Copies of the Code book containing the Code may be purchased from the Municipal Clerk upon the payment of a fee to be set by resolution of the Township Council, which may also arrange, by resolution, for procedures for the periodic supplementation thereof. (Subsection

Each applicant applying for the services of the Municipal Public Defender shall pay a nonrefundable application fee of $200. The fee may be waived or reduced, in part, as the Court determines based on the financial circumstances of the applicant. The application fees collected pursuant to this section shall be deposited in a dedicated fund administered by the Township's Chief Financial Officer. The funds shall be used exclusively to meet the costs incurred in providing the services of the Municipal Public Defender including, when required, any expert or lay investigation and testimony. a. Whenever the Chief of Police authorizes the assignment of a Township Police Officer or Special Officer to quasi-public duty, the fee for this service shall be equal to the Senior Patrol Officer's overtime hourly rate of prior years' pay or a capped rate, determined by the Chief or his designee, until a fee increase is warranted. Officers will receive a minimum of four hours for each assigned detail. There is a 10% administrative fee for all hours worked. A fee will be charged, should a patrol vehicle be required for any such quasi-public duty, not to exceed $50 for any detail lasting up to four hours and, not to exceed, $100 for any detail lasting more than four hours. Requests for copies of government records under the Open Public
Records Act, N.J.S.A. 47:1A-1 et seq.
1. Photostatic copies of any government record that can be photocopied
with municipal facilities - $0.05 per letter size page or smaller
and $0.07 per legal size page or larger.
2. In the event that the actual cost for duplication of a government record exceeds the foregoing rate, the charge shall be the actual cost of duplicating the government records requested. The actual cost shall be the cost of materials and supplies used to make a copy of the record, but shall not include the cost of labor or other overhead expenses associated with making the copy except as provided in Subsection
5 hereof.
3. For any government record copied onto a non-paper medium, the actual
cost of the non-paper medium.
4. For any copy of a government record for which the Township is unable
to duplicate with its own facilities and requires the services of
an outside vendor, the actual cost to the Township from the outside
vendor.
5. Whenever the nature, format, manner of collation or volume of a record
embodied in the form of printed matter to be inspected, examined or
copied is such that the record cannot be reproduced by ordinary document
copying equipment in the ordinary business size or involves an extraordinary
expenditure of time and effort to accommodate the request, the charge
for the record shall be the actual cost to the Township, together
with a service charge of $12 per hour for each hour required to duplicate
the record. The requestor shall have the opportunity to review and
object to the charge prior to it being incurred.
6. In the event that the Township does not maintain the record requested
in the medium requested, the Township shall either convert the record
to the medium requested or provide a copy in some other meaningful
medium. If a request is for a record in a medium not routinely used
by the Township, not routinely developed or maintained by the Township
or requiring a substantial amount of manipulation or programming of
information technology, the cost for the record shall be the actual
cost of duplication together with a special charge that shall be reasonable
and shall be based upon the cost for any extensive use of information
technology, or for the labor cost of personnel providing the service,
that is actually incurred by the Township or attributable to the Township
for the programming, clerical and supervisory assistance required,
or both.
7. Access to electronic records and non-printed materials shall be provided
free of charge, provided however, that the Township may charge for
the actual costs of any needed supplies, such as computer disks.

The fee for participating in the Sparta Township Cooperative
Pricing Council shall be $300 per year payable by March 31.

When a complaint is filed under the provisions of this section, the person filing such complaint shall deposit the sum of $25 to cover court costs with the Clerk of the Municipal Court at the time when the complaint is made. If the complaint is subsequently withdrawn by the complainant, or if for any other reason there is no conviction of the defendant named in the complaint, the sum of $25 shall be retained to cover the costs of making out the complaint and service of the same. In the event the defendant is convicted, he shall be required to pay the costs and in this event the $25 deposit shall be returned to the complainant. (Subsection
3-11.4)
The annual license fee for operating or maintaining each amusement device shall be $10 per year or any part thereof for each device and payable to the Municipal Clerk at the time of the filing of the application. (Subsection
4-2.5a)
The annual fee for the license of tourist homes and motels shall be $10 for each housing or lodging unit, provided, however, that the annual license fee shall not exceed $100 annually. (Subsection
4-7.7)
A fee of $25 shall be paid when filing for a registration permit. The permit application shall be submitted no later than January 31 of each year or within 30 days of installation of the system. A late fee of $5 per month shall be incurred. (Subsection
4-12.4e)
A fee of $25 shall be paid to the Township for any alarm not registered as required by this section. (Subsection
4-12.4f)
The Municipal Clerk is hereby authorized to issue a license for any vehicles to be used in accordance with the terms hereof, upon the payment by the applicant of the initial application fee of $1,000 plus the fee of $30 per vehicle. The annual application fee after the initial application shall be $100 plus the fee of $30 per vehicle. (Subsection
4-16.2)
The annual fee for a deer hunting permit shall be $75, or such other fee established by the Township Council. Applications must be submitted between July 1 and July 31 each year. Permits shall be issued during the first week of September each year. (Subsection
4-3.1)

a. Fees; Term of License. The person applying for the license and registration tag shall pay a fee of $15 for a one-year license and $35 for a three-year license for each dog. Additional fees established by the State of New Jersey will also be incurred. The licenses, registration tags and renewals thereof shall expire on the last day of January in each year. (Subsection
5-2.6)
b. Lost Tags. The owner of any dog may, if the license tag is mislaid,
stolen or lost, procure a replacement dog license and registration
upon the payment of a fee of $1. The owner must provide adequate proof
that the dog is currently licensed for the year in which the replacement
tag is desired. (Subsection 5-2.3e)
c. Delinquent Fees. Any dog owner or person harboring a dog, found to have an unlicensed dog by the Animal Control Officer, dog canvassers or any other municipal official after February 1 of each year, shall be required to pay a delinquent fee of $5 per month for each dog, plus the required license and registration tag fees provided in this section, in addition to any fine imposed for failure to obtain a dog license before February 1. The aforementioned delinquent fee shall not apply to dogs which have been acquired by the owner after March 1, on which the license fee shall be the same as required in Subsection
5-2.5. The owner, however, shall present sufficient proof to establish that the dog was acquired after March 1. (Subsection

d. Fee for License for Potentially Dangerous Dogs. The annual license and registration fee for a potentially dangerous dog is $500 each. (Subsection
5-9.13)

a. Fees. A license shall be issued after payment of a fee of $12 for each neutered cat for a one-year license or $24 for a three-year license and $15 for each unneutered cat for a one-year license or $30 for a three-year license for each unneutered cat. Persons who fail to obtain a license as required by February 1, will be subject to a delinquent fee of $5 per month for each cat. (Subsection

section, per year. However, if the establishment sells only prepackaged
foods such as candy, nuts, fruitcakes and like items, the fee shall
be $20 for foods not contained in indoor vending devices. The fee
for indoor vending machines shall be $10 per machine, with the exception
of gum machines and $0.01 to $0.05 candy machines for which a fee
of $2 per machine shall be charged.
d. Farmer's Market Licenses shall be issued for the period January 1 to December 31 of each year. There shall be a fee of $75 for each Farmer's Market License issued per calendar year or any portion of a year. The payment is due on or before March 1 of each year and in the event the payment is not received by March 1 the applicant shall be subject to a $25 late fee. Subsection
11-2.8 does not apply to the Farmer's Market License.
The following fees are hereby established:
a. For the issuance of a permit to locate and construct a swimming pool, the fee shall be as established in Chapter
12, Subsection 12-1.3a2(h).
b. For the issuance of a permit to alter a swimming pool, the fee shall be as established in Chapter

a. Incinerators. No person shall operate or permit the operation of an incinerator in the Township without a permit issued by the Sussex County Health Department. The Sussex County Health Department shall recommend issuance of a permit for the operation of an incinerator after examining the application and inspecting the facility and being satisfied that it may be operated in accordance with this code. The permit may be conditioned on improvements being made within a prescribed time or on certain operating restrictions, if necessary, to comply with this section. All permits shall be issued by the Sussex County Health Department and shall expire on September 15 following their issuance, or at such time prior thereto as any conditions or restrictions shall not be complied with. Each incinerator shall require a permit for which the annual fee shall be $25 payable to the Township of Sparta. (Subsection

5. Fire protection subcode: The fire protection subcode fees shall be:

Sprinkler systems and smoke and heat detectors.

6. Elevator subcode: The elevator subcode fees shall be:

In accordance with N.J.A.C. 5:23-12.6 (see schedule of fees
of elevator inspection agency on file in construction code enforcement
office).
(b)
Township of Sparta administration fee shall be 15% of the elevator
subcode permit fee.
7. Demolition:
(a)
The fee for a demolition permit for a structure less than 5,000
square feet and less than 30 feet in height for one- or two-family
residences (use groups R-3 and R-4) and all structures on farms regardless
of height, used exclusively for storage of feed or grain or sheltering
of livestock shall be: $75.
(b)
The fee for all other demolition permits shall be: $125.
8. Moving/relocation:
(a)
The fee for a permit for removal of one building from one lot
to another or to another location on the same lot shall be in the
amount of $25 per $1,000 of the estimated cost of moving, plus the
estimated cost of new foundation and all work necessary to place the
building in its completed condition in the new location.
9. Signs:
(a)
Advertising signs shall be computed on the basis of square footage

13. Variation: The fee for an application for a variation in accordance
with N.J.A.C. 5:23-2.10 shall be $423 for class I structures and $85
for class II and class III structures. The fee for resubmission of
an application for a variation shall be $163 for class I structures
and $46 for class II and class III structures.
14. Certificate of occupancy/approval:
(a)
The minimum fee shall be $100 except for one- or two- family
(use group R-3 and R-4) structures of less than 5,000 square feet
in area and less than 35 feet in height and structures on farms (regardless
of height) used exclusively for storage of food or grain or sheltering
of livestock, for which the minimum fee shall be: $50.
(b)
Change of use of occupancy fee: $250 (includes four technical
applications/processing).
(c)
Certificate of continued occupancy fee: $250 (includes four

16. Waiver of fees:

The Township of Sparta waives all construction code fees subject
to exceptions set forth herein for the following entities:
(1)
Sparta Township Fire Department.
(2)
Sparta Township Ambulance Squad.
(3)
Charitable, philanthropic, fraternal, and religious nonprofit
organizations holding a tax exempt status under the Federal Internal
Revenue Code of 1954 (26 U.S.C. Section 501 (c) or (d)).
(4)
Those entities set forth in Section 52:27D-16C of the Uniform
Construction Code Act.
(5)
The within waiver shall not apply to Department of Community
Affairs Training Fees and private enforcing agency fees.
17. Training fees:
(a)
In order to provide for the training and certification and technical
support programs required by the New Jersey Uniform Construction Code,
the Township shall collect a surcharge fee which shall be forwarded
to the Department of Community Affairs of the State of New Jersey.
(b)
This fee shall be computed in accordance with N.J.A.C. 5:23-4.19.
18. Unlisted fees: Construction fees not specifically listed in this

The application fees for a certificate of smoke detector, carbon
monoxide and fire extinguisher compliance are as follows:
a. Inspection applications filed prior to 10 calendar days before the
closing date, the inspection fee is $60.
b. Inspection applications that are filed within 10 calendar days prior
to the closing, the inspection fee is $120.

Annual Life Hazard registration fees shall be collected and
accounted for by the State Division of Fire Safety. They shall annually
bill for and take such steps as may be necessary to collect these
annual fees. Sixty-five percent of these fees shall be remitted to
the Township of Sparta in accordance with the provisions of the New
Jersey Uniform Fire Code.

The term "professional personnel" or "professional services," as used herein, shall include the services of a duly licensed engineer, surveyor, planner, attorney, realtor, appraiser or other expert who would provide professional services or advise to insure an application complies with the standards set forth in this ordinance and other experts whose testimony is in an area testified to be any of the applicant's experts. "Professional personnel" shall include personnel retained by the Township pursuant to a professional services contract, as well as Township employees (i.e., personnel whose services are provided by a Township employee). The charge shall not exceed 200% of the sum of the products resulting from multiplying (1) the hourly base salary, which is established annually by ordinance, of each of the professionals by (2) the number of hours spent by the respective professionals upon review of the application or inspection of the developer's improvements. (Subsection
18-8.3)
a. Residential Development Fees. Residential development in the Township of Sparta that includes less than four residential lots and/or dwelling units shall pay a development fee of 1 1/2% of the equalized assessed value of any eligible residential activity. The term developer shall mean the legal or beneficial owner or owners of a lot or any land proposed to be included in a proposed development including the holder of an option to contract or purchase, or other person having an enforceable proprietary interest in such land. Teardowns and reconstruction of previously existing dwellings are subject to the requirements of this section except existing housing units reconstructed after being destroyed by a catastrophic event such as fire, flood or other natural disaster. (Subsection
18-8.4b)
b. Collection of Fees.
1. Developers shall pay 50% of the calculated development fee to the
Township of Sparta at the issuance of building permits. The developer
shall submit to the Housing Officer an estimate of the assessed value
of the new construction and lot to be verified if required by the
Tax Assessor.
2. Developers shall pay the remaining fee to the Township of Sparta
at the issuance of certificates of occupancy. At the issuance of certificates
of occupancy, the Tax Assessor shall calculate the equalized assessed
value and the appropriate development fee. The developer shall be
responsible for paying the difference between the fee calculated at
certificate of occupancy and the amount paid at building permit.
The following fees and charges are hereby established:
a. The fee for the issuance of a permit to locate, construct or alter
non-public or non-community water system: $150.
b. The fee for the filing of an application and plans and issuance of
a permit to locate, construct or alter a pump and/or storage tank
for the purpose of supplying water to a non-public or public non-community
water system: $40.
c. The fee for each reinspection of a water supply system or part thereof,
caused by the failure of the permittee to locate and construct or
alter the same in accordance with the terms of the permit issued or
the terms of the aforesaid Code shall be for each house or building
to be served: $50.
d. The fee for the review of an application and plans to locate, construct
or alter a non-public or public non-community water system: $40.
e. The fee for the review of an application and plans to locate, construct
or alter a non-public or public non-community water system, after
the initial review which is necessary because of applicant's failure
to submit an application and plans that conform to the required State
Law and Regulations and local ordinances shall be: $25.
f. The fee for the reissuance of a permit that has expired to locate,
construct or alter a non-public or public non-community water system:
$40.
The following prices, annual rentals and water charges are hereby
established by the Township in accordance with the following schedule:
a. Water Use Rates. Customers shall be charged at the rate of $4.50
per 1,000 gallons of water consumption plus a minimum quarterly service

b. Unmetered Customers. Unmetered single-family residences which would
normally be provided with standard 5/8 inch by 3/4 inch service meters,
shall be charged a quarterly flat rate equal to a minimum 25,000 gallons
plus service charge, or alternate usage determined by the Utility
based upon historical records. This flat rate shall also be applicable
to one inch and larger meters.
In those cases where a metered customer has equipment that is
not working properly to determine water usage and access has been
denied to the Township after repeated attempts to repair said equipment,
these accounts shall be charged a quarterly flat rate equal to 75,000
gallons plus the applicable service charge, or alternate usage determined
by the Utility based upon historical records. This flat rate shall
apply until the metering unit can be repaired or replaced. A continued
lack of cooperation with providing a Township agent access to correct
metering functions may result in a loss of water service.
c. Hydrant and Sprinkler Systems.
Public Hydrants – Applicable to municipalities for public
fire protection service provided by the Sparta Water Utility and fee
distributed to benefiting customers $85 per hydrant per quarter.
Private Hydrant – Applicable for private fire protection
through hydrants owned by the Sparta Water Utility or the customer,
and connected to utility-owned mains, and located in private rights-of-way
$85 per hydrant per quarter.
Private Fire Protection – Applicable for private sprinkler
heads, or other fire-fighting facilities connected to a private service
connection, with fee based upon size of service line as it enters
the building.

prior to meter installation). Meters larger than two inches may be
provided and installed by owner/contractor and inspected by the Department.
The fee for meters provided by the Department shall be the actual

j. Water Meter Installation. As requested, water service meters shall
be installed outside of normal working hours for a fee of $100.
k. Supply Line Installation. Supply line installation shall be allowed
at the sole discretion and approval of the Water Utility as follows:
A supply line shall be installed by the Water Department, including
all aspects of labor, materials, and equipment for a fee (tapping
fee) of $4,200 for a 3/4-inch tap; $4,400 for a one-inch tap; and
$4,800 for a two-inch tap. Any additional costs incurred by the Water
Department, above fees listed, as a result of certain subsurface or
above grade conditions or constraints, shall be borne by the applicant.

l. Thawing Privately-Owned Service Pipe. Point of contact for electrical
thawing purposes to any component of the water utility such as a curb
box, or main line or hydrant valve requires approval by the water
utility and shall be subject to the following fees:

m. Meter Readings. Request for special water meter readings other than
the routine quarterly readings obtained by water utility personnel
shall pay a fee of $30 per reading.
n. No Show Service Fee. For any service requiring entry into a building
and a prearranged appointment with the property owner or representative
to gain access by the water utility, an additional fee shall be charged
if the appointment is not met and access to the building cannot be
made by the water utility.

o. Water Quality Sampling. As requested by the property owner, an administrative
handling fee of $25 shall be charged for the sampling of the water
supply at a home or business. This fee shall be in addition to the
laboratory analytical costs to be reimbursed by the property owner
to the water utility.
p. Miscellaneous Service Call Fee. A minimum fee for miscellaneous service
calls not specifically identified elsewhere within this fee schedule
shall be:

q. Special Cases. In special cases not specifically identified or clearly
defined elsewhere within this fee schedule, the Township Manager is
hereby authorized to establish special rates or rentals under such
schedules or formulas as the Township Council may deem necessary to
keep and maintain the Water Department on a self-liquidating basis.
r. Inoperable and Inaccessible Meters. In those cases where the customer's meter is not operating properly so as to be able to determine amount of water usage, there shall be charged each quarter at a rate equivalent to the usage of 25,000 gallons, plus a minimum quarterly service charge as set forth in Subsection
a. In those cases where the customer does not provide access to the Township to read or repair the water meter, there shall be charges each quarter at a rate equivalent to the usage of 75,000 gallons, plus a minimum quarterly service charge as set forth in Subsection
a. The 75,000 gallon rate will apply until the meter can be required, replaced or, if deemed necessary, water service is discontinued.
s. Connection Fee. A connection fee shall be paid by each property connecting
to the municipal water system in accordance with the provisions of
N.J.S.A. 40A:31-11 and this subsection.
1. The procedure for the determination of connection fees shall be as
follows:
(a)
The amount representing all debt service, including but not
limited to sinking funds, reserve funds, the principal and interest
on bonds, and the amount of any loans and the interest thereon, paid
by the Township to defray the capital cost of developing the system
as of the end of the immediately preceding budget year shall be added
to all capital expenditures made by the Township not funded by a bond
ordinance or debt for the development of the system as of the end
of the immediately preceding budget year.
(b)
Any gifts, contributions or subsidies to the Township received
from, and not reimbursed or reimbursable to, any Federal, State, County
or municipal government or agency or any private person, and that
portion of amounts paid to the Township by a public entity under a
service agreement or service contract which is not repaid to the public
entity by the Township shall then be subtracted.
(c)
The remainder shall be divided by the total number of service
units served by the Township at the end of the immediately preceding
budget year, and the results shall then be apportioned to each new
connector according to the number of service units attributed to that
connector. In attributing service units to each connector, the estimated
average daily flow of water for the connector shall be divided by
the average daily flow of water to the average single-family residence
in the Township water system, to produce the number of service units
to be attributed. Estimates of water usage for other than residential
units shall be based upon commonly used engineering standards, as
approved by the Township Engineer. This fee shall be exclusive of
the supply line installation fee. The connection fee shall be recomputed
at the end of each budget year, after a public hearing is held. The
revised connection fee may be imposed upon those who subsequently
connect in that budget year to the system.
2. Subdivisions and Site Plans. Any property receiving either subdivision
or site plan approval for development that has frontage along a right-of-way
or easement containing an existing Water Department distribution main
shall connect to this main and shall pay a connection fee for water
supply and storage in accordance with the provisions of this chapter,
unless stipulated otherwise by a developer's agreement executed with
the Township.
3. Affordable
Housing Connection Fees.

(a)
New connection. Public housing authorities, nonprofit organizations building affordable housing projects, and any other affordable housing including affordable housing units in inclusionary projects, shall receive a 50% reduction in the connection fees established in Subsection
s1 for new connections to the water system.
(b)
Previously connected to system(s). Units previously connected
to the Township's water system that were demolished or refurbished
in order to allow for new affordable housing units and for which a
water connection or tapping fee was previously paid shall receive
a credit in the amount of the connection fee previously paid. However,
the connection fee(s) shall be the lesser of the 50% reduced rate
provided for in Subsection s3a, or the current nonreduced rate minus
the credit for the connection fee previously paid. The affordable
housing developer is responsible to provide evidence of the previously
paid connection fee; failure to provide such proof of payment shall
result in the developer paying the reduced rate provided for in Subsection
s3a.
t. Bulk Water Purchase. A 10% surcharge will be added to the current
water rate per 1,000 gallons of water consumption for bulk water purchase
with no hookup fee or a quarterly service charge. A truck using the
Germany Flats Filling Station shall pay a flat rate of $50 per visit
for a truckload of up to 8,000 gallons.
u. Water Distribution Plan Review. As a condition of the Township's
Master Permit, if in effect with the New Jersey Department of Environmental
Protection (NJDEP), for each permit to construct a water distribution
system, the permit application review fee payable to the Township
shall be the greater of the amounts calculated based on the number
of service connections or the water main length in accordance with
the following table:

The fees and charges under this chapter shall be as follows:
a. Application:
1. For the filing of an application for each soil log/soil test required
for the construction, alteration or repair of an individual sewage
disposal system, to be witnessed and recorded by a representative
of the Health Department the fee shall be $25 per hole.
2. For the review of an application and plans to construct, alter or
repair an individual sewage disposal system, after the initial review,
which is necessary because of applicant's failure to submit an application
and plans that conform to the required State Law and Regulations and
local ordinances the fee shall be $25.
b. License. For the issuance of a license to operate subsurface sewage
disposal system in accordance with N.J.A.C. 7:9-3.14, the fee shall
be $15.
The following schedule of charges for the use of sewer utility
facilities shall apply:
$18.50 per 1,000 gallons or $250 minimum charge per quarter, whichever is higher. (Subsection
20-2.5; 20-4.2)
Where a tap is required into an existing sewer main, a tap-in application fee of $100 shall be charged. The applicant shall also pay the service connection construction cost fee of $1,800. Any additional costs incurred by the Sparta Sewer Utility, above the fees listed, as a result of certain subsurface or above grade conditions or constraints, shall be borne by the applicant. The service connection construction cost fee shall be for the service connection from and including the fitting at the main to and including the cleanout, located in the vicinity of the property line or edge of pavement, as determined by the Township Engineer. The applicant shall have the option to install the service connection with their means at their cost. (Subsection

Connection Fee. All premises required to be connected to the Sparta Township Municipal Sanitary Sewer System pursuant to Subsection
20-2.2 and Subsection
20-3.6, shall pay a wastewater treatment facility connection fee as determined and set forth in accordance with Subsections a and b below.
a. Procedure for Connection Fees.
1. The procedure for determination of connection fees shall be as follows:
(a)
The amount representing all debt service, including principal
and interest paid by the utility for capital improvements to the Plaza
Wastewater Treatment Facility and Collection System shall be calculated
as of the end of the immediately preceding calendar year.
(b)
An equivalent dwelling unit (EDU) shall be defined as a single
family residential dwelling unit. The wastewater flow generated from
a single family residential dwelling unit shall be assigned a value
of 1.00 EDU and the rate of flow in gallons per day is as defined
in Table I, below.
(c)
The number of equivalent dwelling units (EDU), as of the end
of the immediately preceding calendar year, serviced by the utility
shall be calculated by dividing the average daily wastewater flow,
contributed by its users, by the rate of flow assigned to 1.00 EDU.
(d)
The connection fee for the subsequent calendar year shall be
calculated for a single EDU by dividing the debt service, defined
under "a" by the total number of EDU's, defined under Subsection e1(c).
(e)
The connection fee for a single family residential dwelling
unit shall be that for 1.00 EDU.
(f)
For connectors, other than single family residential dwelling
units, the number of EDU's attributed to that connector shall be calculated
by dividing the estimated average daily flow of sewage for the connector
by the average daily flow of sewage from an average single family
residential dwelling unit, as defined in Subsection e1(b) and Table
I.
(g)
The estimated average daily flow of sewage for the connector
shall be based upon metered water usage for the prior two years. If
metered water usage is not available, sewage flow shall be calculated
based upon Table I. If the specific type of use is not covered in
Table I, the sewage flow shall be estimated (based upon sound engineering
criteria and judgment) by the Township Engineer.
(h)
The connection fee for connectors, other than single family
residential dwelling units, shall be calculated by multiplying the
unit price (cost per EDU), as defined under Subsection e1(d) by the
number of EDU's attributed to the connector, as defined under Subsection
e1(f).
2. Calculation of connection fees. Connection fees shall be calculated according to the procedure established in Subsection
20-3.6 Subsection
e1 above, pursuant to Table I, below.

b. Affordable
Housing Connection Fees.
[Added 6-25-2019 by Ord. No. 19-06]
1. New connection. Public housing authorities, nonprofit organizations building affordable housing projects, and any other affordable housing, including affordable housing units in inclusionary projects, shall receive a 50% reduction in the connection fees established in §
20-3.6e1 for new connections to the sewer system.
2. Previously connected to system(s). Units previously connected to the Township's sewer system that were demolished or refurbished in order to allow for new affordable housing units and for which a sewer connection or tapping fee was previously paid shall receive a credit in the amount of the connection fee previously paid. However, the connection fee(s) shall be the lesser of the 50% reduced rate provided for in §
20-3.6e3(a) or the current nonreduced rate minus the credit for the connection fee previously paid. The affordable housing developer is responsible to provide evidence of the previously paid connection fee; failure to provide such proof of payment shall result in the developer paying the reduced rate provided for in §
20-3.6e3(a).
a. The schedule of charges for the use of sewer utility facilities shall
apply as set forth below:
$18.50 per 1,000 gallons or a minimum of $250, whichever is
higher per quarter.
1. Sewer charges shall be based upon the consumption of water measured
by an approved water meter installed on the premises. Where other
water sources are connected to the sewer system, the consumer shall
install a separate, approved meter on the building sewer at his own
expense. Any consumer may, at his own expense, install such a meter
with the approval of the Township. Such installations shall be made
under the supervision of the Department.
2. Sewer users connected to the system who are not water users may be
required by the Department to install suitable metering devices or
they may be billed pursuant to the provisions of Subsection 12-4.17a
of this section.
b. Special regulation of charges.
1. Unspecified users. Any other users of the sanitary sewer system,
not coming within the above group, shall be charged in accordance
with arrangements upon application made to the Township Council of
the Township.
2. New connections. In the event of a new connection, the sewer rental
will be prorated on a monthly basis, with full month charge for the
month for which water service is turned on prior to the 15th of the
month connection is made.
3. Unused building. An unused building connection shall not be connected
with the sewer system until the sewer department has inspected the
same, and has found it to be clean and to conform with the requirements
of this section. If a building is to be unused for more than 90 days,
the owner must notify the sewer utility and request a water turn-off
by the water utility in writing in order to eliminate the minimum
quarter fee.
4. Billings and interest. Billings for sewer service shall be rendered
in accordance with the standard billing period employed by the Department.
Such bills will be mailed within a reasonable time after each billing
date. Bills remaining unpaid for more than 45 days after the billing
date shall accrue interest, from the billing date, at the maximum
rate permitted for nonpayment of real property taxes pursuant to N.J.S.A.
54:4-67, i.e., 8% per annum of the first $1,000 of delinquency and
12% per annum on any amount in excess of $1,000 or at such greater
rate of interest as may hereinafter be permitted by future amendment
to the foregoing statute.
a. Application Fees. Each property owner filing for a sewer allocation
permit shall pay the following permit fees:
1. Single family residential dwellings — $50.
2. Multifamily residential dwellings — $100.
3. All commercial properties — $100.
4. All nonprofit properties — $50.
5. All properties owned by Sparta Township or Sparta Township Board
of Education — exempt.
b. Escrow Fees. For all properties requiring eight or more EDUs, the applicant shall also submit an escrow fee of $500 per project with the application to offset the Township's costs in evaluating and processing the application. In the event that the entire escrow is not utilized by the Township in processing the application, any unused escrow shall be returned to the applicant within 90 days of the processing of the application. In the event that additional funds are necessary to complete the review of the application, the applicant will be required to replenish the escrow account in an amount sufficient to cover said costs. c. Sewer Allocation Permit Fees. Upon approval and prior to the issuance
of a sewer allocation permit, the property owner shall pay to the
Township a nonrefundable allocation reservation fee of $260 per EDU
for any improved property or $515 per EDU for any unimproved property.
Fractional portions of EDUs shall be paid proportionately. No sewer
allocation permit shall be issued unless all application permit fees
and escrow fees have been paid in full and all real property taxes
for the property are current. The property owner shall pay the allocation
permit fee within 90 days of notification by the Township of Sparta
of the granting of the allocation or the allocation shall lapse.

a. Fees and Deposits. Applications for permits referred to herein shall
be accompanied by deposits of money sufficient to cover the fees for
said openings, which fees may be amended from time to time, and any
escrow which may be required to defray inspection costs. The Public
Works Department, upon receipt of a properly completed application,
shall determine the amount of the deposit to be made by the permittee
in accordance with the schedule of charges established by ordinance
of the Township Council. The deposit shall be paid at the time the
permit is received and the deposit shall be used to reimburse the
Township for the cost of all necessary inspections of said work, the
cost of restoration or for any other purpose set forth in this section.
The Township may elect to waive this requirement insofar as it pertains
to a public utility company if such company files with the Township
its corporate bond in a form satisfactory to the Township Attorney,
conditioned upon the payment to the Township of all costs which would
otherwise be covered by and paid out of such a deposit. In the event
any public utility company elects to file such a bond, the Township
shall bill such company monthly for such costs as they accrue. If
any deposit is less than sufficient to pay all costs, the permittee
shall, upon demand, pay to the Township an amount equal to the deficiency.
If the permittee fails or refuses to pay such deficiency, the Township
may institute an action to recover the same in any court of competent
jurisdiction until such deficiency is paid in full. No additional
permits will be issued to such a permittee.

b. Driveways over Drainage Ditches; Permit Required; Fee. No person shall create, construct or put in a driveway over or across a drainage ditch serving any street without first applying to the Township in writing for a permit. The application shall be signed by the owner of the property on which the driveway is to be located, and shall have annexed thereto a simple but legible plan or sketch showing where, how and in what manner the driveway will be constructed over or across the drainage ditch and what materials will be used in permanently preserving drainage space and courses underneath the point where the driveway will cross over the drainage ditch and connect up with the right of way. A non-refundable permit fee of $1 shall accompany each application. (Subsection
21-4.3)
a. Upon the installation of street improvements by a developer and prior to acceptance by the Township, and where properties adjacent to said streets contain occupied dwellings, the developer shall be responsible for the maintenance of said streets including but not limited to maintaining the streets free of snow and ice. In the opinion of the Director of Public Works if a developer has not kept any streets in his control free and clear of ice and snow within a reasonable time after any storm, then the Township shall be authorized to plow or treat said streets for snow and ice and such plowing or treatment shall not be considered an acceptance of the roadways. If the Township shall plow or treat the snow and ice, the developer shall pay to the Township fees which are hereby established at the rate of $0.25 per running foot of street for the plowing and $0.25 per running foot of street for each application of salt and/or sand which fee shall be paid by the developer within 10 days of the submission of a statement to the developer. (§

The applicant shall submit a performance bond or guarantee in
favor of the Township of Sparta in an amount sufficient to assure
reclamation of the site of quarrying operations pursuant to the reclamation
plan. The amount of the performance bond or guarantee shall be based
upon a certified estimate prepared by an engineer licensed in the
State of New Jersey that reflects the maximum reclamation cost (including
regrading, revegetation and demolition of existing structures) that
exist, or could exist, as a result of operations on the licensed property
during the license period. The performance bond or guarantee shall
be posted in accordance with the following standards:
a. The form of the performance bond or guarantee shall be subject to
the approval of the Township Council and, if a performance bond, shall
be a performance bond from a recognized surety company authorized
to do business in the State of New Jersey and approved by the Township
Council or a letter of credit, credit or cash, or such other guarantee
as approved by the Township Council;
b. The amount of the performance bond or guarantee shall be reviewed
and approved by the Township Council based upon information submitted
by the applicant and shall be 110% of the cost of reclamation;
c. The performance bond or guarantee shall remain in full force and
effect during the entire period that quarrying operations are conducted
and until completion of reclamation after the termination of those
operations. The licensee shall post a maintenance bond in the amount
of 15% of the cost of reclamation to cover the period of two years
after the completion of reclamation.
The following fees and deposits shall be submitted with each
original or renewal license application:
a. Initial application fee deposit: $5,000.
b. Renewal application fee deposit: $4,000.
The applicant shall annually post a fee deposit of $4,000 with the Township for reasonable costs associated with services by the Township for conducting inspections. Draws made on the inspection account will be conducted in the same manner as described in §
23-6, Application Fees, above. (§

Pursuant to the terms and conditions of the Cable Television
Act, the Company shall pay to the Township, as an annual franchise
fee, a sum equal to two percent (2%) of the actual gross revenues
received from all recurring charges in the nature of subscription
fees paid by subscribers for its cable television reception services
in the Municipality. In the event applicable law hereinafter permits
a larger franchise fee to be collected, but does not fix the amount
thereof, the Township and the Company shall negotiate in good faith
with respect to the amount thereof provided, however, that nothing
herein shall be construed to permit the Township to require payment
of a franchise fee by the Company that is higher than the fee paid
by all other cable television service providers offering service in
the Municipality.
