a. There is hereby established in the Borough a "Tree Dedication Program"
to become effective on July 1, 2023. Said program shall be in accordance
with recommendations submitted by the Borough Environmental Commission,
an advisory board of the Borough.
b. The Business Administrator and the Director of Public Works, in consultation
with the Borough Environmental Commission, are hereby authorized and
directed to prepare the formal Tree Dedication Program specifying
the terms, conditions, and requirements thereof. In so doing, the
Business Administrator and Director of Public Works are authorized
to seek the services of such other Borough consultants as may be required.
The plan, when finalized, shall be submitted to Borough Council for
final approval which approval shall be expressed in the form of a
formal resolution. Such resolution when adopted shall remain in effect
from year to year thereafter until such time as it may be amended
or rescinded.

a. The program shall establish a dedication fee. A portion of such fee,
as determined by the plan and as modified by time to time by Borough
Council, shall be designated as a fund for the services of an arborist
for the trees in the program. The remaining part of the dedication
fee shall be utilized for the replacement of diseased, dying or dead
trees that are in the program and for the purchase of additional trees
to be placed throughout the Borough and which shall be available for
future dedication.
b. The Borough will establish a Dedication by Rider, either as part
of the Environmental Trust Fund or otherwise as the Chief Financial
Officer shall determine, for all revenue received from the program
and for the payment of all expenses associated with the program as
specified therein.
c. The purpose of the Dedication by Rider is to establish a mechanism
which shall be separate and apart from the Current Fund of the annual
municipal budget and which shall exist on a continuing basis from
year to year.
d. A condition of the program is that it be totally funded from the
dedication fees received and provided further that such program shall
not require any municipal appropriation of tax revenues to fund or
sustain the program.

a. The Business Administrator in consultation with the Director of Public
Works and such other Borough consultants as the Business Administrator
or Director of Public Works deem necessary, and after consultation
with the Borough Environmental Commission, is hereby authorized to
adopt reasonable rules and regulations for the enforcement of this
chapter.
b. In accordance with N.J.S.A. 40:69A-183 any such rule or regulation
shall become effective when filed with the Borough Clerk and approved
by resolution of Borough Council which resolution shall establish
the effective date thereof.
