The title of this chapter shall be known and referred to as the "Administrative Code of the Township of Berkeley."

a. 
As used in this chapter:
ADMINISTRATOR
Shall mean the Business Administrator duly appointed pursuant to the Charter and the Administrative Code, or the Assistant or Acting Administrator serving in the place of the Business Administrator pursuant to the Charter or this chapter.
CHARTER
Shall mean the Mayor-Council Form constituting Chapter 210 of the New Jersey Law, 1950, N.J.S.A. 40:69A-1 et seq., as amended and supplemented by Chapter 465 of the Laws of 1981, and any and all statutory provisions, administrative rules and regulations or case law of the State of New Jersey as may be applicable to the Township.
CLERK
Shall mean the Municipal Clerk duly appointed pursuant to the Charter and this chapter.
CODE
Shall mean the Administrative Code, unless the context indicates that the term applies to the entire codification of Township ordinances.
COUNCIL
Shall mean the local legislative body of the municipality constituted and elected pursuant to the Charter.
COUNSEL
Shall mean the Director of Law.
DEPARTMENT
Shall mean an organizational unit of the municipal government established or designated by or pursuant to the Administrative Code as a "department."
DIRECTOR
Shall mean the administrative head of a department.
GOVERNING BODY
Shall mean the Municipal Council as constituted under the Charter of the Township of Berkeley.
INDEPENDENT BERKELEY BOARD, COMMISSION OR BODY
Shall mean any agency or instrumentality of the municipal government which is created by the Council by ordinance not allocated or assigned within a department.
MONTH
Shall mean a calendar month, unless otherwise specifically provided.
MOTION
Shall mean and include any act of the Governing Body dealing with the procedural or parliamentary matters not required to be reduced to writing, which may be finally passed at the meeting at which it is introduced.
MUNICIPALITY
Shall mean the Township of Berkeley, within the County of Ocean and State of New Jersey, or any corporate successor thereof.
ORDINANCE
Shall mean and include any act or regulation heretofore or hereafter adopted by the Governing Body required to be reduced to writing and read at more than one meeting thereof and published.
PERSON
Shall mean any corporation, firm, partnership, association, organization or other entity, as well as an individual.
RESOLUTION
Shall mean and include any act or regulation of the Governing Body required to be reduced to writing but which may be finally passed at the meeting at which it is introduced.
TOWNSHIP COUNCIL
Shall mean the Municipal Council, the legislative branch of the Township Government.
WRITING AND WRITTEN
Shall mean and include printing, typewriting and any other mode of communication used on paper or similar material which is in general use, as well as legible handwriting.
YEAR
Shall mean a calendar year, unless otherwise specifically provided.
b. 
Construction. For the purposes of the Administrative Code and any other ordinances which were heretofore or are hereafter adopted, except as the context may otherwise require, the following constructions shall apply:
1. 
The present tense includes the past and future tenses.
2. 
The masculine gender includes the feminine and neuter.
3. 
The singular number includes the plural, and the plural, the singular.
4. 
The time within which an act is to be done shall be computed by excluding the first and including the last day, and if the last day is a Sunday or legal holiday, the day shall be excluded.

a. 
It is the intent of the Council in enacting this Code to exercise fully the powers delegated by the Charter to order and regulate its internal affairs fully, and the provisions of this Code should be constructed liberally to that end.
b. 
This Code shall be interpreted and administered so as to maintain the separation of legislative and administrative powers as provided in the Code.

The purpose of this Code shall be to establish departments; allocate the Township's functions, powers and duties among and within the departments; establish official relationships and prescribe standards and procedures for the conduct of public business; to establish standards and qualifications for persons serving in offices and employment with the Township in order to establish professional management for the Township of Berkeley pursuant to N.J.S.A. 40:69A-1 et seq.

If any article, section or part of this Code shall be declared to be unconstitutional, invalid or inoperative, in all or in part, by a court of competent jurisdiction, such article, section or part shall, to the extent that it is not unconstitutional, invalid or inoperative, remain in full force and effect, and no such determination shall be deemed to invalidate the remaining articles, sections or parts of this Code.

a. 
All ordinances heretofore adopted by the Township, community of the Township of Berkeley or the Board of Health of the Township of Berkeley, to the extent that the same are consistent with this chapter, are continued in full force and effect. All references in the ordinances to the Township Council, Board of Health or any body, board, department or office shall be construed to mean such body, board, office or officer to which the respective functions, powers and duties are allocated and assigned by this Code.
b. 
All ordinances and parts of ordinances which are inconsistent with any provisions of this Code are repealed to the extent of such inconsistency.

Within the Administrative Code, there are established a variety of positions appointed by various Township appointing authorities. It is the intent of this Code that no appointment be made without specific ordinance authorization for the position. However, any appointment authority, provided that there are funds available for the position, may, by official action, whether it be by executive order, directive or resolution, establish a temporary position, which position shall be valid and capable of being temporarily filled only if within three working days the Township Council shall initiate and subsequently enact an appropriate legislation, the intent of which is to establish the position to be filled. No position of department head shall be temporarily filled without the advice and consent of the Council.
