No person, firm, corporation or individual connected
with such firm or corporation shall do or cause to be done by others
to any tree, shrub or plant on a public highway or place, either purposely,
carelessly or negligently, without the written permission of the Shade
Tree Commission any of the following acts:
A. Cut, disturb or interfere in any way with any root.
B. Cut, prune, climb with spikes, break, damage or remove.
D. Fasten any rope, wire, sign or other device.
E. Remove or damage any guard or device placed to protect
any tree or shrub.
F. Close or obstruct any open space within three feet
from the perimeter of the base of a tree or shrub in such a manner
as to exclude air, water or fertilizer from the roots of such tree
or shrub.
G. Excavate or fill within six feet of a tree or shrub.
Every person, firm or corporation owning or
having control over any wire, cable and appurtenances for the transmission
of electric current along or over any public land within the jurisdiction
of the Shade Tree Commission shall, at all times, guard and protect
all trees through, over or near which such wire, cable and appurtenance
may pass from and against any injury or damage therefrom or from the
electric current carried by the same. The device or means used for
the transmission of any electric current and the methods used to guard
and protect any such tree or trees shall be subject to the approval
of the Shade Tree Commission.
No person, firm or corporation shall permit
or cause any injurious chemical, fire, heat, vapor, fumes or other
substance to come in contact with or otherwise cause damage or injury
to any tree, shrub or parts thereof upon any public land within the
jurisdiction of the Shade Tree Commission.
No person, firm or corporation is permitted
to lay any sidewalk along or to open, construct, curb or pave any
street or do any like act so as to interfere with the proper growth,
care and protection of any shade tree within the jurisdiction of the
Shade Tree Commission without the consent of the Shade Tree Commission.
In the erection, altering or repairing of any
building or structure, the owner or contractor thereof shall place
such guards around all trees within the jurisdiction of the Shade
Tree Commission as will effectually prevent injury to such trees.
Such guards shall be placed not less than three feet from the perimeter
of the trunk of the tree.
Shovels and all other implements, machines and
tools shall be used or operated in such a manner as not to damage
or destroy any tree, shrub or plant within the jurisdiction of the
Shade Tree Commission.
No one shall maintain a diseased or infected
tree that will affect the health of surrounding trees nor maintain
any tree or part thereof dangerous to public safety.
No person, firm or corporation shall prevent,
delay or interfere with any lawful work undertaken by the Shade Tree
Commission or its authorized servants, agents or employees.

A. Preparation and handling. Brush, stumps, limbs, branches and tree
cuttings may be placed at the curbline in accordance with this section
and collected during scheduled hours of the Department of Public Works
as follows:
(1)
No piece or bundle of brush shall exceed four feet in length,
in piles not to exceed three feet in height and extend less than six
inches or more than four feet from the curbline into the roadway,
and shall at no time create a traffic hazard.
(2)
Trees and stumps shall not exceed 24 inches in diameter. No
other debris or trash shall be mixed in with the brush.
(3)
All debris must be 10 feet away from any storm drain.
(4)
All tree clippings must be separated from any other materials
(leaves, bulky trash, etc.).
