Mobile homes and mobile-home parks (and, where made applicable
herein, motor homes and camping trailers) shall be regulated and governed
by this Chapter.

As used in this Chapter, the following terms shall have the
meanings indicated, unless the content requires otherwise.
DEDICATED MOBILE-HOME PARCEL
An area owned all by one (1) owner or the same owners, legally
dedicated in writing solely to mobile-home use. The owner(s) of a
dedicated mobile-home parcel that no longer contains a mobile home
may revoke the dedication in the same manner in which it was dedicated.
MOBILE HOME
A single-family dwelling unit as defined in Section 700.600,
RSMo., that has one (1) of the following characteristics:
1.
Designed to be transported after fabrication upon its own permanent
or detachable wheels or upon one (1) or more flatbed or other trailers;
or
2.
A manufactured home as defined in Section 700.010, RSMo., or
a modular home.
MOBILE-HOME PARK
Any parcel of land, or contiguous parcels of land owned all
be a single owner or the same owners, upon which are located two (2)
or more mobile homes occupied for dwelling or sleeping purposes, regardless
whether a change is made for such accommodation.
MOBILE-HOME SPACE
Ground within a mobile home park designed to accommodate
one (1) mobile home.

A. A mobile home [or, as provided in Subsection
(A)(5) of this section, a motor home or camping trailer] may be placed within the City of Summersville only if it has all the following features:
1.
The mobile home is designed for long-term occupancy and contains
sleeping accommodations, a flush toilet, a tub or shower bath, and
kitchen facilities, with plumbing and electrical connections provided
for attachment to outside systems;
2.
The mobile home arrives on site where it is to be occupied for
dwelling or sleeping complete with major appliances and furniture
and ready for occupancy, except for minor and incidental unpacking
and assembly operations, location and underpinning on foundation or
supports, connection to utilities, and the like;
3.
Within thirty (30) days after arrival at its occupancy site,
the mobile home is tied down and anchored in compliance with Section
700.076, RSMo., in that the mobile home either is required to and
does comply with the federal standards set out at 24 CFR 280.306 (as
provided in 4 CSR 240-124.050) or, if not required to comply with
those federal standards, is tied down and anchored by a manufactured
home tie-down system that meets the anchoring standards set out in
4 CSR 24-124.045; provided, however, that mobile home need not be
tied down and anchored if the Board of Aldermen finds it permanently
attached to a permanent structure having a foundation and such other
structural elements as assure the rigidity and stability of the manufactured
home;
4.
Within thirty (30) days after arrival at its occupancy site,
the mobile home is underpinned (skirted) and has solid-built steps
with railings accessing each door (no portable steps);
5.
Except as provided in Subsection
(B)(3) of this section, the mobile home sits fifteen (15) or more feet away from all boundary lines of the single parcel or contiguous parcels of land, owned by the same owner or owners, upon which it sits or of the dedicated mobile-home parcel upon which it sits [or, where it is a motor home or camping trailer complying with Subsection
(B)(4) of this section, sits (15) or more feet away from all boundary lines of the dwelling-house parcel or parcels upon which it sits], and the mobile home (or motor home or camping trailer) has had its position within the parcel approved by the Board of Aldermen with a view to public welfare; and
6.
The mobile home is at least fourteen (14) feet wide and is valued
by certified appraisal, as of a date before but no more than six (6)
months before its arrival into the City of Summersville, at no less
than ten thousand dollars ($10,000.00) for a single-wide mobile home
less than sixteen (16) feet wide, at fifteen thousand dollars ($15,000.00)
for a single-wide mobile home sixteen (16) feet or more wide, and
at twenty thousand dollars ($20,000.00) for a double-wide mobile home.
The certified appraisal shall be at no cost to the City of Summersville
and shall be approved by the Board of Alderman. When a new mobile
home has been placed within the City limits, a bill of Sale may be
provided instead of an appraisal.
B. Also, a mobile home (or motor home or camping trailer) may be placed
within the City of Summersville only if it is located within one (1)
of the following site categories:
1.
The mobile home sits in a mobile-home park having a mobile-home-park
permit;
2.
The mobile home sits upon a single parcel or, if taking into
consideration contiguous parcels of land owned by the same owner or
owners be necessary to have a parcel of sufficient size, it sits upon
a combined parcel or it sits upon a dedicated mobile-home parcel,
the single combined, or dedicated parcel having an area of at least
ten thousand (10,000) square feet, fronting a street, and having located
upon it no other dwelling of any kind, including not another mobile
home;
3.
The mobile home sits upon the former site of another mobile
home (such site being a "grandfathered parcel" if non-conforming but
occupied by a mobile home before passage of this Chapter and such
mobile home being a "grandfathered mobile home" if non-conforming
but having been on its site before passage of this Chapter), the mobile
home thereby replaces the other mobile home, which was occupied as
a dwelling upon that site within ninety (90) days immediately before
its replacement, and the mobile home at no point encroaches any farther
within fifteen (15) feet of any boundary line of the single parcel
or contiguous parcels of land owned by the same owner or owners upon
which it sits than did encroach the mobile home it replaces; or
4.
It is a motor home or camping-type unit sitting beside a dwelling
house upon the dwelling house's same parcel of land or parcels of
land owned all by the same owners, which motor home or camping trailer
is not itself occupied as a dwelling while there and, if it belongs
to no one living in the house beside which it sits, which has been
within the City of Summersville less than thirty (30) days.

Each mobile-home parcel — single, combined, or dedicated
— not in a mobile-home park shall provide at least one (1) off-street
vehicle-parking space on the parcel for use by the occupants of and
visitors to the mobile home. Such parking space shall have an area
of not less than two hundred (200) square feet, exclusive of driveway
necessary to provide access to a street, and shall be accessible from
the street.

No mobile home, wherever sited, shall be built onto with additional
living, storage or other enclosed or roofed space until the size and
placement of the addition is approved by the Board of Alderman with
a view to public welfare.

A. The mobile-home park shall be located on a well-drained site, graded
to insure rapid drainage and freedom from stagnant pools of water.
B. The mobile-home park shall abut a driveway not less than twenty (20)
feet wide that shall have access to a street.
C. Each mobile-home in the park shall sit upon a mobile-home space that
has dimensions measured perpendicular to each other of at least thirty-five
(35) feet by seventy (70) feet;
D. Mobile homes shall be so harbored in their spaces that there shall
be at least a fifteen-foot clearance between mobile homes, and the
placement of mobile homes upon spaces fronting any street or alley
shall be approved by the Board of Aldermen with a view to public welfare.
E. At least one (1) vehicle-parking space of at least two hundred (200)
square feet shall be provided on each mobile-home space;
F. An electrical outlet, drinking water, and sanitary sewer shall be
provided on each mobile home space at the owners' expense.
G. The mobile-home park shall have a permit as follows:
1.
Its owner(s) shall, on a mobile-home-park application form provided
by the City Clerk; apply and annually reapply for the permit.
2.
The permit shall be for one (1) year commencing July 1 of each
calendar year — a new permit must be obtained for each such
year. The permit fee shall be one hundred dollars ($100.00) for each
such year, with the fee prorated when issued during such year. The
permit form will be promulgated by the Board of Aldermen and will
contain the name and address of an agent (who must be a resident of
Summersville) for service of process on the owner(s) of the mobile-home
park.
3.
The Board of Aldermen shall issue or reissue the permit after
reviewing the proposed mobile-home park. The Board of Aldermen may
refuse to issue or reissue the permit if the park fails or ceases
to conform to the requirements of this Chapter.

Before any mobile home is placed within the City of Summersville
either upon a single, combined, or dedicated parcel, upon a grandfathered
parcel, or upon a mobile-home-park space, the owner(s) of the parcel
or mobile-home park containing the space shall, on a mobile-home placement
application form provided by the City Clerk shall have the authority
to administer and approve the mobile-home placement applications.

Each violation of this Chapter, upon conviction, shall be punishable as set forth in Section
100.220 of this Code.
