[2000 Code § 7-1.1]
Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.
[2000 Code § 7-2.1]
a. 
The City Manager or, in his/her absence, disability or inability to act, the Mayor, and, in the event of his/her absence or disability or inability to act, the Chief of Police or his/her designee is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated in accordance with Subsection a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty ($50) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

a. 
Hours Established for Street Closings. Where the City Manager shall find that a safety problem exists with respect to ingress or egress from any public or private school or with respect to recreational facilities for children attending such school due to a lack of a suitable area surrounding such school, or both, he/she is hereby authorized to close, by regulation, any portion of any street within the block upon which such school is located, to the use of through traffic during the time he/she shall determine, not to exceed one (1) hour between 7:00 a.m. and 10:00 a.m., two (2) hours between 11:00 a.m. and 2:00 p.m., and one (1) hour between 2:30 p.m. and 4:30 p.m., on any days when such school is in session and to permit the use of the portion of the street, during the hours, for ingress to and egress from such school, and for the use by pupils of such school for recreational purposes under proper supervision.
b. 
Supervision Provided. The City Manager shall provide adequate police and police facilities for such supervision and for the control of traffic upon such portion of the street.
c. 
Warning Signs Posted. There shall be posted on the street a warning sign indicating that the street is closed and the purpose thereof during the time the street is so closed.
d. 
General Procedures for Street Closings. No person shall cause a street to be closed for any reason other than as provided in this subsection until the following procedure has been followed to the satisfaction of the City Manager or his/her designated officer:
1. 
A request shall be made in writing to the City Manager as he/she shall designate, fully describing the street or street segment to be closed, the duration of the proposed street closing and the purpose for such street closing.
2. 
A diagram of the street or street segment to be closed shall be submitted, showing the proposed locations of signage warning the public that the street is closed and the purpose of the closing. The requester shall place warning signs at locations specified by the Police Department, if deemed necessary by that Department or the City Manager.
3. 
The Director of Public Works may, upon notifying the Police Department, Fire Department and the City Manager, close any street or public place or section thereof to public traffic for the purpose of repairing, constructing or reconstructing the same, or for any other public purpose. Warning signs shall be posted as provided in Subsection c. above.
e. 
Penalty. Any person violating any terms of this section or any regulation promulgated thereunder shall, upon conviction, be liable to the penalty stated in Chapter I, Section 1-5.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than fifty ($50) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

a. 
Whenever a snow state of emergency has been declared by the Emergency Management Coordinator, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below and as identified on the "Snow Route/Emergency Evacuation Route Map" (the "Map"), as prepared by the City Engineer, dated July 26, 2010, which is incorporated herein and made a part hereof by reference. The Map shall be retained on file in the City Clerk's Office and in the City Police and Fire Departments.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
c.

d.

The Map shall be retained on file in the City Clerk's Office and in the City Police and Fire Departments.

a. 
Pursuant to N.J.S.A. 39:4-138.6, the permissible distance a person may park a motor vehicle from a "stop" sign is twenty-five (25) feet except when the intersection is located in a school zone, in which case the mandated parking distance is fifty (50) feet, pursuant to N.J.S.A. 39:4-138(h). All intersections otherwise posted prior to the adoption of this chapter shall remain in effect. Only the Municipal Engineer, or designee, shall reserve the right to modify the distance at any of these locations.
b. 
Vehicles shall at all times comply with all other parking regulations, including but not limited to regulations on parking permits, street cleaning, and parking along emergency snow routes.
c. 
The City of Asbury Park shall not be required to install or maintain any markings, signs or other indications for permissible parking distances; it shall be incumbent upon the driver to ensure that no vehicle is parked within the permissible parking distances at any time.
d. 
All other provisions of N.J.S.A. 39:4-138 shall apply.
[2000 Code § 7-8.1]
The City Council hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The City of Asbury Park, in the County of Monmouth, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.
[2000 Code § 7-8.2]
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two (2) emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the City may respond to correct such hazardous condition. The reasonable fees for such emergency service by the City shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the City before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police Department. If it is determined by the Officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment, vehicles and stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.
[2000 Code § 7-8.9]
Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than one hundred ($100) dollars nor more than five hundred ($500) dollars and/or be imprisoned in the County Jail for a term not exceeding ninety (90) days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than two hundred fifty ($250) dollars and/or be imprisoned in the County Jail for a term not exceeding ninety (90) days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

Vehicles Over 6,000 Pounds. No truck, bus, tractor trailer or trailer body of any kind, vacation house or camper trailer, pickup, coach or similar vehicle of any kind, weighing six thousand (6,000) pounds registered gross weight or more, or any boat or boat trailer of any size shall be parked on any street in any zone except while actually loading or unloading or making pickups and deliveries, and except as otherwise provided herein. This prohibition shall not apply to properly registered pickup trucks or vans which do not exceed nineteen (19) feet in overall length.
b. 
Construction trailers, upon approval of the Construction Official, may be permitted to be parked on any street in any zone after issuance of a Building Permit for and during the construction of the principal structure therein, but shall be removed prior to the issuance of the Certificate of Occupancy for the principal structure in residential zones and within thirty (30) days of the issuance of the Certificate of Occupancy for the principal structure in all other zones.
c. 
This prohibition shall not apply to trucks, tractor trailers, buses or similar vehicles which are used as motor vehicles to transport goods or materials in connection with the business conducted on premises located in business, commercial and industrial zones only, provided that all such vehicles are properly registered and kept in good repair.
d. 
This prohibition shall not apply to service vehicles parked in residential areas during the performance of services.
e. 
Signs shall be erected giving notice of the prohibitions set forth herein.

The City Manager and the Chief of Police or his/her designee shall have the power to change traffic routing, specifically by creating one-way streets in streets that are presently two-way streets, when emergent situations arise requiring such action. The City Manager and the Chief of Police or his/her designee shall determine when such an emergent situation exists in his/her sole discretion. However, under no circumstances shall a change in traffic routing undertaken by the City Manager and the Chief of Police or his/her designee pursuant to this section last longer than seventy-two (72) hours, unless there is action by the Council of the City of Asbury Park to leave the emergency traffic routing in place longer than it is necessary to remediate the emergent situation and/or the expiration of seventy-two (72) hours, whichever occurs first.

In accordance with the provisions of N.J.S.A. 39:4-197, the following on-street locations are designated as handicapped parking places. Such spaces are for use by persons who have been issued special identification cards or plates or placards by the New Jersey Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these places.

That on or before January 15th of every year (or the first weekday thereafter), the applicant shall provide proof to the City of Asbury Park Police Department that the handicapped parking space is still needed at the subject property. The owners of the premises referred to in subsections 7-36.3 and 7-36.4 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the City of Asbury Park. The owner shall be responsible for the repair and restoration or replacement of same.

Pursuant to P.L. 1989, C. 201 (N.J.S.A. 39:4-1380), the penalties for violations of this Section 7-35 must be one hundred ($100) dollars for a first offense and for a subsequent offense must be a fine of at least one hundred ($100) dollars and up to ninety (90) days community service on such terms and such form as the Court shall deem appropriate, or any combination thereof.

The MonOc Credit Union of Asbury Park has filed a written consent with the City that the provisions of Subtitle One, Title 39, of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots at MonOc Credit Union, Monroe Avenue and Bond Street.

Tow-Away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any grass area, pedestrian walkway, or to present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

Installation of Signs. All signs, posts, bolts, or other necessary materials shall be installed and paid for by the applicant. Work shall be checked by the Police Department to ensure installations meet State and Federal Specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.

Penalty for Violation. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of not less than one hundred ($100) dollars for the first offense; subsequent offense, not less than one hundred ($100) dollars and up to ninety (90) days community service, or both.

For a violation of the provision of this Section 7-37 or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than fifty ($50) dollars or imprisonment for a term not exceeding fifteen (15) days, or both; except that for a violation of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:123 et seq. or N.J.S.A. 39:4-140 et seq., the offender shall be liable to a penalty of not less than fifty ($50) dollars or more than two hundred ($200) dollars or imprisonment for a term not exceeding fifteen (15) days, or both.

As used in this section:
PARKING LOT
Shall mean, pursuant to N.J.S.A. 39:5A-1, any place, lot, parcel, yard, or garage used in whole or in part for storing or parking motor vehicles, where a storage or parking fee is charged therefor, and which is open to the general public. The term excludes residential, neighborhood parking lots restricted to residents thereof without charge, or on a monthly rental basis, where such premises are not held out for use by the general public and are not marked or advertised as a public parking lot.

a. 
No person shall operate or maintain a parking lot without obtaining a license from the City. Application for the license and renewal shall be made to the City Clerk.
b. 
No license shall be issued until all the requirements of this section and the matters set forth, in the application and shown on the plan filed in connection therewith have been complied with and approved by the City Clerk and the Director of Public Safety.
c. 
No license shall be granted for any premises unless the use for automobile parking is permitted on the premises under the Zoning Regulations of the City or under a variance granted under the Zoning Regulations.
d. 
The license for a parking lot expires annually on December 31.
e. 
The conditions set forth in the application upon which the license is issued shall be maintained by the licensee continuously during the conduct of the business thereunder.
f. 
In the event of the sale or transfer to new ownership of the parking premises, the new owner shall make application to the City Clerk for transfer in manner provided herein. Such application and transfer shall be subject to all the conditions of a new application.

a. 
Application for a parking lot license shall be made by the person intending to operate the parking lot, upon a form furnished by the City Clerk. Applicant shall file with the application a plat or drawing of the parking lot, approved by the City Engineer, showing the location, size, capacity and, subject to City approval, the location and size of driveways, kind of floors or ground surface, location, size, and construction of attendant's shelter, wall or railing surrounding the lot, location and type of lighting units and signs. It shall not be necessary to furnish a supplementary plat or drawing with application for renewal unless changes have been made that do not appear upon the original plat.
b. 
The application shall contain the following information:
1. 
The name under which, and place where, the parking lot is to be operated;
2. 
Whether the applicant is an individual, partnership or corporation; if an individual, the name and business and residence address of the applicant; if a partnership, the name and business and bona fide residence address of each partner; if a corporation, the name, date, and State under which such corporation was organized, and the name and business address of the officers and stockholders;
3. 
Whether the premises are owned or leased by the applicant, and, if leased, the name and business address of the owner;
4. 
The number of motor vehicles which may, at one time, be stored upon the premises;
5. 
The hours during which the motor vehicles may be stored;
6. 
The hours during which parking attendants will be on duty on the lot;
7. 
A complete schedule of rates to be charged for storing motor vehicles; and
8. 
Such other information as the City Clerk may require.
c. 
The application shall be signed and verified by the applicant, if an individual or partnership, or by an authorized agent, or properly constituted officers if a corporation.
d. 
Before a license is issued, a Certificate of Occupancy shall be obtained from the Building Subcode Official.

Prior to the issuance of a license for a parking lot, the applicant shall file a policy or certificate of public liability insurance in the minimum of ten thousand ($10,000) dollars for each person, and twenty thousand ($20,000) dollars for two (2) or more, and five thousand ($5,000) dollars property damage, by a company authorized to do business in New Jersey. Any owner desiring to carry his/her own public liability insurance may make application to the Mayor and Council, showing his/her financial ability to do so, and, if the Mayor and Council is satisfied of the applicant's financial ability, they may exempt the applicant from the requirement of furnishing the policy of insurance. A determination of such financial responsibility shall be made upon the application for renewal. The Mayor and Council may at any time during the period for which such exemption is granted review such action and make a new determination as to the insurance requirements.

a. 
Fee imposed.
Every public and commercial parking facility shall pay a license fee. There is hereby levied and imposed upon the use and privilege of parking a motor vehicle in or upon any parking lot or garage in the City a fee of $10 for each designated parking space. The ultimate incidence of and liability for payment of such fee is to be borne by the operator of the parking facility.
b. 
Nonpayment of fee on due date.
Whenever the license fee required to be paid is not paid on or before the date on which it becomes due, as herein provided, a penalty shall be imposed. A penalty at the rate of 7% will be imposed for nonpayment as of January 1 through January 31. Thereafter, an additional 1.5% will be imposed for each delinquent calendar month.

a. 
The Mayor and Council, subject to right of appeal, may after a hearing, revoke or suspend a parking lot license upon proof that the licensee, his/her agent or employee:
1. 
Has made any false or materially incorrect statements in his/her application; or
2. 
Has made any charge for storing any motor vehicle in a parking lot other than set forth in his/her license application; or
3. 
Has violated or permitted or countenanced the violation of any provision of this chapter; or
4. 
Has violated or permitted or countenanced the violation of any provision of any penal law or ordinance regarding theft, larceny or conversion of a motor vehicle, or the operation of a motor vehicle without the owner's consent, whether or not such license or other person has been convicted of such an offense; or
5. 
Fails to keep an attendant on duty during the time specified on his/her application; or
6. 
Fails to keep the lot adequately lighted at all times that cars are stored thereon, during the hours that the lot shall be kept open, according to the application for a license.
b. 
The licensee is responsible for the proper conduct of his/her agents, and employees in the conduct of the business, and for any violation of the provisions of this section by them.
c. 
No license shall be revoked or suspended for any of the above listed reasons until the licensee has been notified in writing of the charges against him/her. The notice shall be given by registered mail to the licensee at the address given in the application. The notice shall state the time and place of the hearing.

a. 
The operator of a parking lot shall maintain in good condition at each entrance to his/her parking lot a sign showing the name of the licensee, the hours of the day or night during which such place is open for storing motor vehicles, the rates charged, and the closing hour of the station. Where more than one (1) rate is charged for parking, the figures for each rate shall be of the same size and dimension, and such figures shall measure not less than three (3) inches in height.
b. 
Signs giving information as to the owner, rates, and operation of the lot shall be erected on private property only at points of ingress or on shelter buildings and not on enclosures. They shall be of sheet metal or other suitable material and shall be displayed at a height of not less than four (4) feet and not more than twelve (12) feet above street level. No sign shall be erected in such manner as to obstruct the vision of traffic. The sign shall be readily visible within a reasonable distance.

A wood or concrete bumper six (6) inches high and six (6) inches in width, suitably anchored into the earth, shall be provided along the lot lines of each parking lot. The bumper shall be placed three (3) feet from the lot lines.

a. 
The operator of a parking lot shall keep the sidewalks surrounding the parking lot free from dirt, ice, sleet and snow, and shall keep the sidewalks in safe condition for the travel of pedestrians.
b. 
A parking lot shall be kept free from dust so that it does not become a nuisance to adjacent property owners or others.

Not more than one (1) building for the use of attendants for the operation of each parking lot is permitted. Such building shall be durable construction and the plans shall be approved by the Director of Public Works. On parking lots facing two (2) or more streets, one (1) additional building may be maintained.

The operator of a parking lot shall place shielded floodlights or other type of approved lighting in such location, and to such an extent as will permit owners of cars to have safe, lighted access to all portions of the lot during the hours of darkness. A certificate approving the lighting, installation, and service shall be obtained from the Director of Public Works. The operator of any parking lot which does not remain open after 4:00 p.m. need not comply with this subsection.

Each parking lot, as the City Engineer shall determine convenient for the public safety, shall have one (1) or more entrances and exits over the public sidewalks which may or may not be combined. Driveways shall not exceed eighteen (18) feet in width at the property line, and shall be at least twenty-five (25) feet from the curbline of any intersection street. All curbs shall be lowered to street level at driveway entrances.

A parking lot operated in conjunction with a garage or hotel shall be equipped with proper fire extinguishing apparatus, subject to the approval of the Fire Department, and all motor vehicles therein shall be so stored that they may be reached readily in case of fire or other emergency.

All parking lots hereinafter constructed within the City shall conform to the following specifications:
a. 
The sub-grade shall be properly graded and sloped so as to provide adequate stormwater drainage across the surface of the lot to the street. Drainage structures shall be utilized where found necessary by topographical conditions. After sub-grading has been completed, the entire area shall be thoroughly compacted with the minimum ten (10) ton roller in preparation for the base course material.
b. 
Upon completion of the sub-grading, the base course shall be installed consisting of four (4) inches of Type 2 Road Gravel or two (2) inches compacted bituminous stabilized base.
c. 
The top course shall consist of one and one-half (1 1/2) inch thick, compacted F.A.B.C. 1 bituminous concrete.
d. 
All materials and workmanship shall conform to New Jersey Highway Department Standard Specifications for Road Bridge Construction, latest edition.

At the time of accepting a motor vehicle for storage or parking in a parking lot, every person parking his/her motor vehicle shall be furnished a distinctive check which shall be numbered to correspond to a coupon placed upon such motor vehicle. The check shall contain the name and address of the parking lot.

The operator of a parking lot shall not make any charge for storage of a motor vehicle in excess of that set forth in his/her application for a license unless he/she has:
a. 
Notified the City Clerk in writing of the change at least forty-eight (48) hours before the effective date of the change, and
b. 
Posted signs showing such increase in the same manner as set forth in subsection 7-40.7.

a. 
The operation of a parking lot shall, within twenty-four (24) hours, giving necessary details, notify the Police Department of any claim made by reason of any loss, theft, or conversion occurring upon the premises.
b. 
The operator of a parking lot shall immediately notify the Police Department, giving the necessary details, when any automobile remains in his/her lot without explanation for a period longer than twenty-four (24) hours.

Any place, lot, parcel, yard or garage used in whole or in part for the storing or parking of three (3) or more motor vehicles, whether or not a storage or parking fee is charged therefor, and whether or not it is open to the general public shall be paved in accordance with subsection 7-40.14.

The purpose of this section is to establish rates, schedules and policies in the metered and time-limit parking areas specified herein, and to permit the Asbury Park Parking Utility to establish procedures to be implemented pursuant to these policies.

As used in this section:
BANGS AVENUE PARKING GARAGE
shall mean the City-controlled 75 parking spots located within the Bangs Avenue Garage (located at 605 Bangs Avenue) that will be available to the public for monthly residential permits on a first come first served basis, with Zone 4 residents who have no off-street parking option(s) available to them having right of first refusal.
CBD
shall mean the Central Business District Redevelopment Area, as designated and defined by the City.
CUSTOM CARD
shall mean a card that allows use for a certain period of time, and a certain number of uses. The user can park for the maximum parking duration (of up to 15 hours) for each use.
LPR (LICENSE PLATE RECOGNITION)
is an image-processing technology used to identify vehicles by their license plates.
NON-PEAK SEASON
shall mean the time period from September 16th to May 14th of each year.
PASS/PERMIT
shall mean prepaid parking via hang tags, stickers, Personal Identification Numbers (PINS), and/or Prepaid cards (Smart cards, Custom Cards and license plate recognition (LPR)).
PEAK SEASON
shall mean the time period from May 15th to September 15th of each year.
PERSONAL IDENTIFICATION NUMBER (PIN)
shall mean a unique number that is purchased in bulk (minimum of 10), and can be utilized in the same manner as a Custom card for single day or multi-day events.
SMART CARD
shall mean a prepaid parking card denoted by dollar value. A Smart Card does not have a use restriction, and can be reloaded at a machine.
WRA
shall mean the Waterfront Redevelopment Area, as previously designated and defined by the City.

The following regulations governing on-street metered parking, parking rates, time limits, and permit parking as set forth in the On-Street Metered Parking Schedule and the On-Street Metered Parking Rate Schedule are hereby approved and adopted for use within the City.

15-minute Parking.
All zones shall have 15-minute parking rates which shall be one-quarter of the 60-minute parking rate but never less than twenty-five cents per hour.

e. 
Handicapped Parking. For metered parking spaces that are used by vehicles displaying a handicapped placard or license plate, in compliance with N.J.S.A. 39:4-207, no penalty shall be imposed for the parking overtime of persons and/or vehicles covered by N.J.S.A. 39:4-207, so long as the maximum time shall have been purchased, and so long as said individual and/or vehicle shall have been parked in one location for not more than 24 hours. Handicapped designated parking spaces shall be free at all times for any motor vehicle which has displayed thereon a placard or wheelchair symbol license plates.

All permits are valid from the time of purchase through the end of the calendar year. The following fee schedule for residential and employee permits is hereby approved and adopted for use within the various zones of the City described above:
a. 
Fees for Residential Parking Permits.

Zones 1, 2, and 3: $90/year (Permit #1); $120/year (Permit #2); $150/year (Permit #3)*; and $180/year (Permit #4). . Annual permits purchased after September 1st are discounted 50%.

Zone 4 - -$90/year (Permit #1); $120/year (Permit #2). Annual permits purchased after September 1st are discounted 50%.
b. 
Fees for Employee Parking Permits:
1. 
5-day permit: $40/quarter; and
2. 
7-day permit: $60/quarter.
c. 
Residential Parking Permit Regulations.
Residential parking permits shall be limited to residents in Zones 1, 2, 3, and 4, as defined in section 7-41.5 and residents of streets with free on-street parking that are abutting two or more of the aforementioned zones, that meet the proof of residency requirements in section 7-41.5(d) and demonstrate lack of access to available off-street parking (garage, driveway, surface lot, or other off-street parking), subject to City verification through the City of Asbury Park Parking Office.
In circumstances where more than one resident driver with a vehicle provides proof of residency for the same dwelling unit, residential parking permits can be awarded to each additional resident driver with vehicle, subject to City verification. A maximum of four permits per dwelling unit may be issued for Zones 1, 2, and 3, assuming no off-street parking option is available to the dwelling unit. A maximum of two permits per dwelling unit may be issued for Zone 4, assuming no off-street parking option is available to the dwelling unit.
Access to off-street parking is defined as the ability to purchase, rent or otherwise utilize at least one off-street parking space associated with a specific dwelling unit or when a dwelling unit has a driveway, garage, or other off-street parking space. Dwelling units with access to at least one available off-street parking space. A garage shall be considered as one off-street parking space even if it is utilized as storage. Dwelling units with access to at least one available off-street parking space shall be handled in the following manner:

1. 
One vehicle must utilize the off-street parking option. If there is only one resident driver in a dwelling unit and off-street parking is available, the resident is not eligible for a residential parking permit.
2. 
Zone 1, 2, and 3: In circumstances where more than one resident driver with a vehicle provides proof of residency for the same dwelling unit, residential parking permits can be awarded to each additional resident driver with vehicle, subject to City verification. A maximum of three permits per dwelling unit may be issued, assuming that the first vehicle utilizes the off-street parking option.
3. 
Zone 4: In circumstances where more than one resident driver with a vehicle provides proof of residency for the same dwelling unit, a residential parking permit can be awarded to one additional resident driver with vehicle, subject to City verification. A maximum of one permit per dwelling unit may be issued, assuming that the first vehicle utilizes the off-street parking option.
Each residential parking permit shall have no more than three vehicle license plates registered to any one parking permit.
During the peak season (April 15th – October 15th), no more than one vehicle per permit may be parked on the street at any one time.
During the off-peak season (October 16th – April 14th), each vehicle assigned to a permit may be parked on the street without penalty
If there are extenuating circumstances, a resident may file a letter of appeal for review by the City Manager, Transportation Manager and/or Parking Committee.
d. 
Proof of Residency for Residential Parking Permits. Legal proof of residence or employment shall be required for all permits. For residential permits, applicants must provide the following documents for all resident drivers required in order to obtain a permit:
1. 
Proof of residency: Applicants must provide at least one of the following:
(a) 
Copy of the deed for the property showing the applicant's name.
(b) 
Copy of the most recent mortgage payment for the property at the same Asbury Park address in the applicant's name.
(c) 
Copy of the most recent tax or sewer bill issued by the City of Asbury Park for the same Asbury Park address in the applicant's name.
(d) 
Copy of the original lease or rental agreement showing the applicant's name as a current renter, signed by the applicant, valid for at least six (6) months from the time of application.
(e) 
Valid New Jersey driver's license with the same Asbury Park address on the license and one utility (gas or electric) or cable/internet bill issued in the past 90 days which indicates the applicant lives at the same Asbury Park address or one item of first-class mail received from any federal, state, or local government agency within the past six months for same legal residential Asbury Park address in the applicant's name.
(f) 
Copy of the certificate of occupancy issued by the City of Asbury Park listing the applicant as a resident at the same legal residential Asbury Park address and valid New Jersey driver's license with the same Asbury Park address on the license or one utility (gas or electric) or cable/internet bill issued in the past 90 days which indicates the applicant lives at the same Asbury Park address or one item of first-class mail received from any federal, state, or local government agency within the past six months for same legal residential Asbury Park address in the applicant's name.
(g) 
Two utility (gas or electric) or cable/internet bills issued in the past 90 days which indicates the applicant lives at the same Asbury Park address and a bank account in the applicant's name for the same Asbury Park address.
(h) 
Marriage license indicating the applicant is married to a resident of Asbury Park who has provided sufficient proof of residency outlined herein and one utility (gas or electric) or cable/internet bill issued in the past 90 days which indicates the applicant lives at the same Asbury Park address or a bank account in the applicant's name for the same Asbury Park address.
(i) 
Under rare, extenuating circumstances, other appropriate documentation sufficient for establishing residency of an individual may be permitted (upon approval of the City Manager or his designee).
2. 
Valid driver's license in the name of the applicant.
e. 
Employee Parking Permit Regulations. Employee parking permits shall be allowed in Zones 1, 2, 3, and 4 in designated areas and can be purchased quarterly. For employee permits, applicant must provide the following documents:
1. 
Proof of employment:
(a) 
Copy of Asbury Park mercantile license or state/federal tax forms with an Asbury Park address for the business (business owners); or
(b) 
Current pay statements (two) from an Asbury Park employer or a notarized statement from the Asbury Park employer (employees).
Business owners and employees purchasing employee parking permits on a monthly basis are required to provide updated proof of employment at each renewal of the permit. Business owners/employers may purchase parking permits on behalf of their employees and assign up to two (2) vehicles to each permit. A lease agreement for rented office or retail space may substitute proof of ownership of a commercial space for an Asbury Park business. Concessions provided by businesses for the City of Asbury Park may provide a copy of the concession agreement or contract with the City in order to obtain a parking permit.
2. 
Valid driver's license in the name of the applicant.
f. 
Vehicle Registration for Parking Permits. Legal proof of vehicle registration shall be required for all permits. For residential and employee permits, applicants must provide the following documents for all vehicles to be assigned to a parking permit:
1. 
Valid vehicle registration from the State of New Jersey in the name of the applicant. If the vehicle is not registered in the State of New Jersey and/or is not registered to the applicant, proof of insurance for the same vehicle with the applicant as named insured on the policy and a valid vehicle registration (any address, any state) may be provided to receive a permit. Proof of insurance may include an insurance card for the vehicle with the applicant's name or a declaration page from the insurance provider naming the applicant as a driver on the policy.
2. 
If the vehicle is registered as a company car, a notarized letter from the fleet manager, a current pay stub with the company's name and the name of the applicant, and a valid vehicle registration in the company's name may be provided to receive a permit.
3. 
If the vehicle is leased to the applicant, a valid vehicle registration in the applicant's name or the leasing company's name (with the applicant listed as a leasee), and proof of insurance with the applicant's name may be provided to receive a permit. Proof of insurance may include an insurance card for the vehicle with the applicant's name or a declaration page from the insurance provider naming the applicant as a driver on the policy.
4. 
If a resident or employee has a temporary vehicle while their primary vehicle is not in service, proof of possession of the temporary or rental vehicle may be provided in order to assign said vehicle to a permit. The primary vehicle will be unassigned from the permit while the primary vehicle is not in service.
g. 
Special Permits. The Asbury Park Board of Education shall be provided with no more than 50 special permits gratis per school year in order to accommodate faculty and staff parking along Summerfield Avenue.
h. 
Guest Permits. Residents of Asbury Park who live in regulated parking areas may purchase daily (twenty-four-hour) parking permits for their guests to park in the same regulated parking area (zone). However, guest permits are not permitted to park on Cookman Avenue or Ocean Avenue.
1. 
Guest permits shall be $10 per permit during the peak season and $5 per permit during the nonpeak/winter seasons.
2. 
Residents must either already possess a valid residential parking permit or shall provide proof of residency in accordance with the residential parking permit regulations herein in order to be eligible to purchase a guest permit. Guest permits will not be available for purchase via parking pay stations.
3. 
There is no limit on the number of guest passes that can be purchased per year; however, residents are limited to two guest passes per day.
i. 
Bangs Avenue Garage Parking Permit Regulations.
1. 
Parking permits for access to the Bangs Avenue Garage are available to Zone 4 residents only. Proof of residency, vehicle ownership, and off-street parking availability must be provided in accordance with the Resident Parking Permit Regulations above.
2. 
Permit holders will be assigned parking spaces and are only permitted to park in the assigned space.
3. 
A minimum of three (3) months payment is required to obtain a Bangs Avenue Garage permit. Payments are made on a quarterly basis as follows: Quarter 1 - January 1st - March 31st, Quarter 2 - April 1st-June 30th, Quarter 3 - July 1st-September 30th, Quarter 4 - October 1st-December 31st. Payments can also be made for the calendar year. Permits must be renewed at least 5 days prior to the expiration date.
4. 
Vehicles must be parked head-in only. Vehicles backing in to parking spaces may be subject to penalty.
5. 
If a permit holder causes property damage to the garage or access gates, the permit holder is responsible for the cost of the damage, and access to the parking garage may be revoked.
6. 
Access to the garage, through use of the access card, may not be transferred to, or used by, any individual other than the individual that the permit is assigned to, nor used to park any other vehicle other than the one (1) vehicle assigned to the parking permit. Failure to comply may result in revocation of the Bangs Avenue Garage permit without refund, as well as denial of future permit access privileges.
j. 
Commercial Vehicle Parking Permit Regulations.

1. 
Vehicles designated for commercial use that are under 6,000 lbs and under 19 feet in length must have a valid Commercial Vehicle Permit to park on any and all roadways between the hours of 8:00 p.m. and 6:00 a.m. within the City of Asbury Park.
2. 
This permit will be issued on an annual basis and does not permit commercial vehicles to park in metered or permit parking zones without purchasing parking.
3. 
The number of permitted commercial vehicles to be parked on the street is limited to one per residence or Postal Address.
4. 
Applicants must provide proof of vehicle registration in accordance with paragraph f above. If unable, the applicant may provide a notarized letter from the commercial business in ownership of the vehicle identifying them as the driver of the vehicle.
5. 
Applicant must provide a valid driver’s license and proof of residency in accordance with paragraph d above.
6. 
Commercial Vehicle Permits will be available for $25 (not pro-rated).

The following general regulations shall be applicable within the City:
a. 
Amendments to Rates.
The Governing Body shall be authorized to temporarily amend the parking rates set forth herein through the adoption of a Resolution for years 2016 and later. Said amendments may be based upon the results of the demand pricing model or as otherwise needed.
b. 
Suspension of Metered Parking; Holidays, Approval by City.
Metered parking shall be suspended on the following holidays:
1. 
New Year's Day;
2. 
Veteran's Day;
3. 
Thanksgiving Day;
4. 
Christmas Day; and
5. 
Other dates/time periods as approved by the City Council by Resolution.

The following additional fees and policies are hereby established:
a. 
Discounted Bulk Parking.
The City of Asbury Park offers the following discount on the purchase of bulk parking to encourage use of the mobile application.
1. 
Fifty dollars ($50) worth of parking for forty-five dollars ($45).
2. 
Seventy-five dollars ($75) worth of parking for sixty-five dollars ($65).
3. 
One hundred dollars ($100) worth of parking for eighty-five ($85).
4. 
Two hundred dollars ($200) worth of parking for One hundred seventy dollars ($170)
b. 
All event parking is and will continue to be handled through the Special Events Committee.
c. 
Permit Replacement Fees
Permits, in the form of hang tags, stickers, access cards or other physical medium, may be replaced if damaged or not functional, or if a new vehicle is registered, for a fee of $5 as long as the original permit is returned to the Parking Utility.
Permits, in the form of hang tags, stickers, access cards or other physical medium, may be replaced if lost or stolen at the full cost of the permit. Access cards to the Bangs Avenue Garage, if lost, substantially damaged, or stolen, may be replaced for $25. A late fee of $25 shall be assessed for late quarterly payments for the Bangs Avenue Garage.

Any person who violates any provision of this section shall, upon conviction, be liable to the following penalties:
a. 
For time limit and expired metered parking for areas not covered in Subsection (b) below: $50.
b. 
For expired metered parking in fifteen-minute zones: $55.
c. 
For parking in permit-only designated spaces without a permit: $100.
d. 
For parking in the Bangs Avenue Garage outside of operating hours without a Bangs Avenue Garage Parking Permit $75.
e. 
For any other violations, the penalties shall be as prescribed in Chapter 1, Section 1-5 of the City Code, or by applicable State Statute.

The Asbury Park Parking Utility ("APPU"), under the supervision of the City Manager and his/her designee(s), is hereby authorized and directed to install appropriate signage, and to issue appropriate instructions, vehicle identification stickers/decals and smart cards, and to perform all other necessary actions, in order to effectuate the intentions of this section, as outlined in the Operations Manual of the APPU.

The City Manager and his/her designee(s) is hereby authorized to develop and implement guidelines concerning operational enforcement and related issues, in accordance with the policies set forth in this section. Such guidelines may include the establishment of advertising rates on the meters and establishment of various zones.

In accordance with the provisions of this section, no person shall park or stand any vehicle upon any streets or parts thereof in deference to an emergent or temporary regulation as posted.
a. 
Upon declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergent conditions exist with respect to highway and road conditions, weather, accidents, fires or public celebrations which dictate or require the avoidance of hazards or other conditions which interfere with the flow of traffic or safety and welfare of the general public.
b. 
The herein listed personnel are hereby authorized and empowered to declare an emergency and direct the posting of emergency no parking signs: the City Manager (or designee), Police Chief (or highest ranking Officer), Fire Chief and the Director of the Department of Public Works.
c. 
It shall be deemed to be reasonable notification to vehicles parked within the locations of the emergent condition by the posting of emergency/temporary regulation signs.
d. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and hazard, and any police officer may provide for the removal of said vehicle. The owner of the vehicle shall pay the costs for the removal and storage which may result from such removal before regaining possession of the vehicle.
e. 
Any owner or other person legally entitled to the return of any vehicle removed by the Police Department shall be required to pay, in addition to the full amount of fees chargeable for towing and storing of said vehicle, any fines, interest, penalties and costs that may be imposed under the terms of N.J.S.A. 39:4-139.13a through d and the terms of this chapter.
f. 
The amount of any unpaid fees, the payment of which is required hereunder, shall constitute a debt due to the City of Asbury Park and shall be collectible in the manner provided by law in a court of competent jurisdiction.
g. 
Any member of the Police Department may cause the immobilization or impoundment of such a vehicle found within the jurisdiction of the City of Asbury Park, if there are any outstanding warrants against such vehicle.

Parking spaces may be reserved for commercial vehicles involved in moving, special events or large deliveries, or for construction purposes on a temporary basis. Personal uses are not allowed for temporary reservation. Temporary reservations will be enforced with cones, temporary no parking signs, or other methods as deemed suitable by the City Manager (or designee), Police Department or the Parking Utility.
a. 
Fees.
Temporary reservation of parking spaces can be purchased in 4, 8, 12 and 24-hour increments for commercial vehicles and daily for construction purposes in accordance with the following pricing (per space):

b. 
Time Limits.
Temporary reservation of a parking space for non-construction purposes may not exceed twenty-four (24) hours, unless approved by resolution of the City Council.
c. 
Other Regulations.
1. 
Signs will be posted no less than 48 hours prior to the event.

2. 
All reservations must be received a minimum of five (5) business days prior to the effective date. Reservations submitted less than five (5) business days prior to the event start date are subject to an expedited fee of twenty-five ($25) dollars.
3. 
If the location of the address requested to be reserved is a non-metered space but is not a legal parking space (such as driveway, fire hydrant, within twenty-five (25) feet from a crosswalk or intersection, or handicapped space), Parking Utility officers will post signs at the closest location at their discretion.
4. 
Temporary reservation of parking spaces does not recuse vehicles from observation of street cleaning/alternate side of the street parking regulations.
5. 
Temporary reservation of parking spaces for City construction in the public right-of-way are at no charge.
6. 
The approval of special event functions may result in an altered parking fee per space subject to review by the Special Events Committee in accordance with § 4-10.4 of the City Code. The parking fee per space to be paid will be the higher of the two (2) fees.

As used in this section, the following terms shall have the meanings indicated:
AC
Alternating current (electricity).
BATTERY
A cell or cells onboard an electric vehicle which is used for storing and furnishing electrical energy for the purpose of propelling the vehicle.
BATTERY ELECTRIC VEHICLE (BEV)
An electric vehicle with an onboard battery that operates exclusively on electrical energy from the battery, which battery is charged from an electrical power source (charging station) not onboard. the vehicle.
CAR SHARE VEHICLE
A vehicle that is operated as part of a regional fleet by a public or private car sharing company or organization and provides hourly or daily service for the purposes of sharing amongst residents, visitors, and businesses.
CHARGING LEVEL
The standardized indicators of electrical force or voltage at which an electric vehicle's battery is recharged. Typical electric vehicle charging levels and specifications are:
a. 
Level 1-AC slow battery charging. Voltage is 120 volts.
b. 
Level 2-AC medium battery charging. Voltage is between 120 volts and 240 volts.
c. 
Level 3-DC fast or quick battery charging. Voltage is greater than 240 volts. This is often referred to as "DC fast" charging.
CHARGING STATION
Equipment that has as its primary purpose the transfer of electric energy by conducive or inductive means to a battery or other energy storage device located onboard an electric vehicle. Various type of charging stations include:
a. 
Accessible charging station: A charging station incorporated into or immediately adjacent to a handicapped parking space as "handicapped parking space" is defined by the New Jersey State Statutes.
b. 
Level 3 charging station (sometimes "DC fast charging station"): A charging station that provides any single-phase voltage or current rating higher than that of Level 2 or any three-phase supply voltage configuration.
c. 
Private charging station: A charging station that is (a) privately owned and restricted access or (b) publicly owned and restricted.
d. 
Public charging station: A charging station that is (a) publicly owned and publicly available or (b) privately owned and publicly available.
CHARGING STATION EQUIPMENT
The conductors, including ungrounded and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging stations or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicles.
CHARGING STATION PLACE
A dedicated, marked space that identifies the use thereof as exclusively for the charging of electric vehicles.
CITY CAR SHARE PROGRAM
A program under which the City designates on-street parking spaces or spaces in off-street public parking facilities for the exclusive use of car share vehicles for the purposes of sharing amongst residents, visitors, and businesses.
ELECTRIC SCOOTERS AND/OR MOTORCYCLES
A two-wheel or three- wheel electric vehicle that operates exclusively on electrical energy stored in the vehicle's batteries.
ELECTRIC VEHICLE
A vehicle that operates, either partially or exclusively, on electrical energy from a charging station or other electrical energy source that is stored in the vehicle's battery for propulsion purposes. "Electric vehicle" includes: (1) a battery electric vehicle; (2) a plug-in hybrid electric vehicle; (3) a neighborhood electric vehicle; and (4) electric scooters or motorcycles.
NEIGHBORHOOD ELECTRIC VEHICLE
An electric vehicle with four wheels that conforms to federal regulations under Title 49 CFR Part 571.5000 which can from a standstill attain a speed of 20 miles per hour (mph) within one mile but cannot exceed a speed of more than 25 mph.
NON-ELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE (PHEV)
An electric vehicle that (1) contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor; and (2) charges its battery primarily by connecting to a charging station or other electrical source not on board the vehicle; (3) may additionally be able to sustain a battery charge using an on-board internal-combustion-driven generator; and (4) has the ability to be propelled through the use of electricity.
VEHICLE
Has the same meaning as provided in the New Jersey State Statute, Title 39, Motor vehicles and traffic regulations, Chapter 1, Definitions, 39.1.1., Words and phrases defined.

a. 
Notification and Signage.
1. 
At the direction of the City Manager or designee, appropriate signs and markings shall be placed on or near electric vehicle charging stations, indicating prominently thereon the parking regulations. The signs may identify the voltage and amperage levels; define time limits, fees, and hours of operation, as applicable; and state that the charging station space is reserved for charging purposes only, which is to be defined as occurring when a vehicle is connected to the EVSE for electric charging purposes. The signs may also identify the charging station space is reserved for the City car share program or car share vehicles only.
2. 
Signage for charging station spaces reserved for charging or City car sharing purposes shall clearly and conspicuously states the following: "Unauthorized vehicles not connected for electric charging [or for City car share] purposes may be towed away at owner's expense. Towed vehicles may be reclaimed at designated towing facility or by calling the Asbury Park Police Department - 732-774-1300."
3. 
Parking signage related to electric vehicle parking and charging stations in public parking facilities or on public streets shall accurately reflect the City Code provisions as applied to days and times of parking enforcement under this chapter. If there is a conflict between on-street parking signage and associated electric vehicle parking spaces and charging stations with respect to days, hours of enforcement, and/or maximum parking times, the information contained in the parking signage shall apply.
b. 
Prohibitions.
1. 
When a sign authorized under Subsection a above provides notice that a space is designated as electric vehicle parking or an electric vehicle charging station, no person shall stop, stand, or park any nonelectric vehicle, or otherwise block access to parking, in any such designated parking space or charging station.
2. 
When a sign authorized under Subsection a above provides notice that a space is designated as electric vehicle charging station, it is unlawful to park or permit to be parked any vehicle, including an electric vehicle, if such electric vehicle is not in the process of charging. Only one electric vehicle shall occupy any space marked as an electric vehicle parking space or charging station, and no person shall park except within the boundaries of the space defined.
3. 
When a sign authorized under Subsection a above provides notice that a space is designated as a car share vehicle parking space, no person shall stop, stand, or park any vehicle, or otherwise block access to parking, in any such designated parking space or charging station, except for an authorized car share vehicle.
c. 
Enforcement.
1. 
Electric vehicle parking spaces and charging stations shall be enforced by any police officer or parking enforcement officer.
2. 
Violations of this section shall be punishable by a fine of $50 Each day such violation is committed shall constitute a separate offense and shall be punishable as such.
3. 
In addition to a fine, a person who has parked or left a vehicle standing upon a street, alley, or city parking lot or garage in violation of this section is subject to having the vehicle removed from the street, alley or City parking lot or garage.

No person shall park a vehicle upon any of the streets or parts thereof listed below except an electric or hybrid plug-in vehicle.
