There is established the Volunteer Fire Department of the Township
of West Caldwell, which shall be under the supervision and control
of the Township Council.

The officers of the Volunteer Fire Department shall consist
of a Chief, a Deputy Chief, a First Assistant Chief, and a Second
Assistant Chief and for each company three officers, a Captain, a
First Lieutenant and a Second Lieutenant.
a.
Appointment
of Fire Chief.
1.
The Fire Chief shall be elected by a majority of the regular members
of the Fire Department in accordance with the procedures set forth
in the Fire Department's Rules and Regulations. The Fire Chief's
election to office shall be certified by the Secretary of the Fire
Department and the person so elected shall be appointed by the Mayor
with the advice and consent of the Council.
2.
The Fire Chief shall hold office for a term of two years. No person
appointed to the office of Fire Chief shall serve more than three
consecutive two-year terms. Notwithstanding the foregoing, any person
having been appointed to the Office of the Fire Chief for a two-year
term expiring on December 31, 2004 and having been reappointed to
the office of the Fire Chief for a one-year term expiring on December
31, 2005 may be reappointed in accordance with the requirements of
this chapter and the Fire Department Rules and Regulations for two
additional two-year terms for a maximum of seven consecutive years
of service as Fire Chief.
3.
Any person may be eligible for election and appointment or reappointment,
as the case may be, to the office of the Fire Chief in accordance
with this chapter and the Fire Department's Rules and Regulations
if he or she resides in the Township of West Caldwell and has continuously
served for five years as a regular member of the Fire Department,
except that Firefighters reappointed pursuant to Chapter 4-4(h) shall
be eligible for election and appointment to the office of the Fire
Chief if the member served continuously as a regular member of the
Fire Department for five years immediately preceding that member's
resignation in good standing and otherwise meets the requirements
of this section.

4.
The Mayor and Council upon the recommendation of the regular members
of the Fire Department shall adopt Fire Department Rules and Regulations
that establish additional qualifications, training, education, experience,
attendance, seniority requirements, and examination and election procedures
for the appointment or reappointment, as the case may be, to the office
of the Fire Chief, that may be necessary to implement the provisions
of this chapter.
b.
Vacancy
in the Office of the Fire Chief.
1.
Vacancy in the office of the Fire Chief shall occur upon any the
following: (a) death; (b) resignation; (c) serious permanent physical
injury or illness or mental incapacity as certified by the Township
Physician to the Fire Department and the Mayor and Council; (d) failure
to satisfy the requirements under this chapter and the Fire Department
Rules and Regulations after same has been investigated by the Fire
Department and certified to the Mayor and Council; (e) removal for
cause after notice of charges and hearing before the Mayor and Council
or (f) the expiration of the term of the person appointed Fire Chief.
2.
The Fire Department Secretary shall notify all regular members of
the Fire Department within five days of a vacancy in the office of
the Fire Chief.
3.
Upon notice of vacancy, the regulars members of the Fire Department
shall as soon as practical fill the vacancy in the office Fire Chief
in accordance with the requirements of this chapter and the Fire Department
Rules and Regulations.
c.
Acting
Fire Chief.
1.
In the event of a vacancy in the office of the Fire Chief, the Deputy
Fire Chief, or any Fire Department Officer if the Deputy Fire Chief
is unable to serve, shall be appointed by the Mayor and Council as
Acting Fire Chief without regard to the requirements of this chapter
or the Fire Department Rules and Regulations, until a successor is
elected by the regular members of the Fire Department and appointed
by the Mayor and Council in accordance with the requirements of this
chapter and the Fire Department Rules and Regulations.
2.
Any fire officer position left vacant as a result of a vacancy in
the office of the Fire Chief shall be temporarily filled by the regular
members of the Fire Department for the duration of the vacancy in
the manner prescribed in the Fire Department Rules and Regulations.
3.
Nothing herein shall be construed to prohibit any person serving
as Acting Fire Chief from being appointed or reappointed, as the case
may be, to the office of the Fire Chief for the full term or terms
so specified in the Fire Department Rules and Regulations.
d.
Election
of Other Officers. The Deputy Chief, First Assistant Chief and each
Captain and Lieutenant shall be elected annually by the regular members
of the Fire Department for terms of one year, to begin on the first
day of January of each year. Their election to office shall be certified
by the Fire Chief to the Mayor and Council and shall be subject to
confirmation by the Mayor and Council.
e.
Secretary;
Appointment and Duties.
1.
The Secretary of the Fire Department shall be appointed annually
by the Fire Chief. It shall be the duty of the Secretary to record
the attendance records of all regular members, call men and auxiliary
members, as supplied to him by the Fire Chief, and compute their annual
attendance percentage to all fires, drills and meetings.
2.
The Secretary shall also record the minutes of the regular monthly
meetings of the Fire Department and furnish a copy of those minutes
to the Township Clerk/Administrator. The Secretary shall also furnish
a copy of the roster of the Fire Department to the Township Clerk/Administrator
on or before December 10 of each year.
f.
Appointment
of Second Assistant Chief; Qualifications. The Second Assistant Chief
shall be appointed by the Chief of the Fire Department, subject to
confirmation by the Mayor and Council. The Second Assistant Chief
shall be a regular member of the Fire Department and shall be available
for fire duty during the day. At such time as the Second Assistant
Chief shall be absent from the township, by reason of vacation, illness
or other just cause or excuse, the Fire Chief shall assign one of
the other officers or members of the Fire Department to cover the
position during that period.
g.
Drivers:
Appointment; Duties and Qualifications. There shall be appointed by
the Mayor and Council, for each company, upon recommendation of the
Fire Chief, as many duly licensed and qualified drivers of the automotive
equipment as is deemed necessary. All drivers shall be regular members
of the Fire Department or call men. All drivers shall be tested and
qualified annually in accordance with Department standard operating
procedures and shall hold their appointments for one year or until
their successors shall have been duly appointed.
h.
Absenteeism.
All officers and drivers shall, to the extent possible, be subject
to call during the day. In the event that any one of them shall leave
the township for more than 24 hours, he shall notify the Chief or
the officer in charge of his pending absence. In the case of sickness
or other medical reason or emergency, he is to notify the Chief within
three days.
i.
In
the event of a vacancy in any officer or driver position, the Chief
shall appoint one of the other officers or members of the fire company
who are so qualified to fill that position. Any new driver so appointed
shall hold the position for the remainder of the term of that position.
Any officer so appointed shall hold office until a special election
is held in accordance with Department standard operating procedures.
This special election shall be held within 60 days of the vacancy.

a.
Control;
Powers. The Fire Chief, or designated officer in charge under the
direction of the Mayor and Council through the Township Clerk/Administrator,
shall have charge and control of all officers, regular members, call
men, auxiliary men and any other members constituting the Fire Department
and shall have charge and control of all other persons offering their
services or who are allowed to serve at a fire or fire drill.
b.
Inspection;
Reports.
1.
It shall be the duty of the Fire Chief, as often as may be necessary,
but not less than semiannually, to inspect the firehouses, fire alarm
system, automotive equipment, apparatus and all other equipment delivered
to the Fire Department and which is the property of the township.
In case of any defects therein or negligence by the Fire Department
to maintain the equipment in its custody or to keep the same in good
order, the Fire Chief shall send a written request to the Township
Clerk/Administrator, requesting the repair of such equipment.
2.
In the event that any defects are discovered in the water supply
system, the Fire Chief shall forthwith orally report the condition
found to the Water Department and shall immediately confirm the report
in writing to the Director of Water and Wastewater Utilities and the
Township Clerk/Administrator.

a.
Regular
Members; Qualifications.
1.
Any person may become a regular member of the Fire Department if
he or she meets the following minimum criteria: 1) attained the age
of at least 18 years; 2) possess a high school diploma or equivalent;
3) be a citizen of the United States; and 4) be a resident of the
Township of West Caldwell, County of Essex. In addition to the aforementioned
requirements, the person shall be physically fit to perform the duties
of a firefighter, evidenced by a certificate to that effect by the
Township Physician after physical examination, according to the forms
provided by the New Jersey State Firemen's Association. The applicant
will also be subjected to a comprehensive background check, as well
as a psychological examination, conducted by agencies of the township's
designation. Any applicant refusing to undergo such a medical or psychological
evaluation or background check or who is unable to produce satisfactory
proof of age, education, citizenship and residency will be denied
membership.
2.
All regular members shall have successfully completed an appropriate
period of orientation and training in the auxiliary fire company,
and one year as a probationary firefighter, before being recommended
as a regular member and certified by the Fire Chief for approval by
the Mayor and Council.
b.
Probationary
Member.
1.
All probationary firefighters shall have successfully completed a
one year orientation and training program in the auxiliary fire company,
or hold a Firefighter I certificate and have had alternate firefighting
experience.
c.
Call
Member.
1.
There may be appointed, upon recommendation of the Fire Chief, as
many persons as deemed necessary who shall be designated "call members"
for definite terms not exceeding one year at a time, who need not
be residents of the Township of West Caldwell and who shall not be
regular members of the Department. Call members shall be required
to attend fire calls, fire drills and meetings at the discretion of
the Fire Chief. They will also be required to spend appropriate time
in the auxiliary fire company, and as probationary members.
2.
Any one or more of the call members, when certified by the Chief,
and approved by the Mayor and Council, may be authorized to be a driver
of the automotive equipment of the Fire Department.
d.
Necessary
Duty; Attendance.
1.
All regular members, probationary members, and call members shall
perform actual fire duty as required by this chapter, the actual fire
duty to consist of responses to alarms, obedience to orders at fires,
responsibility for apparatus and supplies and property protection
of the property in danger after termination of fires.
2.
It shall be the duty of regular members, probationary members, call
members, and auxiliary members to attend to the proper housing of
the apparatus, drying of the hoses and cleaning of equipment so as
to leave the apparatus and equipment ready for immediate use.
e.
Number
of Regular Members.
1.
The number of regular firefighters in each company shall be limited
to 70 members including officers and drivers.
f.
Auxiliary
Fire Company.
1.
There shall be established an auxiliary fire company within the Fire
Department for the sole purpose of training those persons recruited
to become regular members of the Fire Department. The auxiliary fire
company shall be under the direct control of the Fire Chief or officer(s)
designated by the Chief and follow procedures set down by the Fire
Chief.
2.
Members of the auxiliary fire company shall be at least 18 years
of age and shall meet the same educational, physical, psychological,
and background requirements of a regular member.
g.
Junior
Firefighters.
1.
The West Caldwell Volunteer Fire Department (hereinafter "the Volunteer
Fire Department") may create and establish a Junior Firefighter Auxiliary
Program pursuant to N.J.S.A. 40A: 14-95 et seq. and the provisions
of this section. The members of the Junior Firefighter Auxiliary Program
shall be known as, and hereinafter referred to, as "junior auxiliary
members."
2.
Minimum qualifications and requirements. All junior auxiliary members
shall meet the following minimum qualifications and requirements:
(a)
Junior auxiliary members must be between 16 and 18 years of age.
(b)
No individual shall be admitted into the Junior Auxiliary Firefighter
Program unless written permission is obtained from the individual's
parent and/or legal guardian. Permission forms shall be acknowledged
and approved by the Fire Chief, with a copy forwarded to the Township
Clerk to be filed and maintained with the official records of the
township.
(c)
Junior auxiliary members shall meet the same physical, psychological,
and background requirements as all regular members of the Volunteer
Fire Department.
(d)
At a minimum, each junior auxiliary member will be provided with
the following basic training:
(1)
Cleaning and basic maintenance of apparatus;
(2)
Handling, care and use of ladders;
(3)
Handling, care and use of nonpower hand tools;
(4)
The municipal water system; hydrants and alternate means of
water supply;
(5)
Care, handling and testing of fire hose;
(6)
Fire behavior;
(7)
Types and uses of hand held fire extinguishers;
(8)
Communications equipment and protocols;
(9)
Ropes and knots;
(10)
Personal safety;
(11)
Personal protective equipment;
(12)
Safety considerations in boarding, traveling on and disembarking
from apparatus;
(13)
Self-contained breathing apparatus;
(14)
Residential and commercial fire alarms;
(15)
Residential and commercial fire suppression systems; and
(16)
The theory of pumps and hydraulics.
3.
The number of junior auxiliary members shall be limited to 10.
4.
The township shall insure each junior auxiliary member with the same
type and amount of insurance coverage that is provided to regular
members of the Volunteer Fire Department.
5.
Standing committee. The Junior Auxiliary Firefighter Program shall
be under the guidance and supervision of a standing committee whose
members shall be appointed annually by the Fire Chief. The standing
committee shall:
(a)
Establish additional qualifications and/or requirements for membership
in the Junior Auxiliary Program as deemed necessary and appropriate
by the Volunteer Fire Department.
(b)
Establish general rules and regulations governing the Auxiliary Firefighter
Program, including grounds and procedures for the expulsion of members.
(c)
Develop additional training programs and/or coordinate activities
and events for the Junior Auxiliary Firefighter Program as deemed
necessary and appropriate by the Volunteer Fire Department, and subject
to budgetary limitations and considerations.
6.
No junior auxiliary member shall be required to perform any duties
that would expose the junior auxiliary member to the same degree of
hazard as regular or probationary members of the Volunteer Fire Department.
7.
No junior auxiliary member shall be permitted to directly engage
in firefighting of any kind, or be in an area of a hazardous condition
involving the handling of dangerous or poisonous acids or dyes or
injurious quantities of toxic or noxious dust, gases, vapor, or fumes.
8.
Junior auxiliary members shall otherwise abide by the township ordinance
covering the Volunteer Fire Department, and shall observe all rules
and regulations established by the Volunteer Fire Department.
h.
Reappointment
of Prior Service Firefighters.
1.
Any firefighter having been appointed to the Fire Department regardless
of membership classification and who shall have resigned in good standing
shall be eligible for reappointment to the Fire Department under the
expedited prior service procedures set forth below:
(a)
For the purposes of this section, "resigned in good standing" shall
mean: a voluntary resignation not concerning or pursuant to a disciplinary
suspension or dismissal or threat thereof, or the acceptance of a
resignation made under less than honorable circumstances or for the
good of the Fire Department.
(b)
For the purposes of this section, no firefighter seeking prior service
reappointment shall have a break in Fire Department service of greater
than 365 days from the date of the approval of the resignation.
(c)
For the purposes of this section, no firefighter seeking prior service
reappointment shall be reappointed to any membership classification
other than the membership classification from which the firefighter
shall have resigned.
(d)
Notwithstanding any provisions of the Revised General Ordinances
of the Township of West Caldwell to the contrary, no firefighter seeking
prior service reappointment shall be required to submit to a psychological
examination.
(e)
Notwithstanding any provisions of the Revised General Ordinances
of the Township of West Caldwell to the contrary, no firefighter seeking
prior service reappointment shall be required to perform any duty
in the Auxiliary Company unless such duty was assigned prior to their
resignation.
(f)
Unless in conflict with this section, any provisions of the Revised
General Ordinances of the Township of West Caldwell relating to satisfactory
medical examination, proof of age, education, citizenship and residency
shall remain effective as otherwise applicable to any firefighter
seeking prior service reappointment.
(g)
Any firefighter seeking prior service reappointment shall require
the recommendation of the Fire Chief and the approval of the Governing
Body.
(h)
An abbreviated application form for prior service reappointment shall
be developed by the Fire Department Secretary and approved by the
Fire Chief.
(i)
The Fire Chief is hereby directed to promulgate by special orders
any necessary procedures governing the eligibility, review, disapproval
or approval of applications for prior service reappointment not otherwise
in conflict with this Rule or with the applicable provisions of the
Revised General Ordinances of the Township of West Caldwell.
2.
The Mayor and Council, upon the recommendation of the regular members
of the Fire Department, shall adopt and/or modify Fire Department
Rules and Regulations consistent with the implementation of the provisions
of this section.

In all cases of general request for response, available members
of the Fire Department shall report for duty and shall attend to the
fire or incident and shall immediately thereafter report to the officer
in charge and see to it the member's attendance is officially
recorded, as well as to obtain formal release from the incident. Junior
members are specifically exempt from the obligation to report to fire
calls.

a.
There
shall be a regular monthly meeting and a regular monthly drill. Each
member who attends these meetings and drills shall answer a roll call
to ensure his attendance is recorded. Additional meetings and drills
may be called by the Fire Chief or the designated officer in charge.
b.
There
shall also be an annual inspection held, at which time each regular
member, call man and auxiliary member of the Fire Department shall
be present with all issued personal equipment. The Mayor and Council
and the Township Clerk/Administrator shall be notified of this inspection.

a.
All
fire fighters and call men refusing or neglecting to execute any or
all orders given by the Fire Chief or any other Fire Department officers
at any fire, fire drill or other emergency may be suspended by the
directing officer.
b.
Any
fire fighter so suspended shall be reported to the Township Clerk/Administrator
and a due process hearing shall be held by the Township Council on
the charges preferred against him. In the event that the charges are
sustained by a preponderance of evidence, the fire fighter may be
dismissed or suspended from service of the Fire Department and thereupon
be deprived of all benefits and emoluments of the position.
c.
A
regular member of this Department in good standing who shall remove
his residence from the township may retain his membership status in
accordance with the Department Rules and Regulations. The location
of such residence must be within a seven mile radius of the West Caldwell
Fire Headquarters.
d.
Any
auxiliary member in good standing who shall remove his residence from
the township may retain his membership status and shall be eligible
for appointment as a regular member in accordance with the Department
Rules and Regulations. The location of such residence must be within
a seven mile radius of the West Caldwell Fire Headquarters.
e.
Any
regular or auxiliary member of this Department who shall remove his
residence from the township to any other municipality shall be deemed
to have resigned from the Department. Any fire fighter so resigned
from the Department shall return all equipment issued to him to the
Fire Chief and a receipt shall be issued for same.

It shall be unlawful for any person to injure, deface or in
any manner destroy any building or fire apparatus or property of the
Fire Department of the township or any police or fire alarm, telegraph
box or connection of or with the same or to hinder or obstruct any
automotive equipment of the Fire Department from freely passing along
the streets or highways of the township to or from passing over any
property, public or private, or in any manner to hinder or prevent
any of the fire equipment or apparatus or any officer or member of
the Department from operating at any fire or other emergency to which
the Department is responding.

a.
Equipment.
The Mayor and Council through the Township Administrator shall have
jurisdiction over all firehouses and property used in connection therewith,
fire alarm systems, automotive apparatus and all other equipment now
or hereafter owned by the township and used or to be used for the
protection of life and/or property.
b.
Additional
Powers. The Public Safety Committee may make the following recommendations
to the Township Council:
1.
To make such repairs and replacements of the firefighting equipment
as may be necessary.
2.
To purchase or lease quarters for firehouse purposes and such engines,
trucks, apparatus, furniture, paraphernalia and supplies and to make
such repairs as it may deem expedient and advisable, but no expenditures
for any purpose shall be made except from the regular appropriations.
3.
To sell, by advertisement, any and all apparatus and property that
is not needed by the Department, and all money derived from such sale
shall be paid to the township.
4.
To determine and recommend such compensation and terms of employment
of all persons under the authority of this chapter and to establish
such rules as shall appear necessary for the proper governance and
control of the Department.

The Mayor and Council upon the recommendation of the regular
members of the Fire Department shall adopt Fire Department Rules and
Regulations for the governance of the Fire Department. All such rules
and regulations shall be posted conspicuously for members of the Fire
Department.

All members of this Department shall follow the procedure of
chain of command and Department standard operating procedures.

The Fire Chief and all officers, employees and other persons
connected with the Fire Department shall receive such compensation
as shall be determined by the Township Council.

a.
Pension Payment Provided. Pursuant to N.J.S.A. 43:12-28.1, the township
shall provide for the payment of a pension to the widow or minor children
of any volunteer fire fighter who has died or shall have died as a
result of injuries sustained in the course of performance of duty
as a member of the West Caldwell Volunteer Fire Department.
b.
Amount of Pension. The pension shall be $5,000 per year, paid to
the widow during her widowhood or to or for the benefit of the minor
child or children, if the deceased fire fighter leaves no widow, or
to such minor child or children after the death of the widow.
c.
Manner of Payment. The Mayor and Council shall make provision in
its budget for the payment of any such pension, and the same shall
be paid in the same manner as municipal employees are paid.

Pursuant to N.J.S.A. 40:47-53, a fire fighter otherwise qualified
who has performed 60% duty in the Fire Department in each year during
seven years shall be entitled to an exempt fire fighters' certificate,
to be issued within 90 days of the date of his qualification thereof,
and to all the rights, privileges and immunities provided by law for
the holder of such certificate.

A Length of Service Award Program (LOSAP) is hereby created
in accordance with Chapter 388 of the Laws of 1997, being N.J.S.A.
40A:14-183, et seq. to award members of the volunteer fire department
for their loyal, diligent, and devoted services to the residents of
the Township of West Caldwell.

The LOSAP shall provide for fixed annual contributions to a
deferred income account for each volunteer member that meets the criteria
set forth below; that such contributions shall be made in accordance
with a plan that shall be established by the Mayor and Council of
the Township of West Caldwell pursuant to P.L. 1997, c.388 and its
implementing regulations and that such plan shall be administered
in accordance with the laws of the State of New Jersey, the U.S. Internal
Revenue Code, and this section.

The LOSAP shall provide for annual contributions to each eligible
member that meets the criteria as follows:
Shall mean any West Caldwell volunteer firefighter who meets
the minimum annual attendance (30% of fire alarms, drills, meetings
and other Fire Department activities as increased by approved extra
credit events) and training requirements set forth in the Fire Department
regulations;
Shall mean the twelve-month period commencing annually on
January 1, and concluding on December 31, of that year.

An active member shall receive from the township an annual LOSAP contribution based on the number of LOSAP points earned during the year. The maximum LOSAP contribution which an active volunteer member may receive in a year is $1,150 (as may be adjusted annually by the state). An active volunteer member must earn 41 LOSAP points in a year to receive the minimum LOSAP contribution of $100 or 5% of the maximum annual LOSAP contribution, whichever is greater. As set forth in subsection 4-15.5, an active member shall earn LOSAP points based on the following:

The estimated cost of the program has been calculated as follows:
a.
For regular annual services: $66,000 per year.

Each active volunteer member shall be credited with points for
volunteer services provided to the West Caldwell Volunteer Fire Department
in accordance with the following schedule:
a.
Seniority. An active volunteer member shall earn one LOSAP point
for each year, or part thereof, for membership in any volunteer fire
company. An active volunteer member may earn a maximum of 30 LOSAP
points in any year for seniority.
b.
Annual Attendance Percentage. An active volunteer member shall earn
LOSAP points based on attendance at fires, fire alarms, and other
Fire Department emergencies, training or maintenance drills, meetings
or other activities as authorized by the Fire Chief or the designated
office in charge. The number of LOSAP points earned by an active volunteer
member shall be equal to the annual attendance percentage.
c.
Extra Credit. An active volunteer member shall earn LOSAP points
based on attendance at extra credit events (auxiliary drills, duty
crews, work projects, special schools or training in other unscheduled
Fire Department activities) as approved by Fire Chief or the designated
officer in charge. Any extra credit earned by an active volunteer
member shall be applied in accordance with Fire Department regulations
to increase the annual attendance percentage.
d.
An active volunteer member shall receive a percentage of the maximum
