The planning board of the township has recommended to the township committee enactment of an ordinance to provide for the construction and control of private swimming pools; and the enactment of this chapter is hereby declared to be for the purpose of conserving and promoting the public health, safety, morale and the general welfare of the township.
As used in this chapter:
PRIVATE SWIMMING POOL
Shall mean any artificial or semi-artificial container or receptacle for the containment of water having an inside depth at any point greater than 24 inches, located outdoors and used or intended to be used for swimming or bathing by the owner or lessee of the property on which it is situated, or by the family or guests of such owner or lessee, as an accessory use to a residence.
No person shall install, construct, erect or make any alteration, addition or other improvement to any private swimming pool until he shall have obtained a building permit issued by the construction official as in the case of any other structure. The fee for the permit shall be as proscribed in the building chapter.
Any private swimming pool shall comply with the accessory building location requirements of the zoning regulations.
Lights used above the surface of the water to illuminate any private swimming pool or other body of water exempted herein, shall be so arranged and shielded that the light will be reflected away from the adjoining premises.
The township construction official shall be responsible for the enforcement of this chapter .
Any natural pond or body of water formed by a stream or river and any other natural area of water or other body of water not herein defined shall be exempt from this chapter and shall be governed by other applicable regulations and statutes.
