A. The provisions of this Part shall be administered and enforced by
the Zoning Officer, or his duly authorized designee, of the Borough.
It shall be the duty of the Zoning Officer or his duly authorized
designee to inspect any building or premises which may be in violation
of this chapter and to order in writing, the remedying of any conditions
found to exist in violation of any provision of this Part. If the
violation is not remedied in the time period established by the Zoning
Officer, a summons may be issued.
B. Any owner or agent and any person or corporation who shall violate
any provisions of this chapter or fail to comply therewith or with
any requirements thereof, or who shall erect, structurally alter,
enlarge, rebuild or move any building or structure, or who shall put
into use any lot, land, building, or structure in violation of any
detailed statement or plan submitted and approved thereafter, shall
be guilty of a violation. Each and every day such violation continues
shall be deemed a separate and distinct violation. Pursuant to N.J.S.A.
40:49-5, any person or persons who violate any provisions of this
chapter are liable, upon conviction to a fine and not to exceed one
hundred twenty-five ($125.00) dollars for each day of violation.
C. No building or structure, or part thereof, shall be erected, constructed,
reconstructed, structurally altered or moved until a zoning permit
has been issued by the Zoning Officer.
D. No zoning permit shall be issued for the erection, construction,
reconstruction, structural alteration or moving of any building or
structure, or part thereof, unless the plans and intended use indicate
that such building or structure is designed and intended to conform
in all respects to the provisions of this Part.
E. Pre-Framing Survey. For each new building, it shall be a condition
of the zoning permit that an as-built survey shall be submitted to
the Construction Official upon construction of the footing for the
building. The survey shall include a certification from a licensed
New Jersey surveyor that the location and the first floor elevation
comply with the development approvals. Construction on the structure
shall be suspended until the Construction Official determines that
the location and first floor elevation comply with the development
approvals. This determination shall be made within three (3) working
days of the submission. The Construction Official may require, at
his discretion that this requirement be satisfied for structures other
than new principal buildings where there is uncertainty as to compliance
with the development approvals.
F. When a subdivision or site plan, as required by this chapter has been duly reviewed and approved by the Board the erection or alteration of the building shall not be deemed to be completed until all the requirements of the approved subdivision or site plan are met. Where weather conditions or other forces beyond the control of the applicant unduly delay the reasonable occupancy of a building under this subsection, a temporary Certificate of Occupancy may be issued in accordance with Section
21-100.
A permanent Certificate of Occupancy shall be issued only after:
A. All site improvements have been completed in accordance with the
approved final plans and any approved amendments thereto.
B. The applicant's or developer's engineer has certified in writing
that all improvements have been constructed and installed and are
operating in accordance with the approved plans and amendments.
C. Written confirmation from the Borough Engineer that all improvements
have been constructed and installed and are operating in accordance
with the approved plans and amendments.
D. All inspection fees and other outstanding fees have been paid.
E. All conditions required by the Board prior to issuance of a Certificate
of Occupancy have been met.
