All pruning, trimming, cutting and removal of planted trees
shall be done under the supervision and direction of the Tree Commission
and by no one else.
Injuring or defacing trees is prohibited. No person shall in
any manner injure, disfigure the bark or any portion of planted trees.
Damage to trees with chemicals or fire is prohibited. No person
shall place on or near or about a tree any liquids, chemicals or other
substances or fire which might injure or damage any of said trees,
or dig in which trees are growing without permission, in writing,
from the Tree Commission.
Tree climbing is prohibited. No person shall climb onto, in,
or about, whether by means of ladders or otherwise, any of the trees
in such a manner as to damage them.
No person shall remove, relocate, or in any manner change the
location or position of any of said trees, except under the supervision
and direction of the Tree Commission.
It is the duty of any person or persons owning or occupying
real property bordering on any street upon which there may be trees
to provide in such a manner that they will not obstruct utilities
(power lines or streetlights), the passage of pedestrians on sidewalks,
vision or traffic signs, or any street or drivable intersection.
It shall be the duty of any person or persons owning or occupying
real property bordering on any street, park or other public land on
which may be trees that are diseased or insect infested to remove,
spray, or treat such trees in such a manner that they will not eject,
damage, or endanger any nearby public vegetation or citizens of the
area.
No person shall intentionally damage, cut, transplant, carve
or remove any tree, attach any wire, rope, advertisements, nails,
posters, or other apparatus to any tree, allow any gaseous liquid
or solid substance which is deemed harmful to trees to come in contact
with them, or set fire or permit any fire to heat to the extent that
it would injure any portion of the tree.
Any person, firm or corporation in violation of compliance with
any of the provisions of this article shall be guilty of a misdemeanor
and upon conviction thereby shall be fined a sum no less than $100
or more than $2,000 or may be imprisoned for a term not to exceed
60 days, or both.
