The following words shall, for the purpose of this chapter,
have the meanings herein indicated:
PEDDLING
includes all of the following activities:
A.
Hawking, vending, peddling, or soliciting orders for the purchase
or sale of goods, wares, merchandise, or other commodities;
B.
Soliciting subscriptions for books, publications, papers, magazines,
or periodicals;
C.
Distributing or peddling handbills, pamphlets, tracts, or advertising
matter of any character;
D.
Soliciting gifts, contributions, or subscriptions; and
E.
Soliciting employment, work, or services to be performed within
or without the Village.
It shall be unlawful for any person to peddle within the Village
without a license issued pursuant to this chapter.
No person when peddling shall:
A. By any trick, device, or false or misleading statement or representation,
obtain or attempt to obtain admission to a house, garage, or other
building, or otherwise onto any private premises within the Village;
B. Enter upon any residential property within the Village:
(1) Except:
(a)
On Mondays through Fridays, excluding federal and state public
holidays, between the hours of 9:00 a.m. and 9:00 p.m.; and
(b)
On Saturdays, Sundays, and federal and state holidays between
the hours of 11:00 a.m. and 6:00 p.m.;
(2) Whereat a clear, visible, and legible "no solicitation" or "no trespassing"
sign is posted between the front door of the property and the street
in front of that front door; or
(3) When the property is on a list, provided to the licensee by the office
of the Village Clerk, of properties of residents who have chosen not
to permit such entry.
Every application for a license pursuant to this chapter shall
be in writing and contain the following information, unless waived
as not relevant by the Village Clerk:
A. The purpose of the application.
B. The dates and times the applicant seeks to peddle.
C. The name, street address, telephone number, cell phone number (if
any), fax number (if any), and email address (if any) of the applicant.
D. The name, street address, telephone number, cell phone number (if
any), fax number (if any), and email address (if any) of each of the
individuals who will be peddling pursuant to the license.
E. A list of all of the motor vehicles that may be within the Village
as a part of the peddling, which shall include, as to each such vehicle,
its license plate number, make, model, and color.
F. If the peddling shall be of ice cream or other food, documentary
proof of such licenses or other permits as may be required by the
Nassau County Department of Health.
G. Such other information as from time to time the Village Clerk may
reasonably require to assure the safety of the residents of the Village.
