As provided by law, there is hereby established in the Township of Frankford a Board of Health which shall be composed of seven members, in addition to which there shall be two alternate members.

The members of the Board of Health shall be appointed by the Township Committee and shall be resident of the Township.

a. 
The regular members of the Board of Health shall hold office for a term of three years.
b. 
Alternate members of the Board of Health shall hold office for a term of two years.

If a vacancy shall occur on the Local Board of Health of the Township of Frankford it shall be filled in the same manner as original appointments.

There is hereby established an Open Space Committee which shall consist of seven members, but may consist of up to nine members, and shall not exceed nine members at any time, whose terms and powers are hereinafter set forth.

All members of the Open Space Committee shall be residents of the Township, and shall consist of the following:
a. 
The Mayor or a Committee Member acting as the Mayor's designee.
b. 
Five residents of the Township appointed by the Township Committee.
c. 
Two members of the Frankford Township Land Use Board.
d. 
One member of the Park Commission.
The Township Engineer and Township Attorney shall advise the Committee, as necessary, in a professional, non-voting capacity.

a. 
The members of the Township Committee, Park Commission and Land Use Board appointed to the Open Space Committee shall have a term of one year.
b. 
The terms of the citizen members shall be for three years, and not more than (2) citizens' terms shall expire in any one year.

a. 
The Open Space Committee shall initially prepare a report recommending which parcels of land should be acquired in fee and/or those parcels of land from which the Township should acquire development rights only, as well as which farmland should be acquired for farmland preservation purposes and whether such farmland should be acquired in fee or only by acquisition of development rights. The report required by this section shall be referred to as the Township's Open Space Plan.
b. 
The Open Space Committee shall submit to the Township Committee a prioritized list of properties which it recommends that the Township acquire and/or from which it recommends that development rights should be acquired, as well as which farmland should be acquired for farmland preservation purposes and whether such farmland should be acquired in fee or only by acquisition of development rights. The Township Committee shall review the list as submitted and make a determination as to which properties are to be acquired and shall state the amount of funds that the Committee shall make available for such acquisition.
c. 
After selection of the properties to be acquired referred to in paragraphs a and b above, the Township may proceed to acquire by gift, purchase or by eminent domain proceedings, pursuant to N.J.S.A. 20:3-1 et seq., the identified parcels within the financial constraints established by the Township Committee.

The Open Space Committee shall hold public meetings, which public meetings shall be held in accordance with the Open Public Meetings Act, and the Committee shall give appropriate notification of the meetings.

The Open Space Committee shall select from among its members a Chairperson and Vice Chairperson to serve as the Presiding Officer in the absence of the Chairperson. The Committee shall also select a Secretary whose function shall be to maintain minutes of the Committee's meeting and records of the proceedings of the Committee.

a. 
There is hereby established a reserve in the general capital fund which shall be known and designated as the "reserve for open space acquisition." A separate bank account shall be opened and maintained for this purpose. Funds from the reserve for open space acquisition may, as directed by the Township Committee, be utilized to acquire vacant land, as well as land which has improvement upon it at the time of the acquisition where the principal purpose of the acquisition is to preserve open space and may also be used for maintenance and improvements on properties that are acquired. In the event that the Township Committee shall find it appropriate to apportion the cost of acquisition between open space and improvements, it may do so and charge the reserve for open space acquisition for the approximate value that it deems appropriate relative to open space and the Township's capital account for the value that it determines shall be attributed to improvements.
b. 
The reserve for open space acquisition may also, as directed by the Township Committee, be used for the retention of consultants to assist the Open Space Committee in (a) identifying lands for acquisition in accordance with the Township's Open Space Plan, (b) updating the Township's Open Space Plan, (c) applying for any grants, including but not limited to, planning incentive grants, and (d) for administrative costs associated with any activities permitted under this section.
c. 
The reserve for open space acquisition may be funded through the dedication to the fund of an amount between $0.0 to $0.03 per $100 of assessed valuation of each annual tax levy commencing on tax years determined by the Committee. The reserve shall also be permitted to accept donations and testamentary bequests. The funds accumulated within the reserve may be utilized for the acquisition or development rights of land or as a down payment for the issuance of bonds for the same purpose at the discretion of the Township Committee, provided that the annual levy collected will not exceed $0.03 per $100 of assessed valuation of each annual tax levy. Any and all interest accruing shall remain in the reserve and may be utilized for the above-described purposes.

No property acquired with these funds from the reserve for open space acquisition shall be leased or sold or otherwise diverted until such action has been authorized by the Township Committee in the manner prescribed by law.

In the event that no property is acquired under this section for a period of five consecutive years, then the Township Committee shall review the activities of the Open Space Committee and issue a report with recommendations and conclusions concerning the reserve for open space acquisition and the continued existence of the Open Space Committee.
