[1980 Code § 157-2]
Except as provided herein, it shall be unlawful for any person
to be in or upon any of the public parks and playgrounds administered
by the Borough of Roselle Park after dusk and before dawn unless prior
written approval is obtained from the Borough Clerk.

a.
Each person using the public parks and playgrounds shall:
1.
Clean up all debris, extinguish all fires, when such fires are permitted,
and leave the premises in good order and the facilities in a neat
and sanitary condition.
2.
Comply with all applicable provisions of the State Motor Vehicle
Traffic Laws in regard to equipment and operation of vehicles, together
with such regulations as are contained in this chapter and other ordinances.
3.
Obtain the written permission of the Borough Clerk before bringing
any buses or charter groups into the park premises.
b.
Prohibited Acts. It shall be unlawful for any person using these
parks and playgrounds to either perform or permit to be performed
any of the following acts:
1.
Protection of Property. No one shall:
(a)
Willfully mark, deface, injure, disfigure, tamper with, displace
or remove any building, bridges, tables, benches, fireplaces, railings,
paving or paving material; waterlines or other public utilities or
parts or appurtenances thereof; signs, notices or placards, whether
temporary or permanent; monuments, stakes, posts or other boundary
markers; or other structures or equipment, facilities or park or playground
property or appurtenances whatsoever, either real or personal.
(b)
Throw, discharge or place or cause to be placed in the waters
of any fountain, stream or body of water in or adjacent to any park
or any tributary, stream, storm sewer or drain flowing into such waters
any substance, matter or thing, liquid or solid, which will or may
result in the pollution of these waters.
(c)
Bring in or dump, deposit or leave any bottles, broken glass,
ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, refuse or
other trash. No such refuse or trash shall be placed in any waters
in or contiguous to any park or playground or be left anywhere on
the grounds thereof, but shall be placed in the proper receptacles
where these are provided. Where receptacles are not so provided, all
such rubbish or waste shall be carried away from the park or playground
by the person responsible for its presence and properly disposed of
elsewhere.
(d)
Damage, cut, carve, transplant or remove any tree or plant or
injure the bark or pick the flowers or seeds of any tree or plant;
nor shall anyone attach any rope, wire or other contrivance to any
tree or plant. A person shall not dig or otherwise disturb grass areas
or in any other way injure or impair the natural beauty and usefulness
of any area.
2.
Domestic Animals Prohibited. No animals shall be permitted on premises.
3.
Protection of Wild Animals. No one shall hunt, molest, harm, frighten,
kill, trap, chase, tease, shoot or throw stones or any missiles at
or give or offer any poisonous foods to any animal, reptile, bird
or the eggs of same, except that the foregoing shall not prohibit
the killing of any deadly animal.
4.
General Conduct. No one shall:
(a)
Bring in or upon, have brought in or upon or cause to be brought
in or upon the park, or the grounds thereof, any alcoholic beverage
or illegal drug, or sell, purchase, consume or drink any alcoholic
beverage or illegal drug at any time in the park. Any person entering
the park or found within the park to be under the influence of alcoholic
liquor or illegal drugs shall be immediately removed.
(b)
Bring in or cause to be brought in or have in his or her possession
or set off or otherwise cause to be exploded, discharged or burned
any firecracker, torpedo, rocket or other fireworks or explosive or
flammable material, or discharge or throw them into any area of the
park or upon the land adjacent thereto. Notwithstanding the foregoing,
the park grounds or facilities may be used for a scheduled fireworks
program under the permit.
(c)
Build or attempt to build a fire except in a fireplace designated
and constructed for such purpose and under such regulations as may
be adopted by the Governing Body. No person shall drop, throw or otherwise
scatter lighted matches, burning cigars, or cigarettes, tobacco or
any other flammable material within the park.
(d)
Enter upon ice, except when ice has been approved for skating
purposes, provided that a safety signal is displayed on the ice or
on an adjacent area.
(e)
Engage in any disorderly conduct or a behavior tending to cause
a breach of the public peace. No person shall disturb or otherwise
interfere with any other person or group of persons occupying any
area or engaging in any organized activity.
(f)
Sell or offer for sale any object or merchandise or any other
thing within the parks or playgrounds or place any other equipment
or apparatus within the parks or playgrounds, except by permit or
as may be permitted by the rules and regulations in accordance with
the requirements set forth in this Code.
(g)
Remove or open permanent or temporary barriers, signs, directionals,
gates or fences.
(h)
Endanger the safety of any person by any conduct or act.
(i)
Prevent any person from using any park or playground or any
of its facilities or interfere with such use in compliance with this
section and the rules applicable to such use.
(j)
Fail to obey or interfere with any Police Officer, Borough Official
or employee in the proper performance of his duties.
(k)
Leave any motor vehicle overnight.
(l)
Ride bicycles or other vehicles without regard to the safety
of others.
(m)
Gamble.
(n)
Sleep on park benches.
(o)
Camp, except with the written permission of the Borough Clerk.
(p)
Solicit alms or contributions, except with the written permission
of the Borough Clerk.
(q)
Carry firearms or other weapons.
(r)
Bring any concession trucks or otherwise sell any food or beverages
in park areas or five hundred (500) feet from park entrances without
the prior written permission of the Borough Clerk.
(s)
Attempt to use any playing field or other area which has been
reserved for use by some other person, firm, corporation or group.
(t)
Attempt to gain entry to a special event without paying the
required admission fee.

a.
The Borough Clerk shall, in connection with her duties, enforce the
provisions of this section and, in furtherance of those duties, may
designate such enforcement to the Recreation Committee or such other
persons employed or appointed by the Borough.
b.
The Police Department or those persons designated by the Borough
Council, including members of the New Jersey State Police, shall have
the authority to eject from the parks and playgrounds area any person
or persons acting in violation of this section.
c.
The Police Department shall have the authority to seize, confiscate,
hold and/or retain, subject to the constraints of due process of law,
any property, thing or device used in violation of this section in
any public park and/or playground.
d.
The Recreation Committee shall have the authority to adopt rules
and regulations, which shall become effective after approval by the
Governing Body.

Permits for special events in parks or to use the park beyond
the normal hours shall be obtained by application to the Borough Clerk
in accordance with the following procedures:
a.
A person seeking issuance of a Special Events Permit shall file an
application with the Borough Clerk or her designee disclosing the
following:
1.
The name and address of the applicant.
2.
The name and address of the person, persons, corporation or association
sponsoring the activity, if any.
3.
The day and hours for which the permit is desired.
4.
The park, or portion thereof, for which such permit is desired.
5.
Any other information which the Governing Body shall find reasonably
necessary to a fair determination as to whether a permit should be
issued hereunder.
b.
Standards for issuance of a use permit by the Borough Clerk shall
include the following findings:
1.
That the proposed activity or use of the park will not unreasonably
interfere with or detract from the general public enjoyment of the
park.
2.
That the proposed activity and use will not unreasonably interfere
with or detract from the promotion of the public health, welfare,
safety and recreation.
3.
That the proposed activity or use that is reasonably anticipated
will not include violence, crime or disorderly conduct.
4.
That the proposed activity or use will not entail extraordinary or
burdensome expense to the Borough.
5.
That the facilities desired have not been reserved for other use
at the date and hour requested in the application.
c.
The Borough Clerk shall not unduly withhold issuance of any permit
unless she finds and determines that the proposed activity or activities
for which a permit is sought would probably result in, at the time
proposed for scheduling, the depriving of adjacent property owners
of the quiet use and enjoyment of their premises or could not be conducted
without jeopardizing the public health, safety and welfare of those
for whom the permit is sought or other citizens of the Borough, or
adjacent thereto, or would result in a public nuisance or disturbance.
d.
In the event of a denial of a request for a permit, the Borough Clerk shall apprise the applicant, in writing, of her reasons for refusing a permit, and any aggrieved person shall have the right to appeal, in writing to the Mayor and Council within ten (10) days from the receipt of such denial. The Borough, in reviewing any such appeal, may make an independent determination of the facts but shall at all times apply those legal standards set forth in Subsection b hereof in the rendering of such determinations.
e.
In the event that the denial of a request for a permit results in
a hearing date beyond that requested in the application for a permit,
the applicant shall be permitted to amend his application on appeal
to request another date beyond the hearing set by the Governing Body.
f.
The permit holder shall be bound by all park and playground rules
and regulations and all applicable ordinances as fully as though the
same were inserted in the permits.
g.
The Borough Clerk shall have the authority to revoke a permit upon
finding a violation of any rule or ordinance or upon good cause shown.

No person in the Green Acres Recreation Area ("recreational
facility"), as hereafter defined shall:
a.
Willfully mark, deface, disfigure, injure, tamper with, displace
or remove any building, table, bench, stand, railing, paving or paving
materials, public utilities or parts or appurtenances thereof, signs,
notices or placards, whether temporary or permanent, monuments, stakes,
posts or other boundary markers or any other structure or equipment,
facility or property or appurtenances whatsoever, either real or personal.
b.
Fail to cooperate in maintaining restrooms and washrooms in a neat
and sanitary condition. No person over the age of five (5) years shall
use the restrooms and washrooms designated for the opposite sex.
c.
Dig or remove any soil, rock, sand, stones, trees, shrubs, plants
or other wood or materials, or make any excavation by tool, equipment,
blasting or other means or agency.
d.
Construct or erect any building or structure of whatever kind, whether
permanent or temporary, or run or string any public service utility
into, upon or across such lands, except on special written permit
issued hereunder.
e.
Damage, cut, carve, transplant or remove any tree or plant or injure
the bark or pick flowers or seed of any tree or plant, dig in or otherwise
disturb any grass area or in any other way injure the natural beauty
or usefulness of any area.
f.
Climb any tree, stand or sit upon monuments, planters, railings,
fences or upon any other property not designated or customarily used
for such purposes.
g.
Tie or hitch any animal to any tree, plant, fence, stand or other
object.
h.
Have brought in or dump, deposit or leave any bottles, broken glass,
ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, refuse or
other trash. No refuse or trash shall be left anywhere on the grounds,
but shall be placed in the proper receptacles where these are provided
and where receptacles are not provided, or are insufficient, all rubbish
or waste shall be carried away from the recreational facility by the
person responsible for its presence and properly disposed of elsewhere.
i.
Drive any vehicle on any area except the paved parking areas or such
areas as may on occasion be specifically designated as temporary areas
by the Board of Education of Roselle Park ("Board of Education"),
except for police, fire or first aid vehicles.
j.
Park a vehicle in other than an established or designated parking
area and such parking shall be in accordance with posted directions
and/or the instruction of any attendant who may be present.
k.
Leave a vehicle standing or parked between 11:00 p.m. and 5:00 a.m.
in established parking areas or elsewhere in the recreational facility.
l.
Cause or permit any vehicle to stand outside of designated parking
areas or spaces in the recreational facility except for a reasonable
time not exceeding five (5) minutes to pickup or discharge passengers
or equipment.
m.
Leave a bicycle in a place other than a bicycle rack (if such is
provided and there is space available).
n.
Ride a bicycle in any area except the parking areas.
o.
Leave a bicycle lying on the ground or pavement or set against any
tree, bush, fence or in other place or position where other persons
may trip over or be injured.
p.
Dress or undress in any bathroom or other place.
q.
Carry or possess firearms of any description, or air rifles, spring
guns, slings or any other form of weapon or any instrument that could
be loaded with and fire blank cartridges except for starter pistols
which may be used for events authorized by the Board of Education.
r.
Picnic or lunch in a place other than those designated for that purpose.
Persons shall utilize such designated areas in such a manner as to
prevent congestion and secure the maximum use for the comfort and
convenience of all. Visitors shall comply with any directions given
by the appropriate Borough or Board of Education representatives to
achieve this purpose.
s.
Use any portion of any area designated for picnics to the exclusion
of other persons unless a special permit has been issued by the Board
of Education, nor shall any person use such area for an unreasonable
time if the facilities are crowded without special permit of the Board
of Education.
t.
Leave any area before all trash is placed in the disposal receptacles
when provided and not filled. If no such trash receptacles are available
or are full, then trash shall be carried away from the recreational
facility by the individual or entity using that area, to be properly
disposed of elsewhere.
u.
Set up tents, shacks or other temporary shelter for the purpose of
overnight camping nor shall any person leave in the recreational facility
after 10:00 p.m. any movable structure or special vehicle to be used
or that could be used for such purpose, such as a house trailer, camp
trailer, camp wagon or the like, without special permit of the Board
of Education or Mayor and Council.
v.
Take part in or assist the playing of any game involving throwing
or otherwise propelling objects such as balls, stones, arrows, javelins,
horseshoes, quoits or model airplanes, except in those areas set forth
for such forms of recreation or as otherwise specially permitted by
the Board of Education. The playing of rough or comparatively dangerous
games such as football, soccer, field hockey, track, baseball and
lacrosse is prohibited, except on the fields, courts or areas provided
therefor. The playing of golf is prohibited.
w.
Allow or permit the entry of any dog or other domestic animal in
the recreational facility, except in areas clearly marked by signs
bearing the words "Domestic Animals Permitted in This Area." Nothing
herein shall be construed to permit any dog or other domestic animal
to run at large and all dogs or domestic animals in those areas where
such animals are permitted shall be restrained at all times on adequate
leashes not greater than six (6) feet in length.

While in the recreational facility, all persons shall conduct
themselves in a proper and orderly manner and, in particular, no person
shall:
a.
Bring alcoholic beverages or consume same at any time in the recreational facility except as provided in Subsection 10-3.7.
b.
Have in his or her possession, or set or otherwise cause to explode,
discharge or burn, any firecracker, torpedo rocket or other fireworks,
firecrackers or explosives of an inflammable material, or discharge
them or throw them into any such areas from lands or streets adjacent
to the recreational facility. This prohibition shall include any substance,
compound, mixture or article that in conjunction with any other substance
or compound shall be considered dangerous. At the discretion of the
Mayor and Council, permits may be given for conducting properly supervised
fireworks in designated areas pursuant to New Jersey law.
c.
Appear at any place in other than proper clothing.
d.
Build or attempt to build a fire, except in such areas as permitted
by special permit issued by the Board of Education. No person shall
drop, throw or otherwise scatter lighted matches, burning cigarettes
or cigars, tobacco paper or other flammable material.
e.
Enter an area posted as being "Closed to the Public," nor shall any
person use or assist in using any area in violation of posted notice.
f.
Gamble or participate in or assist in any game of chance, except
as may be lawfully permitted by the laws of the State of New Jersey
and pursuant to a permit issued by the Borough and the Board of Education.
g.
Sleep on the seats or benches or other areas or engage in loud, boisterous,
threatening, abusive, insulting or indecent language or engage in
any disorderly conduct or behavior tending to breach the public peace.
h.
Fail to produce and exhibit any permit from the Board of Education
and/or the Mayor and Council that he, she or it claims to possess
upon request of any authorized representative of the Borough or the
Board of Education who shall desire to inspect the permit for the
purpose of enforcing compliance with any ordinance, rule or regulation.
i.
Disturb or interfere unreasonably with any person or party occupying
any area or participating in any activity pursuant to the authority
of the Board of Education and/or the Mayor and Council.
j.
Expose or offer for sale any article or thing or station or place
any stand, cart or vehicle for the transportation, sale or display
of any such article or thing in the recreational facility or five
hundred (500) feet from the entrances, except as permitted by permit
issued by the Board of Education and, where necessary, by proper license
issued by the Mayor and Council.
k.
Paste, glue, tack or otherwise post any sign, placard, advertisement
or inscription whatsoever or erect or cause to be erected any sign
whatsoever.

a.
Except for unusual and unforeseen emergencies, the recreation facility
shall be open to the public as set forth in the Green Acres Guidelines
as hereafter described.
b.
All functions shall be concluded no later than 10:00 p.m. and all
lights are to be turned off at 10:30 p.m. for all facilities except
for security lighting.
c.
Tennis courts shall be available for use during the hours from 6:00
a.m. to 10:00 p.m.
d.
The running track at the high school athletic field may be used during
all daylight hours until 10:00 p.m.
e.
Any part of the recreational facility may be closed to the public
by the Board of Education at any time for any temporary interval of
time up to a maximum of seventy-two (72) hours, unless such time interval
is extended by formal resolution of the Mayor and Council.

a.
Permits for events in the recreational facility shall be obtained
by application to the Board of Education in accordance with the Green
Acres Guidelines, where applicable, and utilizing the following procedure:
1.
A person seeking issuance of a permit hereunder shall file an application
with the Board of Education stating:
(a)
The name and address of the applicant.
(b)
The name and address of the person, persons, corporation, or
association sponsoring the activity.
(c)
The day(s) and hours for which the permit is desired.
(d)
The portion of the recreational facility for which such permit
is desired.
(e)
Any other information which the Board of Education shall deem
reasonably necessary to a fair determination as to whether a permit
shall be issued hereunder.
2.
In order for a permit to be issued by the Board of Education, it
must make the following findings:
(a)
That the proposed activity or use will not unreasonably interfere
or detract from the general public enjoyment of the recreational facility.
(b)
That the proposed activity and use will not unreasonably interfere
with or detract from the promotion of the public health, welfare and
safety and recreation.
(c)
That the proposed activity or use reasonably anticipated will
not include or result in violence, crime or disorderly conduct.
(d)
That the proposed activity will not entail extraordinary or
burdensome expense or Police operation by the Borough.
(e)
That the facilities desired have not been reserved for other
use at the date(s) and hour(s) requested in the application.
b.
Appeal. Within ten (10) days after the receipt of an application, the Board of Education shall issue the permit or supply the applicant in writing with its reasons for refusing to issue a permit. If a permit has been refused, any aggrieved person shall have the right to appeal to the Mayor and Council by serving written notice thereof on the Borough Clerk within ten (10) days of this refusal. A copy of the notice shall also be served upon the Board of Education within the same time and the Board of Education shall immediately forward the application and the reasons for its refusal to the Mayor and Council which shall consider the application under the standards set forth under Subsection a2 of this subsection. The decision of the Mayor and Council shall be final. In the event that the denial of a request for a permit results in Mayor and Council's decision being rendered on a date beyond that requested in the application for permit, the applicant shall be permitted to amend his application on appeal to request another date beyond the time when the Mayor and Council renders its decision.
c.
A person issued a permit shall be bound by all rules and regulations
and applicable ordinances as though same were inserted in the permit.
d.
The person or entity to whom the permit is issued shall be liable
for all loss, damage or injury sustained by any person during the
time that the permit is in effect and for a reasonable period of time
immediately before and immediately after the time period for which
the permit is in effect. The Board of Education shall have the right
to require any person, as a condition of issuing a permit, to submit
evidence of appropriate insurance in amounts and coverage determined
by the Board of Education in consultation with the Mayor and Council
and naming the Board of Education and the Borough as additional insureds.
Such evidence of insurance shall be provided to the Board of Education
prior to the issuance of any permit. In no event shall any activity
be commenced by the person granted a permit until such evidence is
provided.
e.
The Board of Education shall have the authority to revoke a permit upon a finding of a violation of any rule, regulation or ordinance, or upon good cause shown. The appeal provisions provided for in Subsection b above shall be applicable in such a situation.
f.
The Board of Education shall determine what activities require the
issuance of a permit and may establish fees for use of the recreational
facility where permits are required, which fees shall be approved
by the Mayor and Council unless otherwise provided for in the Green
Acres Guidelines. All fees must be paid in full prior to issuance
of the permit.
g.
The Board of Education shall not unduly withhold issuance of any
permit. It may do so if it finds and determines that the proposed
activity or activities for which a permit is sought would probably
result in, at the time proposed for scheduling, the depriving of adjacent
property owners of the quiet use and enjoyment of their premises or
could not be conducted without jeopardizing the public health, safety
and welfare of those for whom the permit is sought or other citizens
of the Borough of Roselle Park, or adjacent thereto, or would result
in a public nuisance or disturbance.

a.
The Board of Education, its employees and agents, shall, in connection
with their duties, diligently enforce the provisions of this section
and the Green Acres Guidelines.
b.
The Board of Education shall have the authority to eject from the
recreational facility any person or persons acting in violation of
this section or the Green Acres Guidelines.
c.
The Board of Education shall have the authority to seize and confiscate
any property, thing or device found in the recreational facility or
used in that facility in violation of this section or the Green Acres
Guidelines.
d.
The Green Acres Guidelines and this section shall also be enforced
by the Police Department of the Borough.

The Mayor and Council reserve the right with respect to any
or all of the recreational facility to enter into any agreement with
the Board of Education concerning the control and use thereof. The
Mayor and Council shall also reserve the right to issue rules and
regulations by resolution governing the use of the recreational facility,
which rules and regulations are referred to herein as the "Green Acres
Guidelines."

That portion of the recreational facility which is to be known as the "Senior Citizens Park" and is fully described herein shall be exempt from the provisions of Subsection 10-3.2a and Subsection 3-1.5, Sale or Consumption on Board of Education Property Prohibited, of the Roselle Park Code in that persons desiring to sell, distribute, possess or consume alcoholic beverages within the boundaries of the Senior Citizens Park may do so by applying to the Mayor and Council and the Board of Education for a special permit. Anyone not possessing the requisite permits shall be prohibited from selling, distributing, possessing or consuming alcoholic beverages within the boundaries of the Senior Citizens Park. The Senior Citizens Park is described as follows:
Beginning at the point of intersection of the northerly sideline
of West Lincoln Avenue and the easterly sideline of Pine Street;
Thence (1) North 10 degrees 08 minutes West along the easterly
sideline of Pine Street 100 feet to a point;
Thence (2) South 79 degrees 52 minutes West 60 feet to a point;
Thence (3) North 10 degrees 08 minutes West 20 feet to the point
and place of beginning;
Thence (4) South 79 degrees 52 minutes West 105 feet to a point;
Thence (5) South 10 degrees 08 minutes East 60 feet to a point;
Thence (6) South 79 degrees 52 minutes West 120 feet to a point;
Thence (7) North 10 degrees 08 minutes West 240 feet to a point;
Thence (8) North 79 degrees 52 minutes East 225 feet to a point;
Thence (9) South 10 degrees 08 minutes East 180 feet to the
point and place of beginning.

requires that a Social Affairs Permit be obtained if a nonprofit organization
is holding an affair for which there is a charge to attend and alcoholic
beverages are sold or served.

The Green Acres Recreation Area, also referred to herein as
the "recreational facility," is described as including, but not limited
to, the stadium, all baseball fields, practice fields, field hockey
fields, tennis courts, basketball courts, parking areas, bocci courts,
handball courts, picnic areas, rest areas and other areas immediately
north and west of the Roselle Park High School building. It shall
include all property leased to the Borough by the Board of Education
which is adjacent to the high school building.

living within the same household. Roselle Park residency shall be
