[1993 Code § 125-1]
No person shall detain or fail to return any book, periodical,
pamphlet, artistic reproduction, phonograph recording, audio-visual
material or any other article or property borrowed from the Free Public
Library of West Caldwell after 30 days have elapsed from the date
of mailing by certified mail, return receipt requested, of a notice
demanding the return thereof, addressed to said person at the last
address furnished. Personal service of such notice upon said person
or upon a parent or legal guardian or person over the age of 14 who
resides in the same household as said person may be used in place
of mailing such notice as aforesaid.

No person shall cut, tear, deface, disfigure, damage or destroy
any book, periodical, pamphlet, artistic reproduction, phonograph
recording, audio-visual material or other article or any part thereof
which is borrowed from, owned by or is in the custody of such library.

No person shall remove any book, periodical, pamphlet, artistic
reproduction, phonograph recording, audio-visual material or any other
item or article from the Free Public Library Building without complying
with the rules, regulations and procedures of the library for borrowing
such items or articles.

The Library Director or his designee is authorized to file a
complaint in the Municipal Court or other appropriate court alleging
a violation of this section.

The Board of Trustees of the Free Public Library shall post
in a conspicuous place in the Free Public Library Building a copy
of this section.

Any person who violates or refuses to comply with the provisions
of this section shall, upon conviction thereof, be subject to a fine
not to exceed $200 or twice the cost to replace the book or article,
whichever is greater, and a penalty of not more than $300 for the
second and each succeeding offense.

MUNICIPAL PARK
Shall mean and include the following: Francisco Park; Memorial
Park; Crane Park; Wrensch Park; Richards Park; Rubino Road Park; Firemen's
Park; any and all future parks under the jurisdiction of the Township
of West Caldwell; and all parking, playground or tennis court areas
within or adjacent to any such parks.
MUNICIPAL POOL
Shall mean and include the following: the area of the Cedar
Pool situated on Woodside Avenue; the area of Westville Pool situated
on Westville Avenue; and any parking, playground or tennis court areas
within or adjacent to any such pools.

The following rules and regulations be and the same are hereby
promulgated for the purposes of protecting the health, safety and
welfare of the citizens of the Township of West Caldwell.

The municipal pools of the Township of West Caldwell shall be
closed to the public between the hours of 9:30 p.m. and 8:00 a.m.
prevailing time.

The municipal parks of the Township of West Caldwell shall be
closed to the public and for the parking of any vehicles between the
hours of 9:30 p.m. and 5:00 a.m. prevailing time.

It shall be unlawful for any person to enter in or upon, be
present in or park any vehicle, or suffer or permit to be parked any
vehicle in any municipal park or municipal pool in the Township of
West Caldwell between the hours so designated above, and it shall
be unlawful for any person or persons to at any time remove, damage,
mutilate, deface or destroy any barricade, chain, notice, sign or
other object used at the entrance of any municipal park or municipal
pool, or indicating that any municipal park of municipal pool is closed
during specific hours.

Nothing herein shall be deemed or construed to apply to:
a. Personnel of the Township of West Caldwell and only as specifically
engaged in conducting township business as authorized by the Administrator
or his or her designee; or
b. Any group or organization holding a permit to conduct an activity
in any municipal park or municipal pool during any such prohibited
hours; or
c. Any occasion when use of any such municipal park or municipal pool
is extended until a later hour as authorized by Mayor and Council;
or
d. Any person found in any municipal park or municipal pool by reason
of an emergency.

Any person who violates this section shall, upon conviction thereof, be subject to a penalty as stated in Chapter
1, Section
1-5, General Penalty of this Code.

Regulations setting forth the rules and conditions established
herein and other rules and conditions as are deemed necessary by the
Mayor and Council shall be adopted simultaneously with the adoption
of this section. Such regulations may be amended, as necessary, by
the Mayor and Council. Notice of this section, and any and all such
regulations adopted in accordance with it, shall be posted at the
entrance of every municipal park or municipal pool.
1. Definitions
Municipal Park: Includes the following: Francisco Park; Memorial
Park; Crane Park; Wrensch Park; Richards Park; Rubino Road Park; Firemen's
Park; any and all future parks under the jurisdiction of the Township
of West Caldwell; and all parking, playground or tennis court areas
within or adjacent to any such parks.
The following acts are expressly prohibited and/or regulated by the Township of West Caldwell and shall require enforcement under Chapter
22.
a. Other than in regulated parking areas, no vehicle shall be allowed
within any Municipal Park at any time except for emergency vehicles
or others within written permission from the Township Administrator.
b. It shall be strictly prohibited for one to start or maintain a fire
of any kind or to use barbecue equipment of any kind in any Municipal
Park or any other Township owned or maintained property without the
written express permission of the appropriate authority of the Township
of West Caldwell.
c. It shall be strictly prohibited for one to operate a powered flight
model in any Municipal Park or on other Township owned or maintained
property without the proper permits.
d. It shall be unlawful for a person to enter into any Municipal Park
or on other Township owned or maintained property and post bills of
any sort without the express permission of the Township Administrator.
e. A permit shall be required for organized group/team practices and
games in any Municipal Park. All permits are issued through the Township
of West Caldwell.
f. Private businesses shall be prohibited from using any Municipal Park
or other Township owned recreational facility without the written
permission of the Township Administrator.
g. There shall be no private tennis lessons held on the tennis courts
within any Municipal Park without permits.
h. Bike riding, rollerblading or any non-tennis activity is prohibited
on the tennis courts within any Municipal Park.
i. Consumption of alcoholic beverages is prohibited without the express
written permission of the Township Administrator.
j. The Township may charge and collect in advance a reasonable fee for
admission to or use of facilities, programs, or Activities within
Municipal Parks or other Township owned recreational facilities as
specifically authorized by Resolution.
2. Municipal Parks; Hours and Regulations.
a. The Municipal Parks of the Township of West Caldwell shall be closed
to the public and for the parking of any vehicles between the hours
of 9:30 p.m. and 5:00 a.m. prevailing time.
b. It shall be unlawful for any person to enter in or upon, be present
in or park any vehicle, or suffer or permit to be parked any vehicle
in any Municipal Park in the Township of West Caldwell between the
hours so designated above, and it shall be unlawful for any person
or persons to at any time remove, damage, mutilate, deface or destroy
any barricade, chain, notice, sign or other object used at the entrance
of any Municipal Park, or indicating that any Municipal Park is a
closed during specific hours without a permit from the Township of
West Caldwell.
c. Nothing herein shall be deemed or construed to apply to:
1. Personnel of the Township of West Caldwell, specifically and only
as engaged in conducting Township business as authorized by the Township
Administrator or another appropriate authority; or
2. Any group or organization holding a permit to conduct an activity
in any Municipal Park during any such prohibited hours; or
3. Any occasion when use of any such Municipal Park is extended until
a later hour as authorized by Mayor and Council; or
4. Any person found in any Municipal Park by reason of an unforeseen
emergency.
3. Golf Prohibited.
a. Prohibition. The playing and/or practicing of golf in Municipal Parks
or on other Township owned or maintained property is expressly prohibited
at all times.

The Township Council is hereby authorized to adopt by resolution
amendments, modification, increases and/or decreases to the fee schedule
for membership in the West Caldwell Pool Utility.
