The Aquatic and Recreational Facilities Code, Chapter 233, Ordinances
of St. Charles County, Missouri, as currently enacted and as amended
hereafter, including all fee provisions therein, shall be and is hereby
adopted as the Aquatic and Recreational Facilities Code (this "Code")
of the City of Lake Saint Louis, Missouri. The City Clerk shall keep
on file a current copy of the Code from and after its adoption hereby.

Pursuant to the terms of the agreement entered into between
St. Charles County (the "County") and the City, the County, by and
through its Department of Public Health shall be charged with enforcement
of this Code and shall perform all inspections necessary and required
by this Code and shall collect all fees imposed by this Code for so
long as the agreement shall be in force.

A. Any
person violating any of the provisions of this Code shall be deemed
guilty of an offense and upon conviction thereof shall be fined in
an amount not exceeding five hundred dollars ($500.00) or be imprisoned
for a period of not exceeding ninety (90) days or both such fine and
imprisonment. Each day such violation continues or is permitted to
continue shall constitute a separate offense and shall be punishable
as such hereunder.
B. In
addition to the penalties hereinabove authorized and established,
the City Attorney or his or her designee may take such other actions
at law or in equity as may be required to halt, terminate, remove
or otherwise eliminate any violations of this Code.
