The City Attorney shall be the legal advisor to the Mayor and all departments except as may be otherwise provided by the Charter. He shall prosecute and defend actions and proceedings by and against the City and every department thereof. In furtherance of these general powers, and without limitation thereto, he shall:
A. 
Advise the Mayor as to the form and sufficiency of all ordinances and resolutions prior to their passage.
B. 
Review and approve all contracts, deeds, documents and instruments prior to the execution thereof by or on behalf of the City.
C. 
Conduct appeals from orders, decisions or judgments affecting any interest of the City as he may, in his discretion, determine to be necessary or desirable, or as directed by the Mayor.
D. 
Subject to the approval of the Council, have the power to enter into any agreement, compromise or settlement of any litigation in which the City is involved. However, cases can be settled without prior City Council approval for an amount that does not exceed a maximum dollar amount established annually by resolution of the City Council.
E. 
Render opinions, in writing, upon any question of law submitted to him by the Mayor, City Council, Business Administrator or the head of any department with respect to his/her official powers and duties.
F. 
Maintain a record of all actions, suits, proceedings and matters which relate to the City's interest and report thereon from time to time as the Mayor may require.
G. 
Conduct, when requested by the Judge of the Municipal Court of the City of Orange Township, prosecutions for crimes and offenses recognizable by the Municipal Court, except such crimes and offenses as it may be the duty of the County Prosecutor to prosecute, including violations of ordinances of the City of Orange Township, complaints of any department under state law, and violations of rules and regulations duly promulgated by the Charter or ordinance.
H. 
Conduct labor negotiations and advise on civil service laws and procedures.
I. 
Have such other duties and different functions, powers and duties as may be provided by the Charter or ordinance.
The City Attorney shall be appointed by the Mayor, with the advice and consent of the Council, to serve for one (1) year and until the qualification and appointment of a successor.

A. 
The City Attorney shall devote not less than thirty-five (35) hours per week of his time to city business. Should he be inaccessible during normal working hours (Monday through Friday), he shall designate a member of his law firm to act as his surrogate. The City Attorney shall be paid in accordance with the maximum salary listed in Ordinance No. 6-87, and is not subject to overtime for any work performed in connection with city business.
B. 
Assistant City Attorneys shall devote a minimum of twenty-one (21) hours per week to city business. Assistant City Attorneys shall be paid in accordance with Salary Ordinance No. 6-87, and may, with prior approval of the City Attorney, Business Administrator and Mayor, submit itemized bills for additional work performed on behalf of the City of Orange Township.
