Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Day-light Savings Time as may be in current use in the Borough.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY — NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY — NO PARKING signs when weather conditions, accidents, fires and public celebration dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY — NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets or highways within the Borough, an emergency shall exist, and no vehicle shall be parked on any street or portion thereof.
b. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

Anyone operating a motor vehicle which damages a traffic control device or any other utility equipment owned, operated and/or maintained by the Borough of Tinton Falls or any other governmental entity, which motor vehicle strikes such traffic control device or other equipment as noted above and causes damage thereto, shall be responsible and liable for the reasonable costs of repair or replacement of such traffic control devices or equipment, which cost shall be determined by the Director of Public Works of the Borough of Tinton Falls. Said person shall remit such costs within 60 days of receipt of a certified mail notice of demand for such for such reimbursement by the Borough of Tinton Falls. Failure to remit such reimbursement demanded herein shall constitute a violation under this section and additional penalties, costs or potential imprisonment as otherwise provided in Section 1-5 of the General Ordinances of the Borough of Tinton Falls may be imposed in addition to any costs necessitated for the traffic control device or equipment so damaged as above. The notice as provided herein shall be deemed acceptable if sent as above to the address of the vehicle operator, as shown on the driver's license of said operator as of the date the damage is incurred.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

All former traffic ordinances of the Borough of Tinton Falls covered in this Traffic Chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

This chapter may be known and cited as the "Traffic Ordinance."

a. 
No person shall operate any low-speed vehicle upon any road, path, bikeway, walking path, right-of-way, parking area or public highway or other property within and under the jurisdiction of the Borough of Tinton Falls, including such property that may be owned, controlled or maintained by the Board of Education of the Borough of Tinton Falls or other property of the Borough of Tinton Falls, its entities or agencies.
b. 
Nothing herein contained, however, shall be construed to prohibit the operation of any low-speed vehicle owned by the State of New Jersey, the County of Monmouth, the Borough of Tinton Falls or the Tinton Falls Board of Education in connection with the maintenance or operation of a public facility located in the Borough of Tinton Falls and/or any other function of municipal government.
c. 
Whenever any words and phrases are used in this section, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated (N.J.S.A. 39:1-1 et seq.) shall be deemed to apply to such words and phrases used herein.
d. 
Violations and Penalties.
1. 
Any low-speed vehicle operated in violation of this section shall be deemed to be a nuisance, and any police officer may impound any such vehicle upon observation of such offense. The owner shall pay the reasonable cost of the removal and storage of any such vehicle so impounded before being permitted to regain possession thereof. Such cost and expense shall be paid in addition to the fine or penalty hereinafter provided.
2. 
For a violation of this section, the offender shall be liable to a penalty of not more than $1,000 or imprisonment for a term not exceeding 90 days, or both.
