No structure or construction of any nature, edifice, pole, post,
basketball standard with hoop and backboard shall be erected or allowed
to exist or remain in the public right-of-way. In addition, no basketball
pole and/or backboard and/or basket shall be constructed on private
property in such proximity to the public right-of-way so that it results
in the participants playing or using such structure within the public
right-of-way. All such structures, construction, equipment and the
playing of games within the public right-of-way are hereby declared
to be prohibited structures, activities and public nuisances.
It is declared to be the policy of the Borough that public rights-of-way
exist primarily for the movement of traffic for the public at large
and not for use as playgrounds.
The existence and continued existence of such prohibited structures
shall be a punishable offense for each day the same continues.
Each violation of this article shall be punishable by a fine
up to $600 per day, and all costs of prosecution incurred by the Borough.
