and all persons in, upon or making use of the municipal docks in the Borough shall be bound by and comply with the following rules and regulations.

a. 
The riding of bicycles is prohibited.
b. 
Unnecessary or offensive noise making of any sort is prohibited.
c. 
Disposal or throwing away of tin cans, bottles, garbage, trash or refuse of any kind, except in such receptacles plainly marked for recycling and trash for that purpose as may from time to time be placed in the park by the sanitation department of the Borough is prohibited.
d. 
Use of tennis courts for any purpose other than tennis playing by persons properly attired for that sport is prohibited. Tennis shoes and shirts are considered essential to proper attire as that term is used in this regulation.
e. 
No person shall tie-up or moor a boat or other watercraft to the municipal docks of the Borough for a period not exceeding two hours in duration, provided however, that no person shall tie-up or moor any such boat or other watercraft to said municipal docks for more than one such period in any one day.
f. 
"Day" as used in the foregoing subsection, shall be construed as the 24 hour period between 12:00 p.m. and the succeeding 12:00 p.m.
g. 
No person or persons shall possess, serve, sell or consume any alcoholic beverage in Victory Park, Rogers Park, Piping Rock Park, Sea Bright Bridge Park, Riverside Park, Meadow Ridge Park and any other Borough property unless permission has been duly granted by the Borough Administrator with the approval of the Mayor and Council.
h. 
To willfully mark, deface, disfigure, injure, tamper with, or displace or remove all natural growth, any building, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal is prohibited.
i. 
To operate, park, drive or abandon any vehicle or horse on any area except paved park roads or such other areas as may on occasion be specifically designated by the Chief of Police of the Borough as a temporary area is prohibited. For the purposes of this chapter, "vehicle" is defined as any wheeled conveyance, whether motor powered, animal-drawn, or self-propelled. The term "vehicle" shall include any trailer in tow of any size, kind or description but shall not include baby carriages, wheelchairs and vehicles in the service of the Borough. No slingshots, bows and arrows and firearms of any type shall be permitted.
j. 
No jogging on the playing fields of the Borough parks shall be permitted without Borough Council approval and only for a special occasion such as school event.
k. 
No person or persons shall be allowed to bring a dog into any of the Borough parks.
l. 
The playing of golf or hitting of golf balls is prohibited.
m. 
No person or persons shall be allowed to use skateboards or roller blades in the Borough parks.
n. 
No person shall use or operate model aircraft or model rockets.
o. 
The smoking of cigarettes, electronic cigarettes, cigars or pipes in Borough public parks and beaches within the Borough of Rumson is hereby prohibited. The term "smoking" shall mean the burning of, inhaling from, exhaling smoke from, or the possession of a lighted cigar, cigarette, pipe or other matter or substance which contains tobacco or any other matter that can be smoked including electronic cigarettes, cannabis or related items.

Each group, organization or professional individual, prior to making any use of the playing fields in any of the Borough parks shall, register with a duly authorized agent of the Borough and obtain a permit at the municipal building on River Road in the Borough of Rumson during business hours on Monday through Friday.

True copies of this section shall be conspicuously posted at or near all entrances to all of the above listed public parks and the aforesaid municipal docks.

Victory Park, Rogers Park, Piping Rock Park, Meadow Ridge Park, Sea Bright Bridge Park and Riverside Park shall be open for use from dawn until dusk. No person or persons, other than Borough officers, employees or Police officers engaged in the performance of their duties, shall be in, upon or use said parks from dusk until dawn, except for special events conducted in said parks under the auspices of and under the supervision of the Board of Recreation Commissioners of the Borough.
The exclusion to this regulation shall be any athletic field or court that is illuminated by athletic lights. Use of such lighted fields or courts shall end no later than 10:00 p.m.

Use of tennis courts at Victory Park, Piping Rock Park and Rogers Park shall be as follows:
a. 
Victory Park — 8:00 a.m. to 10:00 p.m. Monday thru Sunday.
b. 
Piping Rock Park — 8:00 a.m. until dusk Monday thru Sunday.
c. 
Rogers Park — 8:00 a.m. until dusk Monday thru Sunday.
d. 
Tennis court use shall be limited to tennis only and all other activities including, but not limited to, roller blading, street hockey, baseball, skate boarding and bicycle riding, are prohibited at all times.

a. 
It shall be unlawful for any person, persons or organization at any time to play soccer, baseball, or any other event on property known as Block 30, Lot 5 adjacent to the Bingham Hall Community Center.
b. 
Penalty. Any person who violates this subsection shall be liable to the penalty as stated in Chapter 3, § 3-1 of these Revised General Ordinances.

a. 
Permit. Use of all playing fields and courts at any of the Borough parks requires the group, organization or professional individual to obtain a field permit at Borough Hall during regular business hours or from the Borough website. Use of the playing field is arranged by the Recreation Director and subject to the rules and regulations as stated on the permit application.
b. 
Field Usage Fees. For use by a Recreation Commission approved camp or clinic run by an independent group, organization or professional individual, or other non-recreation sponsored entity or group, a fee will be charged for the use of the facility. The Recreation Commission shall send to the Mayor and Council a listing of fees to be charged for all permits annually. The Mayor and Council shall adopt a resolution setting forth fees for the calendar year and advise the Chief Financial Officer of the adopted fee schedule.

a. 
Purpose. In order to ensure that the Borough is providing the safest possible recreational programs for its youth, the Borough shall require that criminal history record background checks be performed on any person with unsupervised direct access to minors, as a condition of using the Borough facilities. The recently enacted State Law, N.J.S.A. 15A:3A-1, et seq., permits the Borough to request that the Attorney General's Office conduct a criminal history record background check on each prospective and current person with unsupervised direct access to minors participating in any Borough-sponsored program in connection with the Rumson Borough Recreation Commission. The Department recommends that all such current and prospective persons with unsupervised direct access to minors involved with such youth programs be required to submit to such criminal history record background checks.
b. 
Definitions. As used in this subsection, the following words shall have the following meaning:
CRIMINAL HISTORY RECORD BACKGROUND CHECK
Shall mean a determination of whether a person has a criminal record by cross-referencing that person's name and fingerprints with those on file with the Federal Bureau of Investigation, Identification Division and the State Bureau of Identification in the Division of State Police.
DEPARTMENT
Shall mean the Rumson Borough Police Department.
REVIEW COMMITTEE OR COMMITTEE
Shall mean a four member Committee consisting of the Recreation Director, the Borough Business Administrator, a member of the Recreation Commission and the Chief of Police. The Committee shall be charged with the review of all appeals by any employee or volunteer whose criminal history background check reveals a disqualifying criminal conviction.
SPONSORED
Shall mean recreation run directly by the Rumson Borough Recreation Department, including, oversight, control and/or fiscal contribution.
SUPERVISED
Shall mean to have the direction and oversight of the performance of others.
UNSUPERVISED
Shall mean not supervised or under constant observation.
VOLUNTEER
Shall mean any person involved with a Rumson Borough-sponsored sports program or league who has regular unsupervised direct access to minors as a result of their involvement with the organization.
c. 
Requests for Criminal Background Checks; Costs.
1. 
The Borough of Rumson requires that all employees and volunteers in Borough sponsored recreation programs request through the Rumson Borough Police Division that the State Bureau of Identification in the Division of State Police conduct a criminal history record on such individual.
2. 
The Borough shall conduct a criminal history record background check only upon receipt of the written consent for the check from the prospective or current person with direct unsupervised access to minors.
3. 
The Borough of Rumson shall bear the costs associated with conducting a criminal history background check in accordance with the fees established by the State Bureau of Identification in the Division of State Police and in accordance with N.J.S.A. 15A:3A-2(d).
4. 
The Division of State Police shall inform the Rumson Borough Police Department whether the person's criminal history record background check reveals a conviction of a disqualifying crime or offense specified in 2:40.1(c) of this subsection. Any information received by the Rumson Borough Police Department shall be confidential.
5. 
Any person who, by virtue of their occupation, is required by the statute to undergo a Federal and State criminal history record background check similar in nature to the requirements contained herein, and who can provide proof of the results of such background check, is exempt from the requirement hereunder until three years has elapsed since the most current background check.
d. 
Conditions Under Which a Person is Disqualified from Service.
1. 
A person may be disqualified from serving as an employee or volunteer of a Borough-sponsored recreation program if that person's criminal history record background check reveals a record of conviction of any of the following crimes and offenses:
(a) 
In New Jersey, any crime or disorderly persons offense:
(1) 
Involving danger to the person, meaning those crimes and disorderly persons offenses as set forth in N.J.S.A. 2C:11-1 et seq., such as criminal homicide; N.J.S.A. 2C:12-1 et seq., such as assault, reckless endangerment, threats, stalking; N.J.S.A. 2C:13-1 et seq., such as kidnapping; N.J.S.A. 2C:14-1 et seq., such as sexual assault; or N.J.S.A. 2C:15-1 et seq., such as robbery.
(2) 
Against the family, children or incompetents, meaning those crimes and disorderly persons offenses set forth in N.J.S.A. 2C:24-1 et seq., such as endangering the welfare of a child;
(3) 
Involving theft as set forth in Chapter 20 of Title 2C of the New Jersey Statutes;
(4) 
Involving any controlled dangerous substance or controlled substance analog as set forth in Chapter 25 of Title 2C of the New Jersey Statutes except Paragraph (4) of Subsection (a) of N.J.S.A. 2C:35-10.
2. 
In any other state or jurisdiction, conduct which, if committed in New Jersey, would constitute any of the crimes or disorderly persons offenses described in this section.
e. 
Submission, Exchange of Background Information.
1. 
Prospective or current employees or volunteers shall submit their names, address, fingerprints and written consent to the Department of Recreation for the criminal history record background check to be performed. The Department of Recreation shall submit this documentation to the background check vendor who shall coordinate the background check and refer the information to the State Police and FBI for the initial check. Thereafter, all subsequent background checks shall be submitted to the background check vendor, who shall coordinate a background check every three years after the date of the initial check.
2. 
The Rumson Borough Police Department shall act as a clearinghouse for the collection and dissemination of information obtained as a result of conducting criminal history record background checks pursuant to the subsection below.
f. 
Limitations on Access and Use of Criminal History Record Information.
1. 
Access to criminal history record information for noncriminal justice purposes, including licensing and employment, is restricted to the members of the Review Committee, as authorized by Federal or State Statute, Rule or Regulation Executive Order, Administrative Code, local ordinance or resolution regarding obtaining and disseminating of criminal history record information obtained under this subsection.
2. 
The Review Committee shall limit their use of criminal history record information solely to the authorized person for which it was obtained and criminal history record information furnished shall not be disseminated to persons or organizations not authorized to receive the records for authorized purposes. Use of this record shall be limited solely to the authorized purpose for which it was given and it shall not be disseminated to any unauthorized persons. Any person violating Federal or State Regulations governing access to criminal history record information may be subject to criminal and/or civil penalties.
g. 
Challenge of Accuracy of Report.
1. 
If a criminal history record may disqualify an employee or volunteer for any purpose, the Review Committee's determination shall be provided to the employee or volunteer with an opportunity to complete and challenge the accuracy of the information contained in the criminal history record. The employee or volunteer shall be afforded a reasonable period of time to correct and complete this record. A person is not presumed guilty of any charges or arrests for which there are no final dispositions indicated on the record. The New Jersey State Police shall make the initial recommendation, based solely on the New Jersey State Statutes, to the Police Department who shall provide information to the Review Committee. They shall advise the Review Committee whether or not the volunteer is being recommended. The Review Committee will receive a preprinted form on each individual submitted to the State Police for a background check. One form will be for recommendation and the other will be for rejection. If there is a rejection, the Review Committee may still allow the employee or volunteer to participate. The New Jersey State Police will make a recommendation based on the record only. It is within the Review Committee's discretion to overturn the decision of New Jersey State Police Recommendation.
2. 
The Review Committee shall promptly notify a prospective or current employee or volunteer whose criminal history background check reveals a disqualifying conviction. The person shall have 30 days from the receipt of that notice to petition the Review Committee for a review and cite reasons substantiating the review.
3. 
Notwithstanding the provision of Subsection d of this subsection, no person shall be disqualified from serving as an employee or volunteer on the basis of any conviction disclosed by a criminal history record background check, if the person can affirmatively demonstrate rehabilitation to the Review Committee. In determining whether a person has affirmatively demonstrated rehabilitation, the Review Committee shall consider the following factors:
(a) 
The nature and responsibility of the position which the convicted person would hold or has held, as the case may be;
(b) 
The nature and seriousness of the offense;
(c) 
The circumstances under which the offense occurred;
(d) 
The date of the offense;
(e) 
The age of the person when the offense was committed;
(f) 
Whether the offense was an isolated or repeated incident;
(g) 
Any social conditions which may have contributed to the offense; and
(h) 
Any evidence of rehabilitation, including good conduct in prison or the community, counseling or psychiatric treatment received acquisition of additional academic or vocational schooling, successful participation in correctional work-release programs, or the recommendation of those who have had the person under their supervision.
4. 
The Review Committee shall promptly advise the Department of Recreation, in writing, if a current or prospective employee or volunteer whose criminal history record background check reveals a disqualifying offense has affirmatively demonstrated rehabilitation under this subsection.
5. 
This subsection shall not apply to persons who have been convicted, adjudicated delinquent or acquitted by reason of insanity of aggravated sexual assault; sexual assault; aggravated criminal sexual contact; kidnapping pursuant to Paragraph (2) of Subsection c. of N.J.S.A. 2C:13-1; endangering the welfare of a child by engaging in sexual conduct which would impair or debauch the morals of the child pursuant to Subsection a. of N.J.S.A. 2C:24-4; endangering the welfare of a child pursuant to Paragraph (4) of Subsection b. of N.J.S.A. 2C:24-4; luring or enticing pursuant to section 1 of P.L. 1993, c.291 (N.J.S.A. 2C:13-6); criminal sexual contact pursuant to N.J.S.A. 2C:14-3b, if the victim is a minor; kidnapping pursuant to N.J.S.A. 2C:13-2, or false imprisonment pursuant to N.J.S.A. 2C:13-3 if the victim is a minor and the offender is not the parent of the victim; knowingly promoting prostitution of a child pursuant to Paragraph (3) or Paragraph (4) of Subsection b. of N.J.S.A. 2C:34-1; or an attempt to commit any of these enumerated offenses.
6. 
When the Review Committee determines that the person has affirmatively demonstrated rehabilitation under this act, the organization or Review Committee may file that written notification with the Police Department.
7. 
The Police Department shall keep the written notification on file for three years from the date it was issued.
8. 
A current or prospective employee or volunteer shall not be required to submit to another criminal history record background check if such written notification was issued within the past two years.
9. 
No person or entity shall be held liable in any civil or criminal action brought by any party based on any written notification on file with the Police Department pursuant to the provisions of this subsection.
h. 
Penalty. Failure to comply with this subsection may result in the Borough withholding funding for the program or league, prohibiting the use of facilities, and/or prohibiting the use of facility maintenance.
Former § 10-2, Fishing Prohibited, previously codified herein and containing portions of Ordinance 6/28/51, was deleted in its entirety by Ordinance No. 13-009G.

It shall be unlawful to use within the limits of the Borough and upon the thoroughfares or waterways lying within this State forming a boundary of the Borough any boat propelled in whole or in part by gas, gasoline or naphtha burned or consumed in an engine exceeding 10 horsepower, unless the same is provided with an efficient underwater exhaust or muffler so constructed and used as to muffle in a reasonable manner and to a reasonable extent the noise of explosion.

It shall be unlawful to use within the limits of the Borough and upon thoroughfares or waterways lying within this State forming a boundary of the Borough any boat propelled in whole or in part by gas, gasoline or naphtha burned or consumed in an engine having 10 or less horsepower, unless the same is provided with an efficient muffler or similar contrivance so constructed and used as to muffle in a reasonable manner and to a reasonable extent the noise of explosion.

Any person(s), firm(s) or corporation(s) who violates or neglects to comply with any provisions of this section or any rule or regulation promulgated pursuant thereto, shall be subject to the penalty as stated in Chapter 3, § 3-1.
