time, shall park, stop, stand or abandon any
motor vehicle or obstacle on any street in the borough during snow
removal activities.
No person shall stop or stand a vehicle between the hours specified
on any day upon any of the streets or parts of streets described in
Schedule IV attached to and made a part of this chapter.
Busses and trucks over four tons gross weight are hereby excluded
from the streets or parts of streets described in Schedule V attached
to and made a part of this chapter, except for the pick up and delivery
of materials or passengers.
The streets or parts of streets described in Schedule VI attached
to and made a part of this chapter are hereby designated as one-way
streets in the direction indicated.
Pursuant to the provisions of R.S. 39:4-140, the streets or
parts of streets described in Schedule VII attached to and made a
part of this chapter are hereby designated as through streets. STOP
signs shall be installed on the near right side of each street intersecting
the through street except where YIELD signs are provided for in the
designation.
Pursuant to the provisions of R.S. 39:4-140, the intersections
described in Schedule VIII attached to and made a part of this chapter
are hereby designated as stop intersections. STOP signs shall be installed
as provided therein.
Pursuant to the provisions of R.S. 39:4-140, the intersections
described in Schedule IX attached hereto and made a part of this chapter
are hereby designated as yield intersections. YIELD signs shall be
installed as provided therein.
The locations described in Schedule X attached to and made a
part of this chapter are hereby designed as bus stops.
The locations described in Schedule XI attached to and made
a part of this chapter are hereby designated as taxi stands.
Pursuant to R.S. 40:48-2.46, vehicular traffic and the parking
of motor vehicles in the shopping center area known as the Little
Silver A & P Shopping Center on Prospect Avenue and having an
exit on Church Street shall be subject to the following regulations:
No motor vehicle or other vehicle shall be operated in the area
at a speed greater than ten miles per hour.
No motor vehicles other than the motor vehicles of employees
of businesses situated in the area shall be parked therein between
the hours of 12:00 midnight and 6:00 a.m.
There shall be no parking except in the spaces provided therefor
and delineated by lines painted upon the surface of the parking areas.
All traffic signs, including, among others, directional signs,
stop signs and yield signs, shall be placed in the area by or under
the supervision of the police department and both pedestrian and vehicular
traffic in the area shall comply with such signs.
The entrance driveway at Grant's Store shall be expanded
to and maintained at a width of 30 feet.
Any person who violates or fails or refuses to comply with this
section shall, upon conviction thereof, be liable to a fine not exceeding
two hundred ($200.00) dollars or imprisonment for a term not exceeding
ten days.
Unless another penalty is expressly provided herein or by New
Jersey statute, any person convicted of a violation of this chapter
or any supplement thereto shall be liable to a penalty of not more
than fifty ($50.00) dollars or imprisonment for a term not exceeding
15 days or both.

a.
Whenever, in the discretion of the mayor, it is found necessary for
the preservation of the public health, safety or welfare to close
that portion of Prospect Avenue from its southerly terminus at Little
Silver Point Road to its intersection with Willow Drive to motor vehicle
through traffic during certain hours on weekdays of the official school
year (as promulgated by the Little Silver Board of Education) he may
do so by regulation to the chief of police.
b.
The closing of that portion of Prospect Avenue shall be only during
the hours of 8:00 a.m. to 8:30 a.m. and from 2:30 p.m. to 3:15 p.m.

No person shall turn a vehicle 180 degrees in order to travel
in an opposite direction on the streets or portions of streets described
in Schedule XVI attached to and made a part of this chapter.

another vehicle when traveling in the same direction within the streets

In order to enhance safety for the motoring public, a movement
prohibition shall be established for the intersection of County Road
11 (Oceanport Avenue) and the driveway for Townhomes at Little Silver
in the Borough of Little Silver, Monmouth County, New Jersey. No person
shall make a left turn from northbound on County Road 11 (Oceanport
Avenue) into Essex Drive, the driveway for Townhomes at Little Silver
between the hours of 6:00 a.m. to 9:00 a.m. and 4:00 p.m. to 7:00
p.m. Monday through Friday as described in Schedule XIX attached to
and made a part of this chapter.

semi-public roads, streets, driveways and parking lots as depicted
on the approved and signed site plans for Red Bank Regional High School

All stalls shall be 12 feet wide as shown on the applicable
site plan and signed with the R7-8 and R7-8P (Reserved Parking Sign
and Penalty Plate), in the designated parking areas for persons who

Any vehicle parked or standing as to obstruct or impede a normal
flow of traffic, block entrances or exit ways, loading zones, oil
fills, any grass area, pedestrian walkway, or present in any way a
safety or traffic hazard may be removed by towing at the owner's
or operator's sole expense.

and paid for by the applicant. All signing shall conform to the current
Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198
