The Mayor shall be the chief executive and administrative officer
of the municipality. He shall:
A. Enforce the charter and ordinances of the municipality.
B. Supervise all departments and employees and all property and equipment
of the municipal government.
C. Require each department to make an annual and such other reports
of its work as he may deem desirable.
D. Appoint all officers and employees for whose election or appointment
no other provision is made by charter or ordinance.
E. From time to time make such recommendations for action by the Council
as he may deem in the public interest.
F. Report, annually, at the beginning of the year, to the Council and
the public on the work of the previous year and the conditions and
requirements of the municipal government for the current year.
G. Have such other functions, powers and duties as are provided by the
charter and Code.

In accordance with N.J.S.A. 10:5-10, the Mayor may appoint members
of the Human Relations Council consisting of 13 citizen members who
shall serve without compensation. One of the members shall be a member
of the East Brunswick Board of Education, to be selected by the President
of the East Brunswick Board of Education and shall serve for a term
of 1 year. This member may be appointed as long as he/she remains
a member of the East Brunswick Board of Education. As a member, this
representative has full voting rights. The Human Relations Council
shall attempt to foster through community effort or otherwise, good
will, cooperation and conciliation among the groups and elements of
the inhabitants of the community. The Human Relations Council is hereby
empowered to make recommendations to the Township Council for the
development of policies and procedures in general and for programs
of formal and informal education that will aid in eliminating all
types of discrimination based on race, creed, color, national origin,
ancestry, age, marital status, affectional or sexual orientation or
sex. Three of the first appointees shall serve for a term of 3 years,
two of the first appointees shall serve for a term of 2 years and
two of the first appointees shall serve for a term of 1 year. Thereafter,
all appointments shall be made for 3 years. All new appointments shall
first be approved by a majority of Human Relations Council members
before final Mayoral appointment. If a vacancy occurs in the middle
of a term, it shall be filled by the Mayor with the approval of a
majority of Human Relations Council members to complete the unexpired
portion of the remaining term.

The Mayor shall designate the Administrator, any other department
head or the Clerk to act as Mayor whenever the Mayor shall be prevented
by absence from the municipality, disability or other cause from attending
to the duties of his office. During such time the person so designated
by the Mayor shall possess all the rights, powers and duties of the
Mayor. Whenever the Mayor shall have been unable to attend to the
duties of his office for a period of sixty (60) consecutive days for
any of the above-stated reasons, an Acting Mayor shall be appointed
by the Council, who shall succeed to all rights, powers and duties
of the Mayor or the then Acting Mayor.
Whenever a vacancy exists in any office required by the charter
or Code to be filled by the Mayor with the advice and consent of the
Council and there is no holdover incumbent, the Mayor may temporarily
fill such vacancy, in the absence of any contrary provision in the
charter or ordinances, by appointing an acting officer, including
the designation of himself as Acting Business Administrator in the
event of a vacancy in that office. Such appointee shall have all of
the functions, powers and duties of the office until it shall be filled
permanently. Any such appointment shall terminate not later than forty-five
(45) days after the date of the appointment, unless the Council shall
by resolution authorize one or more extensions of such period.
Each department head shall:
A. Appoint and, with the approval of the Mayor, remove or suspend subordinate officers and employees within his department subject to the provisions of Chapter
28 of the Code of the Township of East Brunswick.
B. Direct and supervise the work of the department and its employees.
C. Assign functions, powers and duties to subordinate officers and employees
within the department and modify such assignments, as need appears.
D. Delegate to division heads such of his powers as he may deem necessary
for efficient administration.
E. Adopt rules and regulations pertaining to his department. No rule
or regulation made by any department shall, except upon written approval
of the Mayor, take effect until at least 10 days after it is filed
with the Township Clerk as required by the charter. This limitation
of time shall not apply, however, to any order, rule or regulation
which relates solely to the organization or internal management of
the municipal government or a part thereof. The Clerk shall maintain
a docket of all orders, rules and regulations filed in his office,
which docket shall show the name of the issuing department, a brief
description of the subject matter and the date of filing. In the case
of personnel rules and regulations, a written copy of the rules and
regulations shall be distributed to the personnel of the department
affected thereby and shall be posted in the office of the department
director. Copies shall also be available to personnel of the department
upon request.
F. Report at least annually to the Mayor and Council in such form as
shall be approved by the Administrator on the work of the department
during the preceding year.
