There is hereby created in and for the Borough of Island Heights a Police Department which shall consist of such full-time and/or part-time members and officers as shall be deemed necessary by the Mayor and Borough Council which shall, from time to time, determine the number of persons, including temporary officers and members in an emergency to be appointed to these positions together with their compensation.

The Police Department shall: Preserve the public peace, protect life and property; detect, arrest and prosecute offenders of the laws of New Jersey and the Ordinances of the Borough of Island Heights; direct and control traffic; provide attendance and protection during emergencies; provide appearances in court; cooperate with all other law enforcement agencies, and provide training for the efficiency of its members and officers.

The Mayor and Borough Council shall be designated as the Appropriate Authority as provided in the New Jersey Statutes. The Mayor and Borough Council shall be responsible for the overall performance of the Police Department and shall adopt and promulgate Rules and Regulations for the government of the Police Department and for the discipline of its members.

A Superior Officer of the Police Department designated by the Mayor and Borough Council shall be the head of the Police Department and shall be directly responsible to the Mayor and Borough Council for its efficiency and day-to-day operations. Pursuant to policies established by the Mayor and Borough Council, the Superior Officer shall:
Administer and enforce the Rules and Regulations of the Police Department and any special emergency directive for the disposition and discipline of the Department and its members and officers;
Have, exercise, and discharge the functions, powers and duties of the Police Department;
Delegate such authority as may be deemed necessary for the efficient operation of the Police Department to be exercised under the Superior Officer's direction and control; and
Report at least monthly to the Mayor and Borough Council in such form as shall be prescribed on the operation of the Police Department during the preceding month and make such other reports as may be requested by the Mayor and Borough.

No person shall be appointed to the Police Department who is not qualified as provided in the New Jersey Statutes. The Mayor and Borough Council may also require that an applicant for appointment to the Police Department shall successfully complete a physical, mental, and psychological examination.

No member or officer of the Police Department shall be suspended, removed, fined or reduced in rank for any cause other than for incapacity, misconduct or disobedience as provided in the New Jersey Statutes and the Police Department's Rules and Regulations, or as otherwise provided for in New Jersey Statutes.

The Mayor and Borough Council may appoint from time to time Special Law Enforcement Officers in accordance with New Jersey Statutes for terms not exceeding one (1) year. They shall possess and exercise all the powers and duties provided by the Statutes during their term in office, but shall not be continued as regular members of the Police Department and shall not be entitled to tenure. The Mayor and Borough Council may authorize Special Law Enforcement Officers when on duty to exercise the same powers and authority as regular members of the Police Department including the carrying of firearms and the power of arrest.

The Island Heights Volunteer Fire Company No. 1 of Island Heights Borough has offered its services to the Governing Body as an independent fire company with its apparatus. The services of the company are hereby accepted.

Fire Company No. 1 shall be under the charge of the Governing Body.

Island Heights Volunteer Fire Company No. 1 shall not take its apparatus out of the Borough without securing permission from the Governing Body.

The Chief of the Company shall make a report in writing by January 31 of each year. The writing shall be an annual report of the Company's activities and the condition of its equipment.

a. 
Program Created. A Length of Service Awards Program (LOSAP) is hereby created in accordance with Chapter 388 of the Laws of 1997, to reward members of the volunteer Fire Department and First Aid Squad for their loyal, diligent, and devoted services to the residents of the Borough of Island Heights.
b. 
The LOSAP shall provide for fixed annual contributions to a deferred income account for each volunteer member that meets the criteria set forth below; that such contributions shall be made in accordance with a plan that shall be established by the Borough of Island Heights pursuant to P.L. 1997, c. 388 and that such plan shall be administered in accordance with the laws of the State of New Jersey, the U.S. Internal Revenue Code, and this ordinance.
c. 
The LOSAP shall provide for an annual contribution of $1,150 to each eligible member of the Island Heights Volunteer Fire Company and First Aid Squad who accumulates a minimum of 150 and respectively 125 service points per year, which shall be awarded pursuant to the criteria set forth in attached Exhibit A and Exhibit B.[1]

The estimated cost of the program for the regular annual services has been calculated to be $39,100 per year.
