Fire Code shall be enforced in the Borough of Rumson, New Jersey, or shall be completed through a shared services agreement with another approved municipality.

The local enforcing agency shall be the Building Department of the Borough of Rumson, under which a Bureau of Fire Prevention is hereby created, or shall be enforced through a shared services agreement with another approved municipality.

The Bureau of Fire Prevention shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures, and premises within the established boundaries of the Borough of Rumson, other than owner occupied one and two family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The Bureau of Fire Prevention established by Section 20-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The Bureau of Fire Prevention established by Section 20-2 of this chapter shall be a part of the Building Department of the Borough of Rumson, or shall be part of a shared services agreement with another approved municipality, and shall be under the direct supervision of the Fire Official, as stated in Section 20-6 of this chapter.

The Bureau of Fire Prevention shall be under the direct supervision of the fire official who may be the Fire Official appointed pursuant to the State Uniform Construction Code Act (P.L. 1975, c. 217).

The Fire Official shall serve for a period of four years. Any vacancy shall be filled for the unexpired term.

Such inspectors and other employees as may be necessary in the Bureau of Fire Prevention shall be appointed by the Mayor and Council of the Borough upon the combined recommendation of the Fire Official, and Construction Official.

Inspectors and other employees of the Bureau of Fire Prevention shall be subject to removal by the Mayor and Council for inefficiency and misconduct when such removal is recommended by the Fire Official. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.

Pursuant to N.J.S.A. 52:27D-206 of the Uniform Fire Safety Act any person aggrieved by any order of the Bureau of Fire Prevention shall have the right to appeal to the Construction Board of Appeals of the Borough of Rumson.

In addition to the inspections and fees required pursuant to the Act and the regulations of the Department of Community Affairs, the following additional inspections and fees shall be required for all commercial properties.
All of the commercial properties shall be subject to a cyclical inspection with a fee of $0 per location.
