[1980 Code § 109-1; Ord. No. 2087]
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et
seq.) shall be locally enforced in the Borough of Roselle Park.

The local enforcing agency shall be the Roselle Park Fire Department
through its Bureau of Fire Prevention, which is hereby created therein.
The Bureau of Fire Prevention shall hereinafter be known as the "local
enforcing agency."

a.
The local enforcing agency shall enforce the Uniform Fire Code in
all buildings, structures, and premises within the established boundaries
of the Borough of Roselle Park other than one- and two-unit owner-occupied
dwellings used exclusively for dwelling purposes and buildings, structures,
and premises owned or operated by Federal government, interstate agencies
or the State.
b.
The local enforcing agency shall faithfully comply with all the pertinent
requirements of the Uniform Fire Safety Act and Uniform Fire Code.

a.
The Bureau of Fire Prevention established by Subsection 22-1.1 shall be under the direct supervision and control of a Fire Official.
b.
The Fire Official shall submit an annual report to the Mayor and
Council. A copy of this report shall be submitted to the State of
New Jersey, Division of Fire Safety.

The Fire Official shall be appointed by the Mayor upon confirmation
of Council. The Chief of the Fire Department shall submit his recommendation
to the Mayor for consideration by December 1 of each year. The Fire
Official shall hold the equivalent staff rank of Deputy Chief of the
Fire Department. In order to be appointed as the Fire Official, a
person must satisfy the following requirements:

The Fire Official shall serve for a term of three (3) years
beginning January 1 of each year and ending December 31 of that term
or until his successor is appointed.

a.
All employees of the Bureau shall be appointed by the Mayor, upon
confirmation of Council, for a term of one (1) year commencing January
1 of each year and ending December 31 of each year. The Fire Official
shall submit his recommendations for appointment, where applicable,
to the Mayor for consideration by December 15 of each year. No persons
serving as Fire Official or Chief Inspector may also serve as inspectors
or clerical personnel nor may any inspectors also serve as clerical
personnel.
b.
One (1) Chief Inspector shall be appointed with a staff rank equivalent
to a Battalion Chief in the Fire Prevention Bureau.
c.
A maximum of twelve (12) Inspectors may be appointed.
d.
The Chief Inspector and each inspector shall be State certified as
licensed Fire Inspectors. The Chief Inspector's duties shall be as
directed by the Fire Official, including but not limited to training
the Inspectors, assigning them work and generally supervising their
activities. Inspectors shall perform such duties as directed by the
Fire Official and/or the Chief Inspector.
e.
The Arson Investigator shall be a member of the Roselle Park Fire
Department and shall have the staff rank of a Captain in the Fire
Department. He shall perform all duties as may be assigned to him
by the Fire Official, Chief of the Fire Department, or Mayor and Council.
These duties include, without limitations, inspection of buildings,
motor vehicles, land, trees, crops and other property which may be
wholly or partially consumed by fire; investigation of circumstances
of such occurrences; and the submission of reports of inspections
to the appropriate agencies and officials.
f.
Two (2) part-time clerical personnel assigned to the Bureau shall
perform the clerical functions for the Bureau. The Fire Official,
in conjunction with the Borough Clerk, shall advertise for persons
to serve in the positions and shall interview such persons.
g.
The Borough Attorney shall serve as counsel to the Bureau and shall
provide legal advice and legal services for the Bureau.
h.
A police liaison shall be designated by the Chief of Police to attend
meetings of the Bureau or with the Fire Official. The police liaison
shall cooperate with the Bureau and Fire Official to assist in the
enforcement of the Uniform Fire Code.
i.
Neither the Fire Official, Chief Inspector nor any Inspector shall
carry out any inspection or reinforcement procedure with respect to
any property or business in which he or she or a member of his or
her immediate family has an economic interest. Such person owning
such property or business subject to the Uniform Fire Code shall annually
report any income or benefits received from any property or business
subject to the Uniform Fire Code to the Mayor and Council.

The salary schedule for the officers and employees of the Bureau
for Fire Prevention will be in accordance with the Borough's current
Salary Ordinance.[1]

The Fire Official, the Chief Inspector, the Inspectors and the
Arson Investigator shall be subject to removal by the Mayor and Council
upon a finding of inefficiency or misconduct. The clerical personnel
shall serve at the pleasure of the Mayor and Council and may be removed
at the request of the Fire Official. Each officer or employee, except
the clerical personnel and police liaison, shall be afforded an opportunity
to be heard prior to removal by the Mayor and Council.

Any person aggrieved by any ruling, action, order or notice
of the Bureau as it relates to the Uniform Fire Code shall have the
right to appeal such ruling, action, order or notice to the Construction
Board of Appeals of Union County.

The Bureau shall carry out periodic inspections in all buildings,
structures and premises, except owner-occupied one- or two-family
dwellings, for both low-hazard uses and life-hazard uses as required
by the Uniform Fire Code.

The State Fire Prevention Code, current edition, is further
amended and supplemented, as permitted by the Act, by adding the following:
a.
Any place of public assembly where more than ten (10) persons are
in attendance shall be required to have a reliable representative
or person delegated by the place of assembly to read, at the beginning
of any function or meeting, the following notice: Fire exits are located
in the directions I am indicating. (Point out at least two (2) or
more optional directions of exits.) In case of fire, you will be notified
in the following way: bell, horn, or public address system. If you
are altered for fire, please move in a calm, orderly manner to the
nearest smoke-free exits, or as directed by the establishment over
the public address system.

In addition to the registrations required by the Uniform Fire
Code, the following non-life-hazard uses shall register with the Bureau
of Fire Prevention. These uses shall be inspected once per year and
pay an annual fee. Any use having failed to pay its corresponding
annual fee, or having failed to allow for inspection as part hereof,
shall be considered in violation of the foregoing regulations and
shall be subject to enforcement and penalties as outlined herein.

b.
In addition, a permit will be required for the following:
1.
Use of Hydrant. A Type 1 permit shall be required for the use of
any hydrant. In addition, a hydrant wrench and gate valve supplied
by the Roselle Park Fire Department shall be used to prevent hydrant
damage. A deposit of three hundred ($300) dollars shall be paid to
the Bureau, which will be refunded when the equipment is returned.
2.
The penalty for the unauthorized uses of a fire hydrant, i.e., without
a permit, shall be one hundred ($100) dollars for the first offense
and five hundred ($500) dollars for each offense thereafter.

Nothing contained herein shall be construed to affect any suit
or proceeding now pending in any court or before any administrative
body or any right, liability or cause of action acquired or existing
under any prior law.

Any person or entity who refuses to comply with any part or provision set forth in this section of the Code, or the Uniform Fire Code of the State of New Jersey, or other prevailing statutory regulations relating to fire prevention, shall be in violation of the same and subject to enforcement by the Local Enforcing Agency. Unless otherwise specified by New Jersey State Statute or the provisions of this section, violators shall be subject to a penalty imposed pursuant to the provisions of the General Penalty, § 1-5, of the Code of the Borough of Roselle Park.

It shall be unlawful to obstruct any properly signed and posted
fire lane or fire zone on private property within the Borough of Roselle
Park.

As used in this section:
Shall mean as defined or referred to in Ordinance No. 1351.
Shall mean any road, driveway or parking area which is not
open to the general public for the purposes of vehicular traffic.
Quasi-public areas which are accessible to the public but not publicly
maintained, such as roadways, parking lots, driveways, etc. in connection
with restaurants, shopping areas, apartments, professional buildings,
etc., shall be included within the definition of "private property."

Unless another penalty is provided by statute, any person violating any provision of this section shall be subject to a fine of one hundred ($100) dollars or imprisonment for a term not exceeding fifteen (15) days, or both. Anything blocking a fire lane or fire zone as described in Subsection 22-2.1 shall be subject to also being towed or removed at the owner's expense.

The provisions of this section and violations listed herein shall be separate from and in addition to the provisions of any other part of the Borough Code, including but not limited to § 22-1 commonly known as the "Fire Prevention Code."

The Fire Department and/or the Police Department of the Borough
or Roselle Park shall be charged with the responsibility for enforcement
of the provisions of this section.
