[1971 Code § 22-1]
As used in this section:
SOLID WASTE
Shall mean and include all garbage and rubbish normally placed
at the curb by the residents of the Borough for regular once-weekly
municipal collection.
USED NEWSPAPER
Shall mean and include paper of the type commonly referred
to as newsprint and distributed at stated intervals, usually daily
or weekly having printed thereon news and opinions and containing
advertisements and other matters of public interest. Expressly excluded
however, are all magazines or other periodicals as well as all other
paper products of any nature whatsoever.

In order to implement this program, it is requested that all
persons who are occupants of buildings and premises in the Borough
separate used newspapers from all other solid waste produced by such
residents and separately bundle newspapers for pickup, collection
and recycling. The newspapers shall be compacted and shall be tied
securely in bundles not exceeding 50 pounds in weight with a rope
or cord, or placed in paper bags, sufficient to facilitate handling.
Such bundles shall be placed separately at the curb on the previous
day or on the day to be designated for collection.

From the time of placement at the curb by any person of used
newspapers for collection in accordance with the terms hereof, such
used newspapers shall be and become the property of the Borough of
Matawan or its authorized agent.

This chapter is in no way intended to prohibit separate newspaper
drives by outside charitable organizations on days other than those
designated for collection by the Borough upon authorization by resolution
of the Borough Council.

It shall be a violation of this chapter for any person unauthorized
by the Borough to collect or pick up or cause to be collected or picked
up any such newspapers. Any and each such collection in violation
hereof from one or more buildings shall constitute a separate and
distinct offense punishable as hereinafter provided. Each violation
of this chapter shall be punishable by a fine not to exceed $100.

It shall be the duty of the Police Department and the Public
Works Department to see to the enforcement of this chapter and to
prosecute all violations hereof.
