Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, Ch. 383) the New Jersey Uniform Fire Code shall be locally enforced
in the Township of Sparta.

The local enforcing agency shall be the Bureau of Fire Prevention
in the Sparta Township Fire Department.

The Bureau of Fire Prevention shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Township
of Sparta, other than owner-occupied one and two family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.

The Bureau of Fire Prevention shall carry out the periodic inspections
of life hazard uses required by the Uniform Fire Code on behalf of
the Commissioner of Community Affairs.

The Bureau of Fire Prevention shall be a part of the Sparta
Township Fire Department.

a. Appointment of Fire Official. The Bureau of Fire Prevention shall
be under the direct supervision of a Fire Official hereinafter known
as the Fire Marshal who shall be appointed by the Township Manager.
This appointment shall be based upon consultation with the Fire Department
Chief and selection shall be made from three candidates recommended
from the Fire Department.
b. Term of Office. The Fire Marshal shall serve for a term of one year,
after which he may be reappointed by the procedures established in
paragraph a. Any vacancy shall be filled for the unexpired term.
c. Inspectors and Employees. Such inspectors and other employees as
may be necessary for the Bureau of Fire Prevention to properly carry
out its responsibilities shall be appointed by the Township Manager
upon the recommendation of the Fire Marshal.
d. Removal from Office. The Fire Marshall, Inspectors and other employees
of the Bureau of Fire Prevention shall be subject to removal by the
Township Manager for inefficiency or misconduct. The Fire Marshal,
each inspector or employee to be so removed shall be afforded an opportunity
to have a public hearing if he/she so desires.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any order of the Bureau of Fire Prevention
shall have the right to appeal to the Construction Board of Appeals
of the County of Sussex.

The application fees for a certificate of smoke detector, carbon
monoxide and fire extinguisher compliance are as follows:
a. Inspection applications filed prior to 10 calendar days before the
closing date, the inspection fee is $50.
b. Inspection applications that are filed within 10 calendar days prior
to the closing, the inspection fee is $100.
c. Exceptions:
1. Short sales where the buyer is responsible for paying for the inspection,
the fee for the inspection will be $50.
2. Foreclosure sales where the buyer is responsible for paying for the
inspection, the fee for the inspection will be $50.

a. The permit fees for Life Hazard Inspections shall be as provided
in the New Jersey Uniform Fire Code.
b. For all commercial occupancies that do not meet the criteria for
Life Hazard Inspection as defined in the New Jersey Uniform Fire Code,
inspection fees are based on the square footage of the occupancy as
follows:

The National Fire Codes of the National Fire Protection Association
shall be used for any fire safety hazard or condition not specifically
addressed by the B.O.C.A. Fire Prevention Code or the New Jersey Uniform
Fire Code.

The State Division of Fire Safety shall collect and account
for the annual registration fees. They shall annually bill for and
take such steps as may be necessary to collect these annual fees.
65% of these fees shall be remitted to the Township of Sparta in accordance
with the provisions of the New Jersey Uniform Fire Code.
No person shall park, stop, stand a vehicle or otherwise obstruct
a fire lane or area which has been established in the Township of
Sparta pursuant to the Uniform Fire Safety Act of the State of New
Jersey.
