This chapter is established to regulate premises on which swine
are maintained; establishing minimum standards governing their location
and maintenance of such premises, authorizing inspection of such premises;
declaring and defining certain acts and conditions on such premises
as nuisances; and declaring and fixing penalties for violations thereof.

The words, terms or phrases listed below for the purpose of
the Code and chapter shall be defined as follows:
GARBAGE
Shall mean and include waste material containing animal and
vegetable matter or only animal matter originating in houses, kitchens,
restaurants, slaughter houses, rendering plants, hotels, produce markets,
etc.
PERSON
Shall mean and include an individual, firm, corporation,
association, society, partnership, and their agents or employees.
SWINE
Shall mean animals of the porcine family excepting offspring
of said animals which offspring are permanently removed from the premises
upon being weaned.

The premises on which swine are maintained shall meet and constantly
conform to the following requirements:
a. The location of the swine shall be in such a place as to preclude
odors and sounds therefrom from interfering with the comfort and enjoyment
of life and property of neighboring premises.
b. Buildings, food storage bins, appliances, equipment, feeding areas
and other facilities on the premises which might provide food or shelter
for insects or rodents must be constructed and maintained in such
a fashion as to permit proper cleansing of the same to prevent insect
and rodent harborage.
c. A water supply must be adequate for proper sanitation.
d. A sufficient supply of clean water available for all swine to drink
at all times.
e. Water and other liquid to which mosquitoes may have access shall
be properly treated to prevent the breeding of mosquitoes.
f. Animal wastes, garbage or vegetable matter deposited on the premises
must be disposed of in such a manner as to prevent insect or rodent
harborage or pollution of the air or any body of water.
g. Garbage which is to be fed to the swine shall be:
1. Thoroughly cooked in apparatus approved by the enforcing official
at a temperature of not less than 185° F.
2. When the premises feeds a ton or less of garbage a day, there must
be enough equipment to heat-treat all of the garbage at one time period.
3. Vats or containers which are used for the heat treatment are to be
large enough to insure that the contents do not boil over during the
heat treatment and the covers shall be made of solid material, shall
be tight, and shall be so constructed that water's condensation
will return to the garbage rather than escape into the atmosphere.
4. Vats or containers which are used for the heat treatment shall have
at least one functioning thermometer, capable of registering at least
212° F. and suitable for measuring the temperature of garbage
being treated.
5. Heat treatment of all garbage shall be accomplished within 40 hours
of receipt of that garbage on the premises and must be fed or otherwise
disposed of within 72 hours of cooking.
h. Any garbage containers holding food for the swine shall be leak-proofed
and covered. The covers shall be constructed so as to prohibit rodents,
other animals, birds and any escaped swine from access to the garbage
or any drainage associated therewith.
i. There shall be adequate equipment available to maintain the premises
in a sanitary condition at all times.
j. The minimum floor space shall be five square feet per animal for
swine up to 100 pounds, 7.5 square feet per animal for swines from
100 to 150 pounds, and nine square feet per animal for swine over
150 pounds.
k. All shelters and feeding areas shall have satisfactory drainage and
there are to be no pools of stagnant water within these areas.
l. Garbage shall not be fed to the swine on the ground.
m. The premises where the swine are maintained shall be kept free of
bones, cans, paper, glass and other trash and these shall be stored
in containers until removed from the premises. Any feeding containers
or platforms shall be cleaned before each feeding.
n. Refuse such as residual garbage and manure which are removed from
the pens, feeding platforms and buildings, shall be disposed of and
by a method that is in compliance with the State and local ordinances
and/or agricultural management practices.
o. Liquid wastes including wash water and urine shall not pollute receiving
waters nor shall they become a nuisance or health hazard, and shall
be disposed of appropriately.

Any premises on which swine are maintained in violation of this
chapter are hereby declared to be a nuisance and detrimental to the
public health.

Any person who violates any provision of this chapter shall
be liable for a fine as permitted by BH1-5.
