The following words shall, for the purpose of this chapter,
have the meanings herein indicated:
includes all of the following activities:
Hawking, vending, peddling, or soliciting orders for the purchase
or sale of goods, wares, merchandise, or other commodities;
Soliciting subscriptions for books, publications, papers, magazines,
or periodicals;
Distributing or peddling handbills, pamphlets, tracts, or advertising
matter of any character;
Soliciting gifts, contributions, or subscriptions; and
Soliciting employment, work, or services to be performed within
or without the Village.
Village of Kings Point.
The Clerk of the Village or such Clerk's designee.
It shall be unlawful for any person to peddle within the Village
without a license issued pursuant to this chapter.
No person when peddling shall:
A.
By any trick, device, or false or misleading statement or representation,
obtain or attempt to obtain admission to a house, garage, or other
building, or otherwise onto any private premises within the Village;
B.
Enter upon any residential property within the Village:
(2)
Whereat a clear, visible, and legible "no solicitation" or "no trespassing"
sign is posted between the front door of the property and the street
in front of that front door; or
(3)
When the property is on a list, provided to the licensee by the office
of the Village Clerk, of properties of residents who have chosen not
to permit such entry.
A.
The Village Clerk shall maintain a list of residents within the Village
who have notified the Village Clerk by letter, email, facsimile, or
other writing of a desire not to be visited by any person for the
purposes set forth in this chapter.
B.
Any such request shall be good for two years and may be renewed biennially
for additional two-year periods.
C.
The list of residents choosing not to permit entry of such persons
upon their premises shall permit residents to distinguish between
commercial, political, charitable, religious, and other organizations.
Every application for a license pursuant to this chapter shall
be in writing and contain the following information, unless waived
as not relevant by the Village Clerk:
A.
The purpose of the application.
B.
The dates and times the applicant seeks to peddle.
C.
The name, street address, telephone number, cell phone number (if
any), fax number (if any), and email address (if any) of the applicant.
D.
The name, street address, telephone number, cell phone number (if
any), fax number (if any), and email address (if any) of each of the
individuals who will be peddling pursuant to the license.
E.
A list of all of the motor vehicles that may be within the Village
as a part of the peddling, which shall include, as to each such vehicle,
its license plate number, make, model, and color.
F.
If the peddling shall be of ice cream or other food, documentary
proof of such licenses or other permits as may be required by the
Nassau County Department of Health.
G.
Such other information as from time to time the Village Clerk may
reasonably require to assure the safety of the residents of the Village.
A.
Every license required by this chapter shall be in writing and signed
by the Village Clerk and shall be effective for a period specified
therein, said period not to exceed one year from the date it is issued.
B.
No such license shall be issued until the licensee shall have paid
a license fee as established from time to time by resolution of the
Board of Trustees.
C.
Any license issued hereunder may be suspended for a violation of
the provisions of this chapter by the Village Clerk, and, in such
event, such suspension shall be reported to the Board of Trustees
at its next meeting, who shall have the right for cause duly shown
forthwith to revoke the same. The licensee shall be given notice of
that meeting with a right to be heard and to be represented by counsel.
D.
Any licensee whose license has been suspended may appeal such suspension
to the Mayor and/or the Board of Trustees.
