Editor's Note: This Chapter is now covered by the Development Code (see Section 400.530), which prohibits mobile homes in the City except for those mobile home parks already existing in the City which have been grandfathered until they no longer exist. This Chapter is retained until further action by the Board to remove or revise these provisions.

A. 
It shall be unlawful for any person to construct, alter or extend a mobile home park within the City limits of Cuba, Missouri, unless he/she holds a valid permit issued by the City Clerk in the name of such person for the specific construction, alteration or extension proposed.
1. 
Application For Permit.
a. 
Before any mobile home park may be constructed, altered or extended within the City limits, a permit must first be obtained from the City Clerk. In order to obtain the required permit, a completed application for such permit must be made with the City Clerk, and a majority of property owners adjoining the area within three hundred (300) feet of the proposed mobile home park construction, alteration or extension must have given their written consent to such. The submission of a park plan as set forth in Section 615.020(B), will also be required upon application for a permit.
b. 
All applications for permits shall be subject to the General Requirements and Evaluation Procedures contained in Section 615.020(C), (D), (F), and (G), and shall contain the following information:
(1) 
Full name, complete address and telephone number of applicant;
(2) 
Location and legal description of the mobile home park;
(3) 
Complete engineering plans and specifications of the proposed park including, but not limited to, the following:
(a) 
The area and dimensions of the tract of land;
(b) 
The number, location, and size of all lots;
(c) 
The location of service buildings and any other proposed structures;
(d) 
The location and width of roadways and walkways;
(e) 
The location of water and sewer lines and riser pipes;
(f) 
Plans and specifications of the water supply, refuse and sewage disposal facilities;
(g) 
Plans and specifications of all buildings constructed or to be constructed within the mobile home parks; and
(h) 
The location and details of lighting and electrical systems.
2. 
Fee. All applications shall be accompanied by an inspection fee of fifteen dollars ($15.00) plus one dollars ($1.00) for each lot constructed, altered or extended, not to exceed fifty dollars ($50.00).

A. 
It shall be unlawful for any person to operate any mobile home park within the City limits of Cuba, Missouri, unless he/she holds a valid business license issued by the City Collector, and renewed annually by the purchase of a business license, in the name of such person for the specific purpose of operating a mobile home park.
B. 
All mobile homes hereafter situated within the City limits of Cuba, Missouri, must be placed within a mobile home park specifically established for the purpose of housing mobile homes unless such mobile home conforms with the City's existing zoning ordinances. Such accommodations shall be subject to the following requirements and regulations:
1. 
Application For License.
a. 
Before any mobile home park may be operated within the City limits, a mobile home park license must first be obtained from the City Clerk. To obtain the required license, a completed application for such license must be made with the City Clerk who shall issue a license upon compliance by the applicant with all applicable provisions of this Chapter.
b. 
The submission of a park plan as set forth in Section 615.020(B), shall also be required upon making application.
(1) 
The license application may be obtained from the office of the City Clerk and shall include the following information:
(a) 
The full name, complete address and telephone number of the applicant;
(b) 
The location and legal description of the mobile home park;
(c) 
A complete plan of the park detailing lot locations and lot sizes;
(d) 
Plans and specifications of all buildings and other improvements constructed within the mobile home park;
(e) 
Such further information as may be requested either by the Board of Aldermen or Commission to enable it to determine if the mobile home park will comply with all legal requirements.
2. 
The Park Plan.
a. 
Upon making application for a mobile home park license or a permit for construction, alteration or extension of a mobile home park, the applicant must submit three (3) completed sets of park plan drawings of the existing or proposed park to the City Clerk. The park plan will consist of two (2) separate scale drawings and shall include:
(1) 
A scale drawing illustrating the size, position and location of each rental space, parking spaces, sidewalks, recreation area, buildings and other improvements; and
(2) 
A scale drawing detailing the distribution of all water, sewage, gas, telephone and electrical plant facilities within the mobile home park.
b. 
The proposed park plan for construction, alteration, or extension will be prepared in conjunction with the minimum standards for the location and construction of the mobile home park as set forth in Section 615.030 of this Chapter.
3. 
Evaluation Of Application. Upon completion of the application process, the Planning Commission (hereinafter referred to as the "Commission"), will review the application for the license. A thorough physical inspection of any area to be converted into a mobile home park will be conducted by the Commission or its assigned agent or agents. Based upon the foregoing requirements and the Commission's evaluation, the Commission shall submit its written recommendation to the Board of Aldermen to be voted upon.
4. 
Board Of Aldermen Approval. If the Board of Aldermen approves the license application for the mobile home park by a majority vote, the license shall be issued by the City Clerk. If the Board of Aldermen rejects the license application, the decision may be appealed to the City's board of adjustment and said appeal shall be governed by Sections 400.1490 et seq. of the Cuba City Code.
5. 
Annual Renewal. The Mobile Home Park Licenses, once issued, are renewable on an annual basis by applying for a business license pursuant to the provisions of Chapter 605 of the Cuba City Code. The operator of the mobile home park must apply for a business license on the issuance date which is closest to the anniversary date of the initial issuance of the mobile home park license.
6. 
Inspections. The Commission shall have the power to enter at reasonable times upon any private or public property for the purpose of inspecting and investigating conditions relating to the enforcement of this Chapter. Such inspection may be conducted by the Commission or its assigned agent or agents.
7. 
Transfer Or Sale Of Mobile Home Park. Any person receiving ownership of a mobile home park shall, within two (2) working days after receiving said interest and/or control of the mobile home park apply for a business license pursuant to Chapter 605 of the Cuba City Code.

A. 
The Board of Aldermen of the City of Cuba, Missouri, hereby declares that: The mobile home parks existing within the City at the time of the passage of this Chapter were constructed without notice of restraint. To give fair recognition of the difference in class between mobile home parks existing at the time of the enactment of this Chapter and mobile home parks hereinafter built, it is hereby declared a policy of the Board of Aldermen of the City of Cuba, and hereby enacted, that there will be no change of mobile home parks now existing in its entirety.
B. 
Mobile Home Stands. The area of the manufactured or mobile home stand shall be improved to provide an adequate foundation for the placement and tie-down of the manufactured or mobile home, thereby securing the superstructure against uplift, sliding, rotation, and overturning. The placement and tie-down of all manufactured or mobile homes within the City shall comply with Chapter 700 of the Revised Statutes of Missouri and with any amendments to said Chapter which may be made by the Legislature in the future.
1. 
The manufactured or mobile home stand shall not heave, shift or settle unevenly under the weight of the manufactured or mobile home due to frost action, inadequate drainage, vibration or other forces acting on the superstructure.
2. 
The manufactured or mobile home stand shall be provided with anchors and tie-downs such as cast-in-place concrete "dead men," eyelets imbedded in concrete foundations or runways, screw augers, arrowhead anchors, or other devices securing the stability of the manufactured or mobile home.
3. 
Anchors and tie-downs shall be placed at least at each corner of the manufactured or mobile home stand and each shall be able to sustain a minimum tensile strength of two thousand eight hundred (2,800) pounds.
C. 
Fire Protection.
1. 
Mobile home parks shall be subject to the rules and regulations of the City of Cuba fire prevention authority.
2. 
Mobile home parks shall be kept free of litter, rubbish and other flammable materials.
3. 
Access to a mobile home for fire protection services shall be such as to permit fire apparatus to approach within one hundred (100) feet of each mobile home.
D. 
Park Area For Nonresident Uses. No part of any park shall be used for nonresidential purposes, except such uses that are required for the direct servicing and well-being of park residents and for the management and maintenance of the park, except for the display of mobile homes for sale.
E. 
Required Separation Between Mobile Homes.
1. 
Mobile homes shall be separated from each other and from other buildings and structures by at least twenty (20) feet; provided, that mobile homes placed end to end may have a clearance of fifteen (15) feet where opposing rear walls are staggered.
2. 
An accessory structure which has a horizontal area exceeding twenty-five (25) square feet is attached to a mobile home and has an opaque top or roof that is higher than the nearest window shall, for purposes of all separation requirements, be considered to be part of the mobile home.
F. 
Mobile Home Required Set Backs, Buffer Strips And Screening.
1. 
All mobile homes shall be located at least twenty-five (25) feet from any park property boundary line abutting upon a public street or highway.
2. 
There shall be a minimum distance of four (4) feet between an individual mobile home and adjoining pavement of a park street, or common parking area or other common street.
3. 
Each lot provided for occupancy of a single mobile home unit shall have an area of not less than two thousand one hundred (2,100) square feet and a width of not less than thirty-five (35) feet, and no park shall be permitted an average density of mobile home lots of more than eight (8) lots per acre.
4. 
All mobile home parks shall provide lots sufficient in size that no mobile home or any structure, addition, or appurtenance thereto is located within four (4) feet from the nearest adjacent lot boundary.
5. 
Every building in a mobile home park shall be designed and constructed in accordance with municipal building codes.
6. 
Space between mobile homes may be used for the parking of motor vehicles if the space is clearly designated and the vehicle is parked t least ten (10) feet from the nearest adjacent lot boundary.
7. 
Insect And Rodent Control.
a. 
Grounds, buildings, and structures shall be maintained free of insect and rodent harborage and infestation. Extermination methods and other measures to control insects and rats shall conform with the requirements of the municipality.
b. 
Parking areas shall be maintained free of accumulations of debris which may provide rodent harborage or breeding places for flies, mosquitoes, and other pests.
c. 
Storage areas shall be so maintained as to prevent rodent harborage; and all lumber, pipe, and other building material shall be stored at least one (1) foot above the ground.
d. 
Where the potential for insect and rodent infestation exists, all exterior openings in or beneath any structure shall be appropriately screened with wire mesh or other suitable materials.
e. 
The growth of brush, weeds and grass shall be controlled to prevent harborage of ticks, chiggers and other noxious insects. Parking areas shall be so maintained as to prevent the growth of ragweed, poison ivy, poison oak, poison sumac and other noxious weeds considered detrimental to health. Open areas shall be maintained free of heavy undergrowth of any description.
G. 
Liquefied Petroleum Gas Systems.
1. 
Liquefied petroleum gas systems shall be installed and maintained in accordance with applicable codes and regulations governing such systems.
2. 
Systems shall be provided with safety devices to relieve excessive pressures and shall be arranged so that the discharge terminates at a safe location.
3. 
Systems shall have at least one (1) accessible means for shutting off gas. Such means shall not be located under a mobile home and shall be maintained in effective operating condition.
4. 
All liquefied petroleum gas piping outside of the mobile homes shall be well supported and protected against mechanical injury. Undiluted liquefied petroleum gas in liquid form shall not be conveyed through piping equipment and systems in mobile homes.
5. 
Liquefied petroleum gas containers installed on a mobile home lot shall be securely but not permanently fastened to prevent accidental overturning. Such containers shall have a minimum capacity equal to twenty percent (20%) of the average annual fuel consumption.
6. 
No liquefied petroleum gas vessel shall be stored or located inside or beneath any storage cabinet, carport, mobile home, or any other structure.
H. 
Fuel Oil Supply System.
1. 
All fuel oil supply systems shall be installed and maintained in accordance with applicable codes and regulations governing such systems.
2. 
All piping from outside fuel storage tanks or cylinders to mobile homes shall be permanently installed and securely fastened in place.
3. 
All fuel oil storage tanks or cylinders shall be securely fastened in place and shall not be located inside or beneath any mobile home or less than five (5) feet from any mobile home exit.
I. 
Responsibilities Of Park Occupants.
1. 
The park occupants shall comply with all applicable requirements of this Chapter and shall maintain their mobile home lot, its facilities and equipment in good repair and in a clean and sanitary condition.
2. 
The park occupants shall be responsible for proper placement of their mobile home on its stand and proper installation of all utility connections in accordance with the instructions of the park management.
3. 
Pets, if permitted in the park, shall be prohibited from running at large or committing any nuisance within the limits of any mobile home park.
4. 
Skirting, porches, awnings, and other additions shall be installed as approved by the park management. When installed, they shall be maintained in good repair. The space immediately underneath a mobile home shall be used for storage only if permitted by the park management. If permitted, the following conditions shall be satisfied.
a. 
The storage area shall be provided with a base of impervious material.
b. 
Stored items shall be located so as not to interfere with the underneath inspection of the mobile home.
c. 
The storage area shall be enclosed by skirting.
(1) 
The park occupants shall store and dispose of all their rubbish and garbage in a clean, sanitary and safe manner. The garbage container shall be rodent-proof, insect-proof and water-tight.
J. 
Restrictions On Occupancy. A mobile home shall not be occupied for dwelling purposes unless it is properly secured and connected to water, sewerage, and electric utilities.
K. 
Responsibilities For The Park Management.
1. 
The park management shall operate the park in compliance with this Chapter and shall provide adequate supervision to maintain the park, its facilities and equipment in good repair and in a clean and sanitary condition.
2. 
The park management shall notify park occupants of all applicable provisions of this Chapter and inform them of their duties and responsibilities under this Chapter and regulations issued hereunder.
3. 
The park management shall supervise the placement of each mobile home which includes securing its stability and installing all utility connections.
4. 
The park management shall maintain a register containing the names of all park occupants identified by lot number or street address. Such register shall be available to any authorized person.

Any person who violates any provision of this Chapter shall upon conviction be punished as set out in Section 100.220 of this Code.

A. 
In any case where a provision of this Chapter is found to be in conflict with a provision of any other ordinance or code of the City of Cuba existing on the effective date of this Chapter, the provision which, in the judgment of the City Clerk establishes the higher standard for the promotion and protection of the health and safety of the people shall prevail. In any case where a provision of this Chapter is found to be in conflict with a provision of any other ordinance or code of the City of Cuba existing on the effective date of this Chapter which establishes a lower standard for the promotion and protection of the health and safety of the people, the provisions of this Chapter shall be deemed to prevail, and such other ordinances or codes are hereby declared to be repealed to the extent that they may be found in conflict with this Chapter.
B. 
If any section, subsection, paragraph, sentence, clause or phrase of this Chapter should be declared invalid for any reason whatsoever, such decisions shall not affect the remaining portions of this Chapter which shall remain in full force and effect; and to this end the provisions of this Chapter are hereby declared to be severable.

For the purpose of this Chapter, the following terms, phrases, words, and their definitions shall have the meaning given herein. Where not defined herein, the language used in these Code Sections shall have the common and customary meaning:
MANUFACTURED HOME
A structure, transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or forty (40) body feet or more in length, or, when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning, and electrical systems contained therein. The term includes any structure that meets all of the requirements of this definition except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the United States Secretary of Housing and Urban Development and complies with the standards established under Title 42 of the United States Code.
MOBILE HOME
A transportable, factory-built home designed to be used as a residential dwelling and built prior to the enactment of the Federal Manufactured Home Construction and Safety Standards Act of 1974. For purposes of this Chapter, "mobile home" shall include a "manufactured home," as defined herein.
MOBILE HOME PARK
A parcel of land which has been planned and improved for the placement of manufactured or mobile homes for non-transient use.
MOBILE HOME STAND
That part of an individual lot which has been reserved for the placement of the manufactured or mobile home, appurtenant structures or additions.
