There is hereby created a Park Commission consisting of nine
members appointed by the Township Committee. The length of the appointment
of any new members shall be for a term which is staggered such that
upon the expiration of any member's term (either new or existing),
no more than four appointments of members will be necessary in any
one year, to have a full, nine member Commission. A member of the
Township Committee may serve as liaison.
Members of the Commission shall be exempt from any provisions
of any other ordinances of the Township limiting the number of terms
that a member of a board or commission may hold. A member of the Commission
may serve for as many succeeding terms as such member may be appointed
to by the Township Committee. Members of the Commission shall serve
without pay, but shall have their expenses paid by the Township in
the manner provided by ordinance. Members of the Commission shall
be knowledgeable in the area of parks, recreation or land development.

The Commission shall elect one of its members as Chairman and
one as Secretary. The Commission shall keep a correct record of its
proceedings and shall meet at such times as it may determine.

The Commission shall be responsible for satisfying all of the
terms of the Lease granted to the Township from the Department of
Environmental Protection, State of New Jersey in regard to the park
land located at Block 40, Lot 1, Block 44, Lot 1 and Block 39, Lot
13 on the Official Tax Map of the Township of Frankford, as well as
any other lease agreements which the Township may sign in order to
obtain more park land.

The Park Commission shall control the Superintendent in charge
of all public parks located within the Township and any lands or lots,
heretofore or hereafter devised, bequeathed or leased to the Township
for park purposes, and shall direct the ornamenting, adorning, laying
out and pruning of the grounds of the said parks in accordance with
any applicable lease terms or deed restrictions, and for that purpose
may employ such workmen or may use more municipal employees and purchase
or contract for material as they may deem necessary; provided that
in no case shall the amount paid for the workmen or to be paid for
such purchase or contract exceed the amount of money appropriated
for this purpose. The Commission shall ensure that all rents are collected
from any building on said park and shall ensure that rents are deposited
in the appropriate park fund in the Township Treasury, provided that
any revenue collected from the property leased to the Township by
the Department of Environmental Protection will go into a separate
account designated for that purpose in the Township Treasury.

The Commission may employ some competent persons as park custodians,
and define their duties. The salaries of such custodians shall be
set by the Township Committee.

All receipts on account of the Township parks, whether rising
from rentals, donations, sale of any part thereof, or of any lands
so willed and devised by any person to the Township, shall be exclusively
expended and applied under the direction and control of the Park Commission
provided that a separate account is kept in regard to those receipts
on account of the property leased to the Township by the New Jersey
Department of Environmental Protection.

The Commission shall keep the Mayor and Township Committee regularly
informed about the activities of the park lands by oral or written
reports.

The Commission may ask for and receive directives from the Mayor
in the event that action normally requiring Township Committee approval
is necessary in an emergency situation.

The Commission shall exercise general supervision over conditions
of sanitation and cleanliness in the park lands to the extent that
such supervision has not been delegated by the Township Committee
to others and may take necessary measures authorized by law for the
preservation of promotion of such conditions.

The Commission shall maintain a program of park land conservation
rehabilitation to improve the physical environment of the park lands
and take necessary measures authorized by law for the preservation
or promotion thereof. The Commission shall prepare a master plan for
the development, maintenance, operation and public use of the park
lands located in the Township for recreational purposes. A separate
master plan must be submitted to the Department of Environmental Protection
of the State of New Jersey for those park lands located in the property
leased to the Township from the N.J.D.E.P. providing for a master
plan for the first 10 years of the lease. The Commission shall provide
information to the public on park land development and shall develop
a program of citizen participation in the development and organization
of the park lands.

Meetings of the Park Commission shall be conducted in compliance
with the requirements of the "Senator Byron M. Baer Open Public Meetings
Act." A schedule of regular meetings for the year shall be advertised
on or before January 10 of each year. Any other meeting shall comply
with the adequate notice or emergency meeting requirements of the
Act. A written agenda may be prepared and posted with respect to any
meeting, which said agenda shall, to the extent known, identify the
business to be conducted at the meeting. Any agenda shall be subject
to additions or deletions, in the sound discretion of a majority of
the Commission.

The Park Commission shall create planned recreational services
for the Township. The term "recreation" shall be interpreted broadly
to include, but not be limited to, formal and informal games, hobbies,
hiking, bicycle riding and any other recreational activities proposed
by the Commission to take place in the park lands.

The Park Commission shall propose rules and regulations governing
all public parks and lands under its control, which shall become effective
after approval by adoption of a resolution by the Township Committee,
who shall approve all rules and regulations and/or amendments thereto.
The Park Commission shall make available to the public copies of the
rules and regulations upon request.
