A. 
The following rates are hereby fixed for the sale of water by the Park Ridge Water Department within the Borough of Park Ridge and so much of the Borough of Woodcliff Lake as is serviced by the Borough of Park Ridge Water Department effective for all water bills rendered as of April 1, 2024.
B. 
Meter service rates. Whenever the term "fixed charge" is used in this article, said fixed charge shall be in addition to any applicable charges for water consumption.
(1) 
General meter service. This rate shall be applicable to use of water supplied through meters.
(a)

(2) 
General metered service: senior citizens.
(a) 
This rate shall be applied to use of water supplied through residential meters when the following criteria and conditions are met:
[1] 
The customer must be at least 65 years of age or totally disabled.
[2] 
The customer's household income which is that total income earned by all residents of that household is not to exceed $35,000 from all sources taxable and nontaxable, but not including social security.
[3] 
The customer must qualify for senior citizens state tax exemption of real property or for the state-regulated Lifeline Program.
[4] 
All senior citizens to be recertified annually.
[5] 
The Chief Financial Officer shall be the enforcing agent.
(b) 
Senior citizen rates shall be as follows:

C. 
Unmetered service for fire protection. This rate shall be applicable to use of unmetered private fire service and shall be charged for each premises so serviced.

There shall be a water service connection fee established in accordance with N.J.S.A. 40A:31-11 in addition to the fees for water services and supply set forth in Chapter 98. This fee shall, pursuant to statute, be recalculated at the end of each budget year and may be recalculated and changed by ordinance of the Mayor and Council after public hearing, on an annual basis. The water service connection fee shall be payable in full to the Borough of Park Ridge Water Department at the time a building water connection permit is issued for connection to the Park Ridge water system. No water connection permit shall be issued without payment of this fee.

The water service connection fee shall be $2,033 per equivalent dwelling unit as defined by law. The number of equivalent dwelling units for all facilities shall be calculated as follows:
A. 
A single-family dwelling unit shall be equal to one equivalent dwelling unit.
B. 
For all other facilities, the number of equivalent dwelling units shall be calculated as the ratio of projected average daily usage of the proposed facility to the New Jersey Department of Environmental Protection's (NJDEP) recognized single-family residential demand of 300 gallons per day or 108,000 gallons per year. The projected average demand for the facility shall be calculated using the flow standards adopted by the NJDEP under N.J.A.C. 7:14A-23.3, "Projected Flow Criteria," and are incorporated herein by reference.

If any existing building(s) which are connected to the Park Ridge water system are located on the property to be developed, and will be disconnected prior to the construction of the new facility, the equivalent dwelling units shall be calculated as the ratio of the projected net increase in the average daily usage of the proposed facility to the New Jersey Department of Environmental Protection's (NJDEP) recognized single-family residential demand of 300 gallons per day or 108,000 gallons per year. The projected average net increase in the average daily usage shall be calculated as the difference between the projected average daily usage of the proposed facility, less the prior year's average daily usage of the existing facilities that will be disconnected. The water service connection fee shall be based upon the net average increase.

If any section, part of any section, or clause or phrase of this article is for any reason held to be invalid or unconstitutional, such decision shall not affect the remaining provisions of this article. The governing body of the Borough of Park Ridge declares that it would have passed the article and each section and subsection thereof, irrespective of the facts that one or more of the subsections, sentences, clauses or phrases may be declared unconstitutional or invalid.

A. 
The parties recognize and agree that the Borough of Park Ridge will, over the life of the Water Supply Agreement between Park Ridge and Woodcliff Lake dated June 12, 2000 ("the Agreement"), anticipate making capital improvements to the water supply system and the value of those improvements which will benefit the Woodcliff Lake customers and the delivery of water by Park Ridge to all of its customers will be approximately $2,000,000. In order to fund this capital construction, the customers of Woodcliff Lake shall, from the date of this Agreement forward, be charged an annual additional capital construction rate of $53.25 per year which shall be added to their bill and charged pro rata over the course of a year. This surcharge shall be effective as of June 1, 2000.
B. 
When capital facilities are created by Park Ridge, i.e., water supply wells, storage tanks and related equipment and improvements to the distribution system in Woodcliff Lake and Park Ridge, Park Ridge shall, after those facilities are completed, within 180 days after the completion, add these facilities to the ongoing Schedule A list of property in the Borough of Woodcliff Lake with the total cost for the construction of that property. Further, to the extent practicable, these improvements shall also be reflected in the capital budget of the Borough of Park Ridge Water Utility. All facilities that are funded under the capital surcharge as shown in Schedule A by Woodcliff Lake shall be used by Park Ridge and maintained by Park Ridge for the life of this Agreement. At the end of this Agreement, the facilities funded under the capital surcharge shall belong to the Borough of Woodcliff Lake. The Borough of Park Ridge shall have the right within 180 days after the end of this Agreement to purchase these facilities in the same type and manner as provided for in Paragraph 11A regarding the purchase of other facilities currently owned by Park Ridge in Woodcliff Lake. In the event the water supply system requires the installation of a water supply well in Park Ridge to serve Woodcliff Lake customers, then upon completion of the term, if the Agreement is not extended, then the well and related equipment in Park Ridge shall be the property of Park Ridge. Woodcliff Lake, however, shall be allowed to set off against the purchase price of the Park Ridge wells in Woodcliff Lake not funded by Woodcliff Lake the fair market value of this well. The determination of fair market value shall be made in accordance with the provisions of Paragraph 11(a) of this Agreement.
