The Borough of Elmwood Park, New Jersey is hereby divided into
17 zoning districts to be designated as follows:

a. The location and boundary of the zoning districts are shown on the
"Zoning District Map" of the Borough of Elmwood Park, such map to
be a part of this chapter duly certified and filed in the office of
the Borough Clerk and Construction Official.
b. Amendments to zoning district boundaries shall be entered on said
map and a record of such amendments noted therein.
1. The Zoning District Map shall be amended to incorporate the establishment
of the POP Zone as shown on the attached map hereto and made a part
hereof.
2. The Zoning District Map shall be amended to incorporate into the
POP Zone as shown on the attached map, lot three consisting of five
acres plus or minus, lot four consisting of 6.4 acres plus or minus,
lot five consisting of 5.12 acres plus or minus, and lot six consisting
of 1.12 acres plus or minus in block 902.
3. The ARHO District encompasses all properties in Block 1105 in the
Borough of Elmwood Park.
4. Ord. No. 01-4 is adopted to resolve the inconsistencies in favor
of the Master Plan of the Borough of Elmwood Park:
(a)
Block 1210, Lot 2, in its entirety shall be rezoned to be located
into the general commercial zone of the Borough of Elmwood Park. The
Zoning Map of the Borough of Elmwood Park shall be revised to reflect
and incorporate this change.
(b)
The Owner of Block 1201, Lot 2 shall, prior to the development
of the portion to be included into the general commercial (CG) Zone,
buffer said lands and premises from all residential zones by appropriate
buffering to be approved by the Planning Board of the Borough of Elmwood
Park. In the event the Owner shall not buffer as required, then and
in that event this ordinance shall be void and of no force and effect.
5. The Zoning District Map shall be amended to incorporate the establishment
of the R-5 Zone as shown on the map attached hereto and made a part
hereof. (The map may be found on file in the office of the Borough
Clerk)

6. The AH-1 District shall encompass all of Lot 3.01 in Block 1201 and
the AH-2 District shall encompass all of Lot 4.01 in Block 1201 as
shown on the current tax maps of the Borough of Elmwood Park. The
Zoning Map of the Borough of Elmwood Park shall be revised to reflect
and incorporate these changes by showing the locations of the AH-1
and AH-2 Zones and by adding the two new zones to the list of zones
on the Map.

7. The location of the proposed AEO Zone is the result of an analysis
of existing land uses in Elmwood Park and surrounding municipalities
in accordance with N.J.S.A. 2C:34-7. This law requires that adult
entertainment uses shall not be located within 1,000 feet of the following
types of land uses: existing sexually oriented businesses, places
of worship, elementary and secondary schools, school bus stops, public
recreational uses, hospitals, child care centers and areas zoned for
residential use. The properties and portions thereof which are identified
on the map as the AEO Zone are those that meet all of the criteria
set forth by the State statute. (The map may be found on file in the

8. Pursuant to Ordinance No. 2015-13, the Zoning District Map is revised
to add the N.C. Neighborhood Commercial District to all current C.L.
Local Commercial District locations with the exception of the C.L.
Local Commercial District located on the south side of Broadway between
East 53rd street and East 54th Street.

9. Pursuant to Ordinance No. 2017-08, the official zoning map of the
Borough of Elmwood Park shall be amended to provide that the properties
identified as Block 902, Lots 2 and 10 be included in the I-G Zone
as well as the POP Zone and subject to the zoning standards of both
zones.

10. Pursuant
to Ordinance No. 2018-11, the Zoning Map is revised to depict Lot
2.01 in Block 1201 as within the AH-3 Affordable Housing Zone.

Where any uncertainty exists with respect to the boundary of
any district as shown on the Zoning District Map, the following rules
shall apply:
a. Where a boundary is indicated as a highway, street, alley, railroad,
watercourse or Borough boundary, it shall be construed to be the center
line thereof or such Borough boundary.
b. Where a boundary is indicated as approximately parallel to a highway,
street, alley, railroad, watercourse or Borough boundary, it shall
be construed as parallel thereto and at such distance from the center
line thereof as shown on the Zoning District Map.
c. If no dimension is given on the Zoning District Map, the location
of any boundary shall be determined as follows:
1. Where a boundary apparently coincides with a lot line, the boundary
shall be construed to be the lot line;
2. Otherwise, by use of the scale shown on the Zoning District Map.
d. Where a boundary divides a lot of record, zoning district regulations
governing either portion of the severed lot may be extended not more
than 30 feet into the adjoining district.
e. The Board of Adjustment shall resolve all boundary questions not
covered above.
